ED’s Rs 10.11 Crore Attachment of S. Shankar’s Properties Stayed by Madras High Court

The ED’s provisional attachment of three S. Shankar properties over allegations involving Enthiran was stayed by the Madras High Court in March 2025. A later listing was set for 15 June 2026, but its outcome is not established here.

The Madras High Court stayed the Enforcement Directorate’s (ED) provisional attachment proceedings against filmmaker S. Shankar on 11 March 2025. The ED had announced in February 2025 that it provisionally attached three immovable properties registered in his name, valued at approximately Rs 10.11 crore, over allegations connected to the film Enthiran. A March 2026 court order listed Shankar’s challenge for 15 June 2026; the outcome of that listing has not been established here.

What happened to Shankar’s properties?

The ED’s Chennai Zonal Office said it issued a provisional attachment order on 17 February 2025 under the Prevention of Money Laundering Act, 2002, covering three immovable properties registered in Shankar’s name. The agency valued them at approximately Rs 10.11 crore and announced the action on 20 February 2025. These are the ED’s figures, not an independently audited valuation. The ED’s 2025 announcement described the measure as provisional.

On 11 March 2025, the Madras High Court stayed the attachment proceedings while Shankar challenged the order. The Times of India reported that the bench said, “The provisional attachment order should not have been issued, particularly when the stay against the criminal complaint was in operation for the past three years,” and directed the ED to file a counter. The report of the High Court hearing attributes the statement to the division bench.

A March 2026 order in the challenge records that the ED sought time after producing a Supreme Court order dated 3 February 2026, and lists the matter for 15 June 2026. The later outcome of that listing has not been established here, so the stay should not be treated as proof of a final resolution of the challenge.

Why did the ED attach the properties?

The ED says its investigation arose from a complaint filed by writer Aarur Tamilnadan on 19 May 2011 before the 13th Metropolitan Magistrate Court, Egmore, Chennai (CC No. 2067/2011). Tamilnadan alleged that the storyline of Enthiran (also known as Robot), directed by Shankar, was copied from his story Jiguba. The ED framed the allegation as a suspected violation of the Copyright Act, 1957 and the Indian Penal Code, 1860. These are allegations described by the agency, not a final judicial finding that Shankar plagiarised the story or committed a crime.

The ED said Shankar received Rs 11.5 crore for contributions to Enthiran that included story development, screenplay, dialogues and direction. It also said an independent Film and Television Institute of India (FTII) report found similarities between Jiguba and the film in narrative structure, character development and themes. The underlying FTII report has not been independently examined here; the claims about the remuneration and report are the ED’s account. The agency also put the film’s worldwide gross at Rs 290 crore, a figure not independently verified here.

How is the civil suit different from the ED case?

The earlier civil suit and the later ED action are separate procedural matters. A Times of India report published on 12 March 2025 said the Madras High Court dismissed Tamilnadan’s civil suit in June 2023. According to that report, the court observed that copyright could not be claimed over an idea or concept and that there was no evidence that Enthiran literally imitated Jiguba. That civil-suit decision should not be conflated with the criminal complaint cited by the ED or with Shankar’s later challenge to the provisional property attachment. The Times of India’s March 2025 report describes the earlier civil-suit outcome.
