The practical consequences depend on a farm’s workforce, whether its labor need is seasonal or ongoing, and which court orders apply to its state or employer group. H-2A can fill some temporary agricultural jobs; it is not a general replacement for the farm workforce.
Why farm employers face policy whiplash
Two developments have made planning difficult: enforcement priorities have shifted, and rules governing the H-2A temporary agricultural worker program have been affected by court orders, a proposed rescission and later agency clarification for dairy operations. These are different kinds of policy action. An operational pause on some investigations is not a statutory exemption, a proposal to rescind a rule is not a final rule, and a court order may apply only to specified states, cases or parties.
That distinction matters to employers making staffing plans. A farm cannot assume that a public statement or a change reported in one part of the country establishes the rule for every farm elsewhere.
What the farm labor figures do—and do not—show

The figures describe different categories and should not be added together or treated as interchangeable. In its summary of USDA Economic Research Service research, CRS identified fruit, vegetable, melon and tree-nut growers as the dominant H-2A users in the 2019 analysis it cited. That pattern helps explain why a change to the program can matter differently to a seasonal crop operation than to a farm with a different labor model.

What changed, and when
- April 29, 2024: The Department of Labor (DOL) published the Farmworker Protection Final Rule, changing H-2A and Employment Service requirements.
- 2024 through January 2025: Court orders blocked or stayed enforcement of parts of the rule in specified states and cases. DOL’s implementation instructions varied by state as of January 2025; the orders did not establish one uniform outcome for every employer.
- June 2025: The Associated Press reported a pause on some immigration investigations and arrests involving farms and related industries after President Trump publicly acknowledged employer concerns. AP also reported arrests at farms and workers skipping work out of fear. The reported pause was not a blanket farm exemption.
- July 2, 2025: The federal regulatory agenda described DOL’s proposal to rescind most requirements of the 2024 H-2A rule. A proposed rescission does not, by itself, repeal a final rule.
- June 17, 2026: USDA announced DHS and DOL guidance clarifying that dairy operations may seek H-2A workers when they demonstrate a qualifying temporary or seasonal need. Petitions are evaluated case by case under the same standards applied to other H-2A employers.
The latest dated information here establishes that the dairy clarification was announced in June 2026; it does not establish the final disposition of every provision of the 2024 rule or every related court order as of October 2026. Employers need to check the applicable court orders and current agency guidance for their location and circumstances rather than infer a nationwide status from the timeline alone.
Can farms use H-2A workers instead?
Sometimes, if the job and employer meet the program’s requirements. H-2A is for temporary or seasonal agricultural work, not a general permanent labor channel. The process involves a DOL labor certification, an employer petition to the Department of Homeland Security, and workers’ visa applications through the Department of State. Labor certifications, employer petitions and visas are separate steps; the approximately 363,000 figure above counts workers covered by approved labor-certification applications.

For dairy farms, the June 2026 guidance clarifies that the industry is not categorically excluded. It does not make every dairy job eligible: the employer must demonstrate a qualifying temporary or seasonal need, and each petition is assessed case by case. Farms with ongoing labor needs should not assume that H-2A is a substitute for a permanent workforce.
How enforcement uncertainty can affect workers and operations
When workers fear that going to work could expose them to immigration enforcement, employers may face absences or difficulty retaining staff. AP’s June 2025 reporting described workers skipping work as well as arrests at farms, illustrating why a reported pause in some investigations did not remove uncertainty for every worker or operation.

A 2026 report by Democratic staff of the House Committee on Small Business estimated that the agricultural workforce declined by 155,000 workers—about 7%—between March and July 2025, based on its analysis of Bureau of Labor Statistics data. That is the report’s estimate of a change over that period; it does not, by itself, establish that immigration enforcement caused the decline. The available figures also do not quantify resulting crop losses or grocery-price changes.

- For employers: Identify whether the work is temporary or seasonal, and confirm that the specific jobs meet H-2A criteria before treating the program as a staffing option.
- For H-2A rule compliance: Check current DOL guidance and the court orders relevant to the operation’s state and any employer association or party status. The injunctions and stays described by DOL were not universal.
- For enforcement questions: Distinguish a reported administrative pause affecting some investigations from a legal exemption. AP reported both the pause and continuing arrests and worker fear.
- For workforce statistics: Keep H-2A certifications, domestic hires and estimates of workers lacking authorization separate; each measures a different part of the labor picture.
The evidence establishes real uncertainty and differing exposure, not a single national labor shock or a demonstrated nationwide effect on food prices. Court orders, agency rulemaking and enforcement directions can change on different schedules, so the status relevant to a particular employer must be checked against current official guidance.
