Dream11’s earlier “game of skill” argument does not make paid fantasy contests broadly legal in India today. The central Promotion and Regulation of Online Gaming (PROG) Act prohibits online money games even when skill is involved, according to the Government’s description of the law. A Delhi High Court order records that Dream11’s operator had stopped pay-to-play contests after 22 August 2025 and was offering free-to-play games by February 2026. The Supreme Court’s May 2026 ruling also confirmed that states can regulate betting on games of skill. The result is a sharp break from the paid-contest era—not evidence that premium fantasy sports are still booming.
Why “game of skill” no longer settles whether a paid contest is legal
“Game of skill” refers to an earlier legal argument about a particular fantasy-sports format. Users selected a team of real athletes, contests ran for the duration of a match, and team changes were restricted after play began. Dream11 and the Federation of Indian Fantasy Sports (FIFS) cited earlier court reasoning that treated this format as predominantly skill-based. That history explains the old classification; it does not create a current exception to later legislation.
The legal questions now need to be separated: what the central law says about online money games, what state laws can do about betting, and whether the central Act itself survives its constitutional challenge. Those are related issues, but they are not the same case or legal test.
What the PROG Act and Rules changed
MeitY announced on 22 April 2026 that Parliament enacted the PROG Act in August 2025 and that its implementing Rules would take effect on 1 May 2026. The Government’s explanation says the Act prohibits online money games whether based on skill, chance, or a mixture of both. It also describes prohibitions on advertising, promoting, or facilitating those games, and on banks and payment systems processing related transactions.

That means a prior finding that a specific fantasy format involved skill does not, by itself, exempt a paid contest from the central law. The Rules establish the Online Gaming Authority of India, procedures to determine whether a game is an online money game or a permitted social game or e-sport, registration for e-sports and notified social-game categories, and user-safety, grievance, and enforcement processes.
The central Act’s constitutionality is a separate question. A Supreme Court Observer case-tracker page described the challenge as pending and listed 5 August 2026 as the next hearing, but that page was last updated on 2 July 2026. Because the scheduled hearing date has passed, its status cannot be confirmed from that tracker alone as of 8 October 2026. Do not treat the tracker’s earlier listing as proof of the case’s present status.
What the Supreme Court said about state powers
On 27 May 2026, in The State of Tamil Nadu v Junglee Games India Private Limited, the Supreme Court allowed the Tamil Nadu and Karnataka appeals, set aside the High Court judgments in those state-law appeals, and held the challenged provisions before it constitutionally valid. The Court said state authority over betting and gambling can extend to betting on games of skill: a skill element in the underlying game does not, by itself, protect wagering from state regulation.

That judgment concerns the state laws and appeals before the Court. It did not decide the separate constitutional challenge to the 2025 central Act. Nor should it be read as a ruling that every fantasy-sports product has the same structure or legal status.
What the court record says about Dream11’s service
A Delhi High Court order dated 3 February 2026 records the plaintiffs’ representation that their platform offered both free-to-play and pay-to-play fantasy sports until 21 August 2025. They told the Court that after the Act came into force on 22 August 2025, the operator stopped pay-to-play contests and continued free-to-play online social games for recreation and entertainment.

The order allowed an amendment to the plaint; it was not a broad judgment on the lawfulness of every feature or every state-level version of Dream11. It is evidence of what the plaintiffs represented to the Court at that time, not independent confirmation of the operator’s complete current offering or availability in every state.

The available user figures describe a historical market, not current participation. KPMG in India’s 2019 report surveyed 336 people who had played fantasy sports during the preceding 12 months. It found that 74% said they played one to three times per week, 54% said they played for free, 46% had entered paid contests at least once in the prior 12 months, 85% played on mobile apps, and 60% recalled Dream11. These are results from a small, historical user survey—not a representative estimate of India’s current population or current fantasy-sports activity.

The reviewed page does not identify the underlying study, time period, or calculation method, so those figures should be presented as Government estimates rather than independently established measures of fantasy-sports use or losses.

No comparable current estimate of fantasy-sports market size or growth is established by these figures. In particular, 2019 survey results cannot support a claim that paid fantasy sports are currently booming after the legal and service changes of 2025–26.
How to assess a fantasy-sports product now
For a user deciding whether a product is a free social game or a paid money game, the marketing label “fantasy sports” or an older “skill game” classification is not enough. The relevant distinctions include whether users pay an entry fee, whether prizes or monetary stakes are involved, how the game is structured, and which central and state rules apply.
- Check the current product terms: distinguish free play from any entry payment, cash prize, or other monetary stake.
- Check the applicable legal framework: the central Act’s treatment of online money games and the relevant state’s laws are separate considerations.
- Check dated operator information: availability and contest formats can change. The February 2026 court record describes what the plaintiffs said about Dream11 then; it does not establish every current feature.
- Do not rely on old skill-game explanations as legal clearance: the central law and the Supreme Court’s 2026 state-law ruling post-date the earlier format-specific reasoning.
