Yes—commercial finfish farming remains prohibited under the 2025 text of Alaska Statute 16.40.210. Governor Mike Dunleavy proposed a limited permit system for certain non-salmon finfish in inland closed systems in 2025, but the legislative records cited here show HB 111 and SB 108 in committee, not enacted. Salmon farming would remain prohibited even under the proposal.

What Alaska’s current law prohibits

The 2025 text of Alaska Statute 16.40.210 prohibits growing or cultivating finfish in captivity or under positive control for commercial purposes, subject to listed exceptions. The statute citation is a secondary reproduction of the 2025 code; consult the current official code and applicable regulations for exact legal wording before acting on it.

Activities the statute treats differently

  • Specified state fishery activities.
  • Certain sales by nonprofit salmon hatcheries.
  • Ornamental finfish kept for aquariums or ornamental ponds, provided they are not reared in or released into state waters.

These exceptions mean the prohibition is not a ban on every form of fish rearing. They do not, however, create a general commercial-farming allowance.

What Dunleavy’s 2025 bills proposed

In February 2025, Governor Mike Dunleavy transmitted House Bill 111 and Senate Bill 108, proposing a permit path for cultivation and sale of certain finfish in natural or artificial inland closed-system bodies of water. The governor described a system in which the Alaska Department of Fish and Game commissioner would issue permits in consultation with the Department of Environmental Conservation commissioner. A permit holder could operate a farm and acquire, hold, transfer, offer, or sell stock and farm products subject to agency rules and oversight. Proposed limits and safeguards

  • Salmon excluded: pink, chum, sockeye, coho, chinook, and Atlantic salmon were excluded from the proposed eligible finfish.
  • Sterile fish: fish acquired under a farm permit would have to be sterile triploids.
  • Escape barrier: farms would need an escape-proof enclosure.
  • No artificial propagation: the proposal did not authorize it.
  • Private-lake stocking: personal stocking of a privately owned lake without a permit would be allowed only if the lake had an escape-proof barrier.

Those are proposed conditions, not requirements or permissions that took effect merely because the bills were introduced. Dunleavy’s February 24 statement put the salmon point plainly: “Salmon farming will remain illegal under this legislation.” (Governor’s statement.)

What the legislative records show

The Alaska Legislature’s bill-history pages identify HB 111 as a 2025–2026 bill introduced by the House Rules Committee at the governor’s request, with the displayed status “(H) FSH” (House Fisheries). SB 108 is shown with the displayed status “(S) RES” (Senate Resources). The records show no passage or chapter enactment; their displayed status dates are February 21 and February 24, 2025, respectively. Because bill records can change, check the HB 111 and SB 108 trackers for later action before relying on that status.
