That figure is an estimate—not a confirmed ETHK asset level or a hard trading cap. CME’s reported 8,000-contract accountability level can trigger scrutiny and possible position-management directions, but positions may exceed it.
Where the $362 million estimate comes from
CryptoSlate’s October 6, 2026 calculation assumes each standard CME Ether futures contract is valued at about $135,800, based on ETHU’s cited futures valuation. At that value, 8,000 contracts represent about $1.0864 billion in futures exposure. Dividing that exposure by a 3x daily target gives approximately $362.1 million in fund assets. The calculation assumes all the relevant exposure is in standard CME Ether futures. It is not an announced ETHK asset figure, a confirmed position, or a universal conversion rate. The contract valuation changes with the market, and actual exposure depends on portfolio construction. A fund might not hold precisely 8,000 contracts when its assets reach that amount.

These are scenario calculations, not actual or projected ETHK holdings. They use the October 6 contract valuation, assume a 3x daily target, and exclude changes in futures prices, portfolio instruments, flows, fees, and other implementation details.
What CME’s 8,000-contract level means
CryptoSlate reported that CME’s Ether futures accountability level for single-month and all-month positions was 8,000 contracts, effective March 2, 2026. An accountability level is not an automatic cap. Positions can exceed it; CME Market Regulation may request information under Rule 560 and may direct a participant to stop adding to or reduce a position to help maintain orderly markets. That distinction matters: the headline calculation identifies a point at which a hypothetical fund’s exposure could reach the reported level, not a point at which trading must necessarily stop. The level brings oversight consequences rather than a guaranteed prohibition on further positions.
ETHK’s reported status and the open aggregation question
CryptoSlate reported on October 6, 2026, that the SEC had approved Cboe BZX’s rule change to list Volatility Shares’ proposed fund, ETHK. The key unresolved issue is whether CME would count ETHK and Volatility Shares’ existing ETHU together for accountability purposes. CryptoSlate says CME aggregates positions according to ownership or trading control, including trading control or ownership of 10% or more. Volatility Shares manages both products, but the public reporting does not establish whether CME would aggregate their positions or grant an exemption. Neither outcome is confirmed. What ETHU’s disclosed figures do—and do not—show
ETHU provides a useful reference for the issuer’s disclosures and a snapshot of futures exposure, but it is a 2x product, not proof of ETHK’s eventual holdings or structure. Volatility Shares states that ETHU uses derivatives and collateral and does not directly invest in ETH. Its page reported net assets of $1,307,683,794.23 as of October 5, 2026, and 19,030 October 2026 CME Ether futures contracts with $2,567,622,750 in notional value as of October 7, 2026. Leveraged ETFs seek a multiple of a benchmark’s performance for a single day. Over longer holding periods, the cumulative return can differ significantly from that multiple because daily gains and losses compound. The issuer explicitly warns that ETHU’s return over a period longer than one day may differ significantly from its daily target. That risk applies to how investors should understand a proposed daily leveraged product; it does not change the separate arithmetic used to estimate the contracts corresponding to a given day’s exposure. The separate rebalancing-flow estimate
CryptoSlate estimated that a hypothetical fund with $362.1 million in assets could generate about $109 million in simplified rebalancing flow after a 5% benchmark move.
