The Ministry of Labour and Employment says the six-month window began when the EPF Scheme, 2026 was notified on 29 June 2026. The opportunity is not a general waiver for every PF default: it targets establishments running Income-tax-recognised PF trusts without a formal exemption order under the applicable provident-fund law.
What the EPFO PF trust amnesty covers
The scheme addresses establishments whose PF trusts were recognised under the Income-tax Act, 1961 but did not receive a formal exemption notification under section 17 of the Employees’ Provident Funds and Miscellaneous Provisions Act, 1952, or under section 143 of the Code on Social Security, 2020. EPFO’s 13 October 2026 update urges eligible employers across India to submit applications quickly as the deadline approaches.

The Ministry describes AMNESTY, 2026 as a regularisation mechanism for exemption status. It does not establish a blanket amnesty for unpaid contributions, damages, interest or other PF violations unrelated to the qualifying trust-status problem.

The Ministry’s overview divides applicants into two broad categories. The exact category, effective date and cut-off mechanics should be confirmed against the detailed scheme and the applicant’s Regional Office instructions.

| Category | Intended continuing route | Purpose |
|---|---|---|
| Category I | Comply prospectively as an unexempt establishment, or regularise while already complying on that basis | Retrospective regularisation of the earlier trust-exemption position |
| Category II | Continue as an exempt establishment under the Code on Social Security, 2020 | Retrospective regularisation while retaining exempt-establishment treatment |
In practical terms, an employer should first establish that its trust has the required Income-tax recognition and then verify that no formal EPF exemption order exists from the competent Central or State government authority. Employers with different facts should not assume that the scheme applies without written guidance from the jurisdictional EPFO office.
Deadline and legal basis
The EPF Scheme, 2026 was notified on 29 June 2026. The Ministry says the amnesty lasts six months and expires on 28 December 2026. Its 13 October release states: “The Amnesty window remains open for a period of six (6) months from the date of notification, expiring on 28.12.2026.” No extension has been announced in the material available for this update, so employers should work to the published date rather than assume additional time.
What relief can the scheme provide?
The Ministry lists retrospective regularisation of exemption status and waivers of the Code’s minimum employee-headcount and corpus requirements. It also says the three-year prior-compliance requirement is treated as satisfied. After regularisation, an establishment can choose whether to operate as exempt or unexempt, subject to the scheme’s conditions and the decision recorded by the authorities.
Relief from financial proceedings is conditional. The Ministry says pending assessments of dues, damages and interest are to be withdrawn and abated where member accounts received contributions and interest at least at the applicable statutory rates. Past finalised orders are described as void ab initio. This wording does not mean every liability disappears automatically: the contribution and interest record must support the application, and the authorities must apply the scheme to the establishment’s facts.
Fine-grained conditions reported in unofficial reproductions of an alleged circular should not be relied on without confirmation. Questions involving omitted employees, delayed transfers, investment-pattern issues or other exceptions should be put to the relevant EPFO Regional Office or checked against the official circular and scheme text.
How to apply
- Confirm eligibility. Gather the Income-tax recognition for the PF trust and evidence concerning any EPF exemption notification under section 17 of the 1952 Act or section 143 of the 2020 Code.
- Choose the proposed route. Decide whether the establishment seeks Category I treatment (unexempt compliance going forward) or Category II treatment (continued exempt status), while checking the category definitions and cut-off rules in the official materials.
- Prepare the application. The national guidance calls for a formal application addressed to the Central Government and submitted through the concerned EPFO Regional Office. An expression of interest may also be sent to
[email protected]. - Obtain the audit records. Financial accounts must be audited by a Chartered Accountant. Keep trust books, member-level contribution and interest records, and supporting statutory filings ready for review.
- Respond to any directed audit. The Ministry says a special or compliance audit required by EPF authorities must be completed within three months of the application.
- Confirm local filing logistics. Ask the jurisdictional Regional Office for its current form, submission channel, cut-off date for documents and any appointment or verification requirements before dispatching the application.
Why Regional Office confirmation matters
The national Ministry summary sets out the legal route but leaves operational processing to the concerned Regional Office. Goa’s EPFO release, for example, specified a prescribed Annexure-I, an audit of trust accounts including individual member ledgers as of the cut-off date, updated employee KYC particulars and physical submission at the Goa Regional Office. It also identified local assistance arrangements. Those are Goa instructions, not a uniform nationwide filing rule. An employer in another state should not copy the Goa process without confirmation.

The Ministry’s September update referred applicants to the detailed circular issued on 11 July 2026 and to EPFO’s website. Because local implementation details can differ, retain proof of submission, correspondence and every version of the documents supplied.
