In the United States, federal, state and local governments regulate fishing. Federal marine rules are built around laws, fishery-management plans and implementing regulations—not one rulebook that applies to every fisher. The requirements depend on where you fish, the species and whether the activity is commercial, recreational or subsistence. This article covers the U.S. framework; it is not a guide to fishing rules in other countries.
Who regulates fishing in the United States?
For U.S. marine fisheries in federal waters, the Magnuson-Stevens Fishery Conservation and Management Act (MSA) is the primary management law. NOAA Fisheries manages commercial and recreational fisheries in U.S. waters, working with regional fishery management councils, states and other federal agencies. State and local rules also apply, particularly depending on the waters and activity involved. NOAA’s laws and policies overview describes the federal framework.
Fishing regulation is not limited to the MSA. NOAA identifies the Marine Mammal Protection Act, Endangered Species Act and National Environmental Policy Act among the major laws that drive its work. Other laws and treaties may also apply; NOAA says its marine-resource work involves implementing and enforcing more than 40 laws and policies.
How are federal fishing regulations made?
Congress passes laws that authorize agencies to establish detailed regulations. For many federal fisheries, the process involves a regional fishery management council and NOAA Fisheries. The MSA established eight regional councils, which work with NOAA on management plans and actions, including recommendations for annual quotas and other measures.

- A regional council commonly develops or recommends a management action for a fishery.
- NOAA reviews the action for consistency with the MSA and other applicable laws.
- NOAA proposes a rule and publishes it in the Federal Register for public comment.
- After considering comments, NOAA issues a final rule. Federal regulations are then codified in the Code of Federal Regulations.
This is the common route, not a universal one. NOAA’s Atlantic Highly Migratory Species division manages Atlantic sharks, tuna, swordfish and billfish outside the usual council process. For an overview of the process, see NOAA’s fishing regulations process.
What can fishing regulations require?
Federal fishery plans and their implementing rules must comply with the MSA’s ten National Standards. National Standard 1 states: “Conservation and management measures shall prevent overfishing while achieving, on a continuing basis, the optimum yield from each fishery for the United States fishing industry.” NOAA’s National Standard Guidelines explain how the standards inform management.

Depending on the fishery and management plan, rules may include:
- Permits or limits on access to a fishery.
- Catch limits, quotas or accountability measures.
- Size limits, trip limits or restrictions on gear and vessel use.
- Closures for particular areas or seasons.
- Requirements related to protected species.
Annual catch limits and accountability measures are tools used in federal fisheries to prevent overfishing. They do not mean every fishery has the same limit or uses every type of restriction. How to find the rules that apply to a fishing trip
Do not rely on a generic nationwide limit or season: identify the exact place, species and activity first. NOAA’s regional fishing regulations directory is the official starting point for current federal rules. State or local requirements may also apply, so check the relevant authorities for the waters where you plan to fish.
- Jurisdiction: Determine whether the waters are federal, state or locally managed.
- Location: Identify the applicable NOAA management region and any state or local area.
- Species or fishery: Look up the relevant stock or species; seasons, limits and protections differ.
- Activity: Check whether the rules concern commercial, recreational or subsistence fishing.
- Rule type: Verify permit, catch, season, area, size, trip, gear and protected-species requirements that apply.
How government enforcement fits in
Rules are enforced through cooperation among NOAA Fisheries, other federal agencies and states. The precise enforcement arrangements and requirements depend on the law and fishery; the existence of a federal rule does not remove the need to check state or local rules. What regulation means for the fishing industry
Regulation shapes who may fish, how much can be caught, when and where fishing can take place, and what methods are allowed. Those controls vary rather than imposing one uniform set of conditions on the entire industry. For scale, NOAA Fisheries reported that U.S. commercial fishermen landed 8.4 billion pounds of edible and industrial fishery products, valued at $5.1 billion, in 2023. That is a U.S. commercial landings figure for that year, not a global estimate. NOAA’s U.S. fisheries economics page provides industry information.
