The reported theory focused on Meta as a platform and advertising intermediary. “Profited” in this context meant the possibility that Meta received payment for ads promoting unlawful services. The public reporting did not establish that Meta took a share of drug-sale proceeds, processed drug purchases, or directly participated in selling or distributing drugs.
What the reported inquiry did—and did not—establish
The subpoenas were a step in an investigation, not proof of wrongdoing. The public information did not establish that Meta knowingly approved unlawful advertisers, that prosecutors had decided to bring a case, or that a court found Meta liable. Advertising records could help investigators identify who bought ads, what they said, how long they ran and what Meta charged. They could also shed light on advertiser review, removals or warnings, but the public reporting did not verify the full evidentiary theory or what specific records prosecutors sought beyond the broad descriptions above.
- Advertiser conduct: A seller’s unlawful activity would not, by itself, establish that Meta knew about or assisted it.
- Moderation: An ad can violate Meta’s rules without necessarily constituting a crime; an ad that remains online is not automatically lawful.
- Knowledge and involvement: Whether Meta knew an advertiser was unlawful, and what it did after any warnings, remained open questions in the reported inquiry.
Why online pharmacies and telehealth ads were part of the story
Online drug businesses are not one legal or medical category. A licensed pharmacy advertising a legitimate prescription service is different from a provider that dispenses without appropriate medical oversight, a seller of counterfeit or unapproved products, or a criminal operation using social media to find customers. A prescription-drug ad is not illicit merely because it advertises a medicine online.

The 2024 coverage placed the inquiry amid concerns about companies offering access to controlled substances and drugs in high-demand markets, including Adderall, opioids, Ozempic and Wegovy. Those references describe the wider context in the reporting; they do not establish that every named drug, provider or advertisement was specifically tied to the subpoenas.
Relevant distinctions can include whether a clinician was licensed and required a valid prescription; whether a pharmacy was licensed; whether a product was approved or lawfully compounded; what medical claims an ad made; and whether customers were redirected off-platform to complete a purchase. The public summaries did not identify the specific advertisers or establish how those factors applied in individual cases.

What Meta said about drug content
Meta’s stated policy is that illicit drug sales are prohibited. In a May 9, 2023 statement, the company said it removed content involving drug sales and misuse, took action against people and organizations attempting to organize illegal sales, and cooperated with law enforcement. Meta also described work with Snapchat to identify activity associated with illicit drugs.
Those are Meta’s descriptions of its policies and enforcement efforts; they do not independently show how consistently the rules were applied or resolve the prosecutors’ reported questions. Meta’s public position, as described in contemporaneous coverage, was that illegal drug sales violated its policies and that it cooperated with law enforcement. The FDA and Virginia prosecutors reportedly declined to comment.

How the investigation fits federal drug enforcement
Federal authorities have pursued online drug sellers in separate cases. In one Eastern District of Virginia prosecution, four men were sentenced for a conspiracy involving counterfeit Adderall containing methamphetamine and more than 13,000 reported sales through darknet vendor pages. The Justice Department’s account describes that case. It demonstrates enforcement against online drug trafficking, but it does not show that Meta was treated as a darknet marketplace or that its conduct was equivalent to the sellers’ conduct.
Other federal actions have targeted darknet markets and online drug sales, while a separate Justice Department case involving McKinsey concerned alleged corporate conduct related to opioid marketing. These matters illustrate different enforcement priorities and legal theories; none establishes Meta’s liability. Federal enforcement against darknet trafficking and the McKinsey resolution involved facts distinct from the reported Meta inquiry.
