Fisker Is Bankrupt, but Its Patents Keep Moving Through the USPTO

Fisker’s bankruptcy did not stop continuation applications from reaching patent grant. Here is what the bumper and mirror patents establish about ownership, design rights and a possible Ocean comeback.

Fisker’s Chapter 11 filing did not stop patent applications already in the examination pipeline. Two continuation applications filed on July 23, 2024—weeks after the company announced bankruptcy—later produced U.S. design patents for a front bumper and a set of side mirrors. Those grants show patent prosecution continued; they do not show that Fisker resumed manufacturing, launched a new vehicle, or put replacement parts on sale.

Why patents can continue after a bankruptcy filing

Fisker Group announced Chapter 11 protection in the District of Delaware on June 17, 2024. The company said it had concluded that pursuing a sale of its assets under Chapter 11 was the most viable path forward.

A bankruptcy filing places a company and its assets under court-supervised administration; it does not automatically cancel every pending intellectual-property application. Applications can remain in examination, and continuations can be filed when the applicant or an authorized successor is preserving design or other patent rights. The U.S. Patent and Trademark Office can therefore issue a patent after the operating company has stopped producing vehicles.

That is the explanation for the timing here: the cited applications are continuations of earlier applications, not evidence that Fisker began a fresh vehicle program after bankruptcy.

The two Fisker design patents

Both records identify the same continuation chain: application 29/824,377, continuing application 29/735,838. Each record states a 15-year term. Because these are U.S. design patents, the protection concerns the ornamental appearance shown in the patent drawings, rather than a broad claim to every bumper or mirror that performs the same function.

What the grants do—and do not—prove

They confirm ongoing patent prosecution

The filings and later grants establish that Fisker-related parties kept these applications alive through the USPTO after the June 2024 bankruptcy announcement. A grant gives the patent owner enforceable design rights subject to the normal limits of design-patent law and the stated term.

They do not confirm a new car

Nothing in the two patent records announces a new model, a production schedule, financing, tooling, or a manufacturing contract. A design application can preserve an asset for licensing, sale, enforcement, or future use without any vehicle being built.

They do not show parts are available

The records do not establish that a Fisker Ocean bumper or mirror is being manufactured, that a particular part fits a customer’s vehicle, or that an authorized seller has inventory. Treat any claim that these patents represent commercially available replacement parts as unverified unless supported by separate fitment and inventory evidence.

Who owns Fisker’s patents now?

The two cited USPTO records name Fisker IP/Austria Assets Trust as assignee and Fisker Inc. as filer. That is the ownership information shown for those specific patents in those records.

It is not enough to establish the complete present-day ownership chain for every Fisker patent or application. A bankruptcy estate can sell, license, assign, or otherwise transfer intellectual property, and a portfolio can include assets in different jurisdictions and entities. The available records do not establish whether additional transfers occurred after the applications were filed.

A 2024 Fisker debtor filing described, in its petition-date context, 60 patents issued in the United States and 11 issued in non-U.S. jurisdictions. The filing said the patents and applications covered areas including vehicle design, engineering, and battery technology. Those figures are historical and should not be treated as a current, complete portfolio count.

What bankruptcy records say about the vehicle business

Production relationships ended

A separate bankruptcy filing described Magna as the Ocean manufacturer at its Graz, Austria facility and Foxconn as the planned PEAR manufacturer. It reported 6,200 Oceans globally as of the petition-date context—a historical filing figure, not a current fleet count.

Magna’s 2025 annual report says Fisker sought Chapter 11 protection in the United States and similar protection in Austria during 2024. Magna also says it terminated the Fisker Ocean manufacturing agreement in the bankruptcy proceedings and recognized $196 million of remaining deferred revenue into income. That confirms the manufacturing arrangement ended; it does not, by itself, identify the current owner of the entire patent portfolio.

Case administration can continue

A Verita case-portal search result showed a post-confirmation report for the quarter ending June 30, 2026, indicating that bankruptcy administration continued through that period. Ongoing docket activity is normal for an estate being wound down or administered and is not evidence that Fisker restarted vehicle operations.

Does this mean the Fisker Ocean is coming back?

No conclusion of a relaunch follows from these patents. A return to production would require substantially more than design rights: an owner or investor with control of the relevant assets, financing, engineering and regulatory work, suppliers, a manufacturing arrangement, service support, and a viable commercial plan. None of those elements is established by the two USPTO grants.

The most defensible reading is narrower: Fisker-related design assets continued through the patent system while the bankruptcy process handled the company’s broader affairs. A future buyer could theoretically use or license such assets, but that is speculation rather than a plan disclosed in these records.

How to interpret similar post-bankruptcy patent headlines

  1. Check the filing date. A post-bankruptcy filing may be a continuation of an earlier application, as both cited Fisker cases are.
  2. Identify the patent type. A design patent protects ornamental appearance; it is not proof of production capacity or a complete vehicle invention.
  3. Read the named assignee carefully. The assignee on one patent does not establish ownership of every related application or asset.
  4. Separate rights from operations. Patent grants, bankruptcy administration, manufacturing contracts, and parts inventory are different questions requiring different evidence.
  5. Look for transfer documents before making a current ownership claim. Bankruptcy sale orders, assignment records, and the live USPTO register are needed to trace later changes.

The practical bottom line for Fisker owners and observers

The bumper and mirror patents may matter to whoever controls Fisker’s intellectual property, particularly for licensing or design-right enforcement. They do not guarantee a source of replacement parts for owners. Customers should verify an actual supplier, part number, vehicle fitment, warranty terms, and shipping geography independently before paying for any purported Fisker component.

For investors and industry watchers, the lesson is straightforward: intellectual-property rights can outlive an operating company. The February 2026 bumper grant and March 2025 mirror grant show that legal rights continued moving through the USPTO, while the manufacturing relationship described by Magna ended in bankruptcy proceedings. Patent activity alone is not a corporate comeback.
