Estate Planning Checklist: How to Get Your Affairs in Order

A practical U.S. checklist for organizing your records, understanding estate-planning documents, coordinating beneficiary forms and keeping signed papers accessible.

To get your affairs in order, gather a current record of your family, finances, property, debts, health information and existing legal documents; understand which decisions each document covers; check beneficiary forms; then store and share signed papers so the right people can find them. This U.S.-focused checklist is a starting point, not individualized legal advice: document names and signing rules vary by state, and the right plan depends on your circumstances.

Start with a complete inventory

Before drafting or changing documents, assemble the information that would help a trusted person understand your situation. The National Institute on Aging (NIA) recommends gathering key personal, financial and health records; the American Bar Association (ABA) also identifies existing estate documents and information about the people who may be involved.

People and family records

  • Write down your full legal name, contact information, residence and relevant birth, marriage and divorce records.
  • List trusted relatives and the contact details for your doctors, lawyer and financial advisers.
  • Identify proposed beneficiaries, an executor and, if relevant, possible guardians for minor children. Consider who could serve in each role and whether your choices remain appropriate.

Assets, income and debts

  • List income sources and retirement benefits, including the beneficiaries currently recorded for those benefits.
  • Inventory bank and investment accounts, insurance policies, real estate and other property. Note how each asset is owned and whether it has a named beneficiary or transfer-on-death designation.
  • Record debts, mortgages, tax records, deeds and titles. Note the location and contents of any safe-deposit box.
  • Collect existing wills, trusts and other documents that could affect the plan.

Health information

Keep a current list of prescriptions and health-insurance details, along with any living will, health-care power of attorney or medical orders such as a do-not-resuscitate (DNR) order, if applicable. Keep sensitive identifiers and account details secure rather than placing them in an unsecured checklist.

Know what each core document does

These documents do different jobs. A will addresses what happens to property at death; a financial power of attorney addresses financial decisions during life; and advance-care documents address medical wishes or decisions when you cannot communicate. A living trust may be useful for some people, but it is not a universal requirement.

Document Main job and timing What to keep in mind
Will Sets out how your estate is handled at death. It can address gifts, care of minor children or dependents, and funeral or burial wishes. Without a will, state law determines how the estate is distributed. A will does not replace reviewing beneficiary forms for assets that transfer by designation.
Durable power of attorney for finances Names someone to make financial decisions under the authority granted by the document. Its scope and operation depend on the signed document and state law. Confirm when the authority applies and what powers it grants.
Living trust Can name a trustee and give instructions for holding and distributing property and funds. Whether one fits your needs depends on your situation. Consider which property it is intended to cover and how it fits with the rest of your plan.
Living will States medical-treatment preferences for circumstances in which you cannot make decisions or communicate your wishes. It is an advance-care document, not a will governing property. State forms and requirements can vary.
Durable power of attorney for health care or health-care proxy Names a person to make medical decisions if you cannot communicate. Discuss your values and preferences with the person you name, and provide signed copies and contact information to the proxy and health-care providers.

The NIA explains living wills, advance directives and choosing a health-care proxy. The right combination depends on the decisions and circumstances you need to address.

Check beneficiary forms against your plan

Review the current primary and contingent beneficiaries on retirement accounts, life insurance, annuities, payable-on-death or transfer-on-death accounts, and any other asset that passes to named beneficiaries. Compare those choices with your broader estate plan and keep copies of the designation records.

A beneficiary designation can control distribution under an account or contract even if a will says something different, subject to applicable law and the specific arrangement. Updating a will alone therefore does not update these forms. The ABA discusses this interaction in its guidance on beneficiary designations in estate plans.

Make signed documents findable and share them

Keep originals and copies in an organized, secure place, and tell a trusted person or lawyer where they are. A fireproof and waterproof safe is one option; a file, drawer or notebook may also work. The safe is a convenience, not a legal requirement. Keep copies accessible outside a bank safe-deposit box so a person who needs them can get them.

For health-care documents, give signed copies to your proxy and health-care providers, and make sure your proxy knows how to reach those providers. When you replace an advance directive, retain the prior version with a note identifying when it was replaced, as the NIA advises.

Review the plan and update the people involved

The NIA advises reviewing plans at least once each year and after major life events, such as divorce, a move or a significant change in health. Also revisit the plan after retirement or a death that affects a named decision-maker or beneficiary. When a document changes, tell the people involved and ensure they have the current copy.

Check state rules and get help when needed

There is no single nationwide signing recipe for wills, powers of attorney and advance directives. Names and requirements vary by state. For advance directives, state forms may require witnesses or notarization; follow the instructions for the relevant state form. Verify execution rules before signing rather than relying on a generic checklist.

Consider advice from a local estate-planning lawyer if you have a blended family, minor children, a business, property in more than one jurisdiction, special-needs planning needs, significant tax questions, or uncertainty about capacity or document execution. The NIA points readers to state forms, local bar associations, legal aid and lawyer directories as possible starting points.
