The approval is often described as Exinity Group receiving a Kenyan licence, but that wording is shorthand. The regulated legal entity is the Kenyan subsidiary, Exinity Capital East Africa Limited. Exinity later announced plans to launch its Kenyan operations under the Exinity brand in 2021.
What the CMA approved
The CMA’s Q4 2020 statistical bulletin records the approval of a Non-Dealing Online Foreign Exchange Broker licence for Exinity Capital East Africa Limited. The authority’s archived media page used the wording: “CMA approves grant of a Non-Dealing Online Foreign Exchange Broker License to Exinity Capital East Africa Ltd.”
The licence was issued under Kenya’s capital-markets framework, including the Capital Markets Act and the Capital Markets (Online Foreign Exchange Trading) Regulations, 2017.

The company remains listed in the CMA’s online register as an Online Foreign Exchange Broker.
Why the announcement referred to Exinity Group
Exinity Group is the wider corporate group, while Exinity Capital East Africa Limited is the specific Kenyan company named on the CMA licence. This distinction matters when checking who is responsible for a client account or service.
A licence issued to the Kenyan subsidiary should not automatically be treated as approval for every Exinity company, product or brand worldwide. Different group entities may have different licences, legal terms and regulators. Current FXTM legal material for Kenya states that references to “FXTM” or “the Company” mean Exinity Capital East Africa Limited.
What happened after the approval
In its contemporaneous announcement, Exinity said it intended to launch its Kenyan operations under the Exinity brand in 2021. The announcement named Duncan Kinuthia as Country Manager of Exinity Capital East Africa.

That statement should not be used to describe the current market. The CMA’s online register now contains substantially more licensed online forex brokers, including firms with licence numbers above 200.
What the licence means for Kenyan customers
The CMA licence indicates that the named Kenyan company is authorised for the specified online foreign-exchange brokerage activity. It gives customers an important starting point when checking whether they are dealing with a regulated local entity.
It does not guarantee profits, protect a customer from every loss or make leveraged trading suitable for everyone. FXTM’s current Kenyan website warns that leveraged financial instruments can result in the loss of invested capital.
“Non-dealing” also does not mean risk-free or fee-free. The classification describes the broker’s regulatory and execution model. It does not establish that there are no spreads, commissions, other charges or conflicts, nor does it confirm that historical promotional terms are still offered.

How to verify the licence before opening an account
A customer can use the CMA’s register and the broker’s current legal documents rather than relying only on advertising.
- Find the legal entity. Confirm that the documents name Exinity Capital East Africa Limited, not merely Exinity Group or another overseas company.
- Check the licence number. The Kenyan entity’s CMA licence number is 135.
- Compare the registration number. The Kenyan company number is PVT-ZQU6JE7.
- Read the client agreement. Check which entity contracts with you, where complaints should be sent, and which fees and trading conditions apply.
- Confirm the current brand and website. The Kenyan-facing operation is currently associated with FXTM, but customers should still verify the website address and legal footer before depositing funds.
- Review the risk warning. Understand margin requirements, leverage, liquidation rules, spreads, commissions and the possibility of losing the invested capital.
The CMA register displays a Nairobi postal address of P.O. Box 50719-00200, Nairobi. Exinity’s corporate website has displayed a different postal address, while more recent client-agreement material identifies Kiganjo House, Rose Avenue, Kilimani, P.O. Box 50719-00200, Nairobi. For address-sensitive matters, the CMA register and the latest applicable legal agreement are the safer references.

Reports that say Exinity “received the licence in 2021” are imprecise. The CMA’s own Q4 2020 bulletin records the approval during the fourth quarter of 2020. The year 2021 relates to Exinity’s announced plan to launch its Kenyan operations, not the date recorded for the regulatory approval.
