No. Erika Jayne did not go to trial in the civil lawsuit over payments allegedly made for her benefit. USA TODAY reported on May 22, 2026, that she settled the Girardi Keese bankruptcy trustee’s lawsuit shortly before trial. The report did not disclose the settlement amount.

What the lawsuit alleged

The case arose from the involuntary bankruptcy of Girardi Keese, the law firm run by Jayne’s then-husband, Tom Girardi. In a 2021 amended complaint, the bankruptcy trustee sought at least $25,592,261.26 in receivables, alleging that payments from the firm had gone toward Jayne’s expenses. The complaint included more than $14 million in alleged American Express charges and roughly $11 million in alleged vendor payments. The trustee described spending allegedly connected to promotion, glam, travel, clothing, shoes and jewelry. These amounts and descriptions are claims made by the trustee, not established findings.

Did Erika Jayne go to trial?

The amount was not disclosed in USA TODAY’s May 22, 2026 report. That report also does not establish whether Jayne admitted liability or whether a final dismissal order was entered. Without a settlement document or current docket confirming those details, they should not be inferred from the fact that the case settled.

How this differs from Tom Girardi’s criminal case

The trustee’s action against Jayne was a civil recovery lawsuit tied to the Girardi Keese bankruptcy. It is separate from the criminal case involving Tom Girardi.
