Short answer: an employee’s canteen contribution, an employer-provided canteen benefit, an operator’s catering bill and a separately charged service fee are not automatically the same GST transaction. Identify who supplies what to whom, then check the contract, invoice and payment flow. CBIC guidance says contractual employee perquisites are not subject to GST, while its general FAQ treats a service charge as consideration for a supply; neither statement classifies every workplace-canteen arrangement by its label alone.
Why the distinction matters
A workplace canteen may involve two separate transactions: an outside operator supplying food or catering services to the employer, and the employer arranging a benefit or recovering a contribution from employees. A separately identified service charge may raise a third question. Analyze each transaction independently rather than assuming that one GST answer applies to the whole arrangement.
The starting point is Schedule III to the CGST Act, 2017, which excludes from supply Services by an employee to the employer in the course of or in relation to his employment.

How employee canteen recoveries are treated
CBIC Circular No. 172/04/2022-GST, dated 6 July 2022, addresses contractual perquisites. It states: Any perquisites provided by the employer to its employees in terms of contractual agreement entered into between the employer and the employee are in lieu of the services provided by employee to the employer in relation to his employment.
The circular says such perquisites are not subject to GST. CBIC Circular No. 172/04/2022-GST.

This guidance means that a payroll deduction or employee contribution does not, on its own, prove that the employer has made a taxable outward supply. The relevant question is what the arrangement actually provides for: whether the canteen benefit is a contractual employment perquisite, what the employee contribution represents, and how the parties have structured and documented the arrangement. Do not assume that every amount recovered from employees is outside GST simply because it is called a “recovery.”
How an outside operator’s canteen supply is treated
The operator’s supply must be considered separately from the employer’s arrangement with employees. Establish who contracted with the operator, who is named as recipient on the invoice, who pays the operator, and whether employees pay the operator directly or contribute through the employer. The supply’s classification under the applicable rate notification also matters.

CBIC’s rate table lists restaurant service other than at specified premises at a total rate of 5%—2.5% CGST and 2.5% SGST—with a condition that input tax credit on goods and services used in supplying the service has not been taken. CBIC GST goods and services rates. This entry is not a blanket rate for every workplace canteen contract. Confirm the service classification and applicable notification for the specific arrangement before applying a rate.
When a canteen service charge is relevant
CBIC’s general FAQ says a service charge, like any other supply, is leviable to GST and is not a statutory government levy. CBIC GST FAQ. That general guidance does not establish that every invoice or payroll line called “canteen service charge” has the same treatment.

First determine who charged the amount and what it pays for. An operator’s fee to an employer, an employer’s recovery from employees, and a distinct charge for a separately supplied service can involve different suppliers, recipients and contractual relationships. The label alone is not enough to establish whether GST applies or which rate governs.
Can the employer claim input tax credit?
CBIC’s Sectoral FAQ states that tax paid in respect of canteen service providers is not available as input tax credit. CBIC Sectoral FAQ. Treat that as FAQ guidance, not as a substitute for checking the current statutory restriction and any applicable exception against the employer’s facts. The credit question is separate from whether GST is due on an employee contribution or on the operator’s supply.

What to check before deciding
- Identify the supplier and recipient for each leg. Separate the operator’s service from any arrangement between employer and employees.
- Read the employment terms and canteen contract. Determine whether the employee benefit is a contractual perquisite and what the operator has agreed to provide.
- Match invoices to the actual arrangement. Check who issues each invoice, who is named as recipient, and whether the fee is for the operator’s supply or a separate service.
- Trace payment and recovery flows. Record whether the employer pays the operator, employees pay directly, or the employer recovers a contribution through payroll or another method.
- Confirm the service classification and rate. Use the current rate notification for the actual supply rather than applying a rate solely because the arrangement involves a canteen.
- Review input tax credit separately. Check the current statutory rule and any applicable exception alongside CBIC’s FAQ guidance.
CBIC’s circular is dated 6 July 2022, and FAQ pages and rate tables may not reflect every later amendment. For a filing or a disputed arrangement, verify the current Act, notifications and later applicable guidance against the actual documents and facts.
