For foreign investors, buying or leasing land is subject to rules that can depend on citizenship, residence, ownership structure, parcel size and location. Brazil’s official agribusiness project portfolio offers another way to find businesses seeking foreign investment, but a listing is not an endorsement or a guarantee of returns.
Three ways to get Brazilian agricultural exposure
Land ownership, a rural lease and an investment in an operating business are not interchangeable. They involve different legal checks, operating responsibilities and exit options. The sources available here do not establish comparative returns for any of them.

The Ministry of Agriculture and Livestock (MAPA) investment portfolio is an official discovery channel for projects submitted by Brazilian businesses and producers seeking foreign direct investment to start, expand or modernize production, processing or commercialization. Evaluate each opportunity independently: inclusion in the portfolio does not by itself mean the project has been vetted as an investment or that an offering is guaranteed.
How foreign ownership and leasing rules affect a land deal
Brazil’s Law No. 5,709/1971 regulates rural-property acquisition by foreign residents and foreign legal entities authorized to operate in Brazil. It also extends the regime to certain Brazilian companies in which foreign persons or entities based abroad hold majority capital. The law sets a maximum of 50 Módulos de Exploração Indefinida (MEI) for an individual foreign buyer across contiguous or non-contiguous rural areas. That is a legal ceiling, not a typical transaction size or automatic permission to buy.

MEI is a locally defined land-area measure, so a property’s area must be assessed using the applicable municipal value rather than treating a MEI as a fixed number of hectares nationwide. INCRA’s guidance describes a first-acquisition or first-lease exception for a foreign individual involving up to three MEI outside a border area. It also says that natural-person transactions above 20 MEI require an exploitation project and that legal entities must submit one regardless of area. These rules do not remove the need to determine the buyer’s status, the parcel’s location, or any other applicable authorization.
Foreign legal entities covered by the law may acquire rural property for agricultural, livestock, industrial or colonization projects connected to their corporate purposes. INCRA states that it controls foreign acquisition and leasing of rural property. Its current guidance, modified June 3, 2026, should be read alongside the statute and transaction-specific legal advice.

Location can add another approval requirement
A property in a border or national-security area requires prior assent from the National Defense Council (CDN), according to INCRA. Confirm whether a parcel falls in such an area before relying on a transaction timetable or structuring a purchase or lease.
Municipal concentration limits need local verification
The U.S. Department of State’s 2024 Brazil Investment Climate Statement summarizes a limit under which foreign nationals from the same country may own or lease no more than 10% of a municipality’s agricultural land. This is a secondary government summary, and the treatment of ownership, leases and corporate structures can be fact-specific. Verify current application and existing municipal holdings with Brazilian counsel and INCRA before proceeding.

Check the status of the court case before relying on a structure
A March 19, 2026 Supreme Federal Court (STF) news report reported five votes supporting the validity of applying the restrictions to Brazilian companies majority-owned by foreign persons or entities resident or headquartered abroad. The report described the vote status, not a final judgment. Its later status is not established here, so do not treat that report alone as a final ruling or a safe basis for a corporate structure.
What the authorization process involves
The federal service page for authorization to acquire or lease land, updated December 15, 2025, lists foreign individuals resident in Brazil, foreign legal entities authorized to operate in Brazil, Brazilian companies with foreign capital and Portuguese nationals among those who may apply through the service. Eligibility to apply is not the same as approval for a specific property.

- Establish the investor’s legal status. Document citizenship, residence, entity domicile and beneficial ownership, including whether a Brazilian company has foreign majority ownership.
- Identify the property and calculate the relevant area. Confirm its cadastral and registered area, the municipality-specific MEI value, any aggregation with other holdings, and whether it is in a border or national-security area.
- Determine which approvals and supporting materials apply. INCRA says natural-person transactions above 20 MEI require an exploitation project and legal entities must provide one regardless of area. A border or national-security location requires prior CDN assent.
- Submit through the appropriate channel. The government service says the request is sent to the INCRA regional office for the state where the property is located. It describes publication of authorization in Brazil’s Official Gazette.
- Make the transaction conditional on the required outcome. The service’s estimated processing time is administrative guidance, not a guarantee of authorization or a completion date. Have Brazilian counsel confirm the current procedure and relevant conditions before signing or funding.
How to assess an opportunity beyond the legal route
Permission to acquire or lease land does not establish that the asset is commercially attractive. Compare a parcel or project using evidence tied to the specific location and transaction. Brazil should not be treated as one uniform farmland market: cropping patterns, water, infrastructure, commodity exposure and local legal conditions vary by property.
- Property and land use: verify title chain, registration and cadastral records, liens, possession claims, permitted use and environmental obligations.
- Operating fundamentals: assess the operator, lease or management arrangements, crop plan, water access, climate exposure, storage and transport links.
- Financial structure: examine financing, transaction costs, taxes, currency effects, capital needs, contracts and who bears operating or commodity-price risk.
- Liquidity and exit: establish how an investor could sell, transfer or otherwise exit, and what approvals or contractual restrictions might affect that route.
- Local context: use regional agricultural analysis to frame questions, not as a substitute for property-level diligence. For example, USDA Foreign Agricultural Service analysis includes soybean-area estimates for MATOPIBA; it does not establish that the region or any individual parcel is a recommended investment.
Crop production is not a measure of investment returns
IBGE’s 2024 crop estimate reported 152.5 million tonnes of soybeans, up 0.6% from 2023, and 118.6 million tonnes of corn, down 9.5%. IBGE also connected lower corn production with reduced area and productivity and noted that falling corn prices squeezed producer margins. These are national crop-output figures for 2024, not current 2026 estimates, land-price data, or evidence of investor performance. A large harvest does not establish farmland appreciation, lease income, or a project’s profitability.

No current farmland transaction prices, regional cap rates, expected returns, transaction multiples or fund performance are established by the sources cited here. A return or price comparison would require current regional transaction records and deal-specific financial evidence; crop totals alone cannot supply it.
Due-diligence checklist before committing capital
- Record the investor’s citizenship, residence, entity domicile and beneficial ownership.
- Confirm parcel area in municipality-specific MEI and check aggregation and applicable local foreign ownership limits.
- Determine whether the property is in a border or national-security zone and whether prior CDN assent is required.
- Review title history, registration, cadastral records, liens, possession claims, land-use permissions and environmental status.
- Assess the operator, lease or other contracts, crop and commodity exposure, water availability and logistics.
- Model transaction costs, financing, taxes, currency effects, working capital and a realistic exit path using deal-specific evidence.
- Verify that required INCRA authorization and any CDN assent have been obtained, and confirm current rules with Brazilian counsel and INCRA.
