Fidelity Data Breach Exposed Customer Information: What Happened and Settlement Status

A state filing reports 77,099 people affected by Fidelity’s August 2024 data incident. Here are the potentially accessed data types, proposed settlement benefits, and what remains unknown about approval and payments.

A Maine Attorney General breach record reports that 77,099 people, including 337 Maine residents, were affected by an August 2024 Fidelity Investments data-security incident. The settlement administrator says information potentially accessed varied by person and could include names, Social Security numbers, financial account information, and/or driver’s-license information. The settlement’s listed claim and hearing dates have passed, and the available administrator pages do not establish the court’s later decision or current payment status.

What happened in the August 2024 Fidelity data breach?

Maine’s Office of the Attorney General record identifies Fidelity Investments as the entity involved. It lists the incident dates as August 17–19, 2024, discovery on August 19, 2024, and written consumer notification on October 9, 2024. The filing reports 77,099 people affected nationwide, including 337 Maine residents; that is the figure reported in the state filing, not a count established here as a court finding. The settlement administrator describes an unauthorized third party accessing and obtaining certain information on Fidelity’s network during August 17–19, 2024. Its FAQ says the personal information potentially accessed differed among individuals and may have included names, Social Security numbers, financial account information, and/or driver’s-license information. That wording does not mean every affected person had every listed data type exposed, nor does it establish misuse of each type. Settlement administrator FAQ.

What lawsuit is connected to the incident?

The case is In re: Fidelity Investments Data Breach Litigation, Case No. 1:24-CV-12601-LTS, in the U.S. District Court for the District of Massachusetts. The defendants are FMR LLC and Fidelity Brokerage Services LLC, both doing business as Fidelity Investments. The administrator states: “Fidelity denies that it did anything wrong, and the Court has not decided who is right.” A proposed settlement is not a finding that the defendants were liable. Who was included in the settlement class?

The administrator’s class definition covers U.S. individuals who received Fidelity’s state-law incident notice by the settlement notice deadline, as well as other U.S. individuals whose account number and routing number were exposed. For a compromised joint account, the displayed definition allows one claim. Being a Fidelity customer by itself does not establish eligibility; the administrator’s definition and any current court-approved terms control. Settlement administrator.

What did the proposed settlement provide?

The administrator’s FAQ, accessed October 4, 2026, describes a $2.5 million settlement fund. It says the fund would first pay court-approved attorneys’ fees and costs, service awards, and administration expenses, with remaining funds supporting the listed benefits. These are descriptions of proposed terms; the page does not establish that the court approved them or that benefits were paid.

  • Documented losses: Reimbursement of incident-related, documented out-of-pocket losses up to $5,000. The FAQ gives the eligible loss period as August 17, 2024 through July 27, 2026.
  • Pro-rata cash payment: An expected $100 payment, which may be higher or lower depending on claims filed.
  • California CCPA payment: An expected $50 payment for eligible California residents, also subject to variation based on claims.
  • Monitoring and restoration: Two years of CyEx Financial Shield Complete for class members, as described by the settlement FAQ.

The stated cash amounts are estimates, not guaranteed payments. The administrator says payments depend on court approval and resolution of any appeals. It separately says the $5,000 reimbursement is for documented losses it connects to the incident.

Have the claim deadline and approval hearing passed?

Yes. The administrator listed June 26, 2026 for objections and opt-outs, July 9, 2026 for the final-approval hearing, and July 27, 2026 for claims. Each date had passed by October 4, 2026. Although the administrator homepage still said court approval remained to be decided, the pages reviewed do not establish the later court outcome or current claims and payment status. How is this different from Fidelity’s 2023 life-insurance incident?

A separate incident involved Fidelity Investments Life Insurance and Empire Fidelity Investments Life Insurance, not the August 2024 Fidelity Investments event. Maine’s separate record describes an Infosys McCamish Systems vendor software incident from October 29 to November 2, 2023, discovered February 13, 2024. That record initially lists 28,268 people. The two records describe different entities and events, and their population figures should not be combined.

What monitoring was described for affected consumers?

Maine’s record for the August 2024 incident lists TransUnion credit-monitoring and identity-restoration services offered for 24 months to notified consumers. The settlement FAQ separately describes two years of CyEx Financial Shield Complete as a proposed class benefit. These are different programs; the available information does not establish current enrollment availability or terms for either. Maine Attorney General record; settlement administrator.
