As of October 8, 2026, Congress has not made year-round nationwide E15 sales permanent law. The standalone bill, H.R. 1346, passed the House but was referred to a Senate committee; a separate Farm Bill provision that includes year-round E15 advanced out of the Senate Agriculture Committee in September, but still awaits further negotiations. Temporary EPA waivers have allowed E15 sales nationwide during specified periods, but they are not a permanent statutory solution—and none of these actions requires every gas station to sell E15.
What the E15 bill would change
E15 is gasoline blended with up to 15 percent ethanol; E10 contains 10 percent. H.R. 1346, the Nationwide Consumer and Fuel Retailer Choice Act of 2025, would extend to gasoline containing up to 15 percent ethanol the federal Reid Vapor Pressure treatment already available to E10. In practical terms, that would remove the summertime federal waiver requirement for year-round E15 sales.
The proposal concerns whether E15 may be sold under federal fuel-volatility rules. It does not order retailers to carry the blend, guarantee it will be available locally, or establish which vehicles may use it. Drivers should follow their vehicle manufacturer’s fuel guidance rather than infer compatibility from a change in the sales rule.
Two legislative routes, at different stages
Year-round E15 is being pursued through two distinct vehicles. Their progress should not be conflated: a committee referral is not Senate passage, and a committee vote does not enact a bill.

The standalone bill and the Farm Bill provision are separate legislative routes, even though both address year-round E15. The Senate Agriculture Committee’s July 31 release described revised Farm Bill 2.0 text that included the provision. Its later September advancement does not establish that the full Senate or Congress approved it.
Why temporary EPA waivers are not the same as a permanent law
EPA has used emergency fuel waivers to allow nationwide E15 sales during specified periods. On March 25, 2026, the agency announced a temporary waiver for nationwide E15 sales beginning May 1, citing fuel-supply conditions. EPA also described removing federal impediments for E10 in the affected waiver context.

EPA’s rolling Fuel Waivers page records later actions, including a July 17 extension with an effective window of July 20 through August 8, 2026, for a national gasoline pool and boutique-fuel requirements. Waiver dates and terms are time-limited and can change; an earlier announcement is not proof that a waiver remains in force today. The cited waiver actions do not make year-round sales permanently authorized by statute.
The distinction is practical as well as legal: a temporary waiver permits sales within its specified terms and period; a permanent statutory change would remove the recurring need for that summertime waiver. EPA also issued a summer 2025 waiver after requests from governors of Illinois, Iowa, Minnesota, Missouri, Nebraska, South Dakota, and Wisconsin, illustrating how seasonal exceptions can recur while Congress considers legislation.

What the bill’s budget estimate says—and does not say
The Congressional Budget Office estimated that enacting H.R. 1346 would increase federal revenues by a net $0.4 billion over 2026–2036. CBO expects only a modest increase in E15 sales because the summertime restriction is not the only factor limiting consumer demand; its estimate reflects lower demand for biomass-based diesel alongside increased use of ethanol-blended fuel.
That is a federal budget estimate, not an estimate of household savings or a prediction that E15 will be cheaper at a particular pump. The sources cited here do not establish a reliable national per-gallon or household savings figure attributable to permanent nationwide E15 sales. A lower price claim should therefore be treated as a claim by its publisher, with its own methodology, not as a result established by CBO’s revenue estimate.

Ethanol industry groups and farm-state lawmakers support year-round sales, arguing that a permanent rule would provide greater certainty for farmers and fuel producers and support domestic fuel supply. In EPA’s March 25, 2026 announcement, Renewable Fuels Association president and CEO Geoff Cooper called that day’s waiver “great news for farmers” and said year-round E15 was “essential for the farm economy,” urging Congress to find a lasting solution. That is an industry advocate’s view, not an EPA finding.
Critics raise questions about air pollution, fuel-market effects, and policy support for corn ethanol. The sources cited here do not establish a comprehensive independent environmental comparison or settle those broader policy debates. The legislative question is narrower: whether federal law should extend E10’s volatility-rule treatment to E15 year-round.

What this means for drivers and household budgets
- Permission is not availability. A federal rule allowing year-round sales would not establish that a nearby station stocks E15. The cited sources do not provide a comprehensive retail-availability map.
- Temporary permission can expire. An emergency waiver applies within its stated terms and dates; it is not a guarantee of uninterrupted year-round availability.
- Do not translate the CBO figure into pump savings. The $0.4 billion estimate concerns net federal revenue over 2026–2036, not money returned to drivers.
- Check the vehicle’s fuel guidance. A change in federal sales rules does not itself certify that E15 is appropriate for every vehicle.
For an individual driver, the most useful evidence is current local station availability, the vehicle manufacturer’s fuel recommendation, and the price difference at the pump. The legislative actions described above do not establish any of those for a particular household.
