The U.S. Court of Appeals for the Federal Circuit affirmed a ruling for AGCO and Precision Planting in Deere’s patent dispute over high-speed planting technology on January 24, 2025. A jury had found that the accused products did not infringe the asserted Deere patent claims, and the court upheld the denial of Deere’s requests for post-trial relief. AGCO later reported that the judgment became final after Deere did not timely seek Supreme Court review.
What did the Federal Circuit decide?
In Deere & Company v. AGCO Corp., the Federal Circuit affirmed the District of Delaware’s order denying Deere’s post-trial requests. Deere had asked the district court for judgment as a matter of law on infringement or, alternatively, a new trial. The appellate court concluded, “For the foregoing reasons, we affirm the district court’s order denying Deere its requested post-trial relief.”
The appeal addressed Deere’s challenges to the weight of the evidence, exclusion of a separate patent, and claim-construction rulings made during trial. The court also held that Deere had not preserved its Rule 50(a) motion for judgment as a matter of law on infringement before the close of evidence. It therefore affirmed denial of that motion without reaching its merits.
What products and patents were involved?
Deere sued AGCO Corporation and Precision Planting, LLC over U.S. Patent Nos. 8,813,663 and 9,699,955, which concern high-speed agricultural planting technology and methods for planting seeds. The accused products relevant to the appeal were Precision Planting’s SpeedTube and vSet2, as well as AGCO planters containing those systems.

AGCO describes SpeedTube-vSet2 as a high-speed planting system and identifies Precision Planting as an AGCO brand. Its January 24, 2025 company statement characterized the decision as confirming that AGCO and Precision Planting did not infringe Deere’s intellectual property. The court opinion is the primary source for the ruling itself.
What did the jury decide—and what did it not decide?
The case went to a jury trial in July 2022. The jury found that AGCO and Precision Planting had not infringed the asserted claims. Because it found no infringement, the jury did not return a verdict on patent validity.

The Federal Circuit’s decision did not invalidate Deere’s patents, nor was it a new jury trial or an independent appellate finding on every question of infringement. It affirmed the district court’s denial of Deere’s requested post-trial relief following the jury’s verdict.
Is the judgment final?
Yes. AGCO’s 2025 annual report later stated that Deere did not file a petition for a writ of certiorari within the required time and that the district court judgment became final.

What does the ruling mean for equipment buyers?
The decision resolves the dispute between the parties over the asserted claims and accused products; it is not an endorsement by the court of SpeedTube-vSet2 or a finding about how the system performs in the field. The case does not establish current pricing, availability, compatibility, planting speed, yield, or whether the system suits a particular operation. Those purchasing questions require current product and dealer information, separate from the court’s ruling.
