The restriction applies to the licensed software; it is not the same as a physical ban on installing every GeForce GPU in a data center. The claim that NVIDIA changed the terms to protect “fat Tesla margins” goes further than the available evidence: a court filing reproduces allegations about a business rationale, but does not establish NVIDIA’s motive or Tesla-specific margins.
What does NVIDIA’s current GeForce license say?
NVIDIA’s general software license, section 2.8, states: “You agree that GeForce or Titan SOFTWARE: (i) is licensed for use only on GeForce or Titan hardware products you own, and (ii) is not licensed for datacenter deployment.” NVIDIA’s GeForce-specific license page also says the agreement governs the NVIDIA driver and related software.

In practical terms, the current language is a restriction on how the covered software is licensed. It does not say that NVIDIA has physically prohibited a GeForce card from being installed in any data-center machine. Nor does buying or owning the card override the software terms.

The cited clause governs GeForce or Titan software, not the physical GPU as an object. A server containing a GeForce card and a deployment using NVIDIA’s covered driver or related software are distinct questions. The license expressly restricts the latter; the cited wording does not establish a universal physical-installation ban.

- AI Performance: 767 AI TOPS
- OC mode: 2632 MHz (OC mode)/ 2602 MHz (Default mode)
- Powered by the NVIDIA Blackwell architecture and DLSS 4
- Axial-tech fan design features a smaller fan hub that facilitates longer blades and a barrier ring that increases downward air pressure
- A 2.5-slot design maximizes compatibility and cooling efficiency for superior performance in small chassis
That distinction matters if you are evaluating a deployment. Do not treat a card’s ability to fit or operate in a server as proof that the software use is licensed. For an actual deployment, review the applicable license terms and obtain appropriate legal guidance rather than relying on hardware compatibility alone.
What changed in the historical EULA account?
A Supreme Court-hosted joint appendix reproduces a historical clause and allegations from securities litigation. The passage says NVIDIA revised the GeForce EULA on January 1, 2018, to restrict corporate data-center use while allowing an exception for blockchain processing. The historical wording quoted there was: “No Datacenter Deployment. The software is not licensed for datacenter deployment, except that blockchain processing in a datacenter is permitted.”

This is a description in litigation material, not the current clause: the present wording quoted above does not include that blockchain exception. The appendix reproduces allegations; it is not an adjudicated finding that establishes why NVIDIA made the change.

Did NVIDIA do it to protect “fat Tesla margins”?
The court filing reproduces allegations that the change would steer corporate data centers away from lower-priced GeForce products and toward professional Quadro or Tesla products. That account attributes a commercial rationale to former employees, but it does not prove that this was NVIDIA’s motive. The available passage also does not establish a Tesla-specific margin figure, so “fat Tesla margins” is not a substantiated conclusion.

- Protective PCB coating helps protect against short circuits caused by moisture, dust, or debris
- 3.6-slot design with massive fin array optimized for airflow from three Axial-tech fans
- Phase-change GPU thermal pad helps ensure optimal thermal performance and longevity, outlasting traditional thermal paste for graphics cards under heavy loads
The filing’s historical characterization says GeForce products cost “several hundred dollars each” and professional Quadro and Tesla products “several thousand dollars each.” Those are dated characterizations in a litigation filing, not current prices, a present-day product comparison, or evidence of margins.

NVIDIA’s SEC filings discuss the company’s data-center business and related commercial context, but they do not link the GeForce software-license clause to Tesla margins or establish the alleged reason for the EULA change. Business growth or investment in data-center products is not, by itself, evidence of the motive behind a particular license term.

NVIDIA’s fiscal 2025 SEC filing and 2026 SEC filing provide company-reported business context, not proof of the EULA’s alleged motive.
