Do Kwon was extradited from Montenegro to the United States on December 31, 2024. He later pleaded guilty to two federal fraud-related counts and was sentenced to 15 years in prison on December 11, 2025. The case stems from the May 2022 collapse of Terraform Labs’ TerraUSD (UST) stablecoin and its sister token, LUNA.

What happened to Do Kwon’s U.S. case?

The U.S. Department of Justice says Kwon, Terraform Labs’ co-founder, was transferred from Montenegro to the United States on December 31, 2024, and appeared in federal court in Manhattan. The headline’s future tense is therefore outdated: the extradition has already taken place. The U.S. and South Korea both sought his extradition, but the DOJ’s public announcement does not establish the full procedural history of Montenegro’s competing decisions.

At the time of the transfer, prosecutors announced charges including commodities fraud, securities fraud, wire fraud, related conspiracy, and money-laundering conspiracy. Those were allegations, not findings of guilt. In August 2025, Kwon pleaded guilty to one count of conspiracy to commit commodities, securities, and wire fraud and one count of wire fraud. The two counts carried a combined maximum sentence of 25 years; on December 11, 2025, the court sentenced him to 15 years in prison, according to the Department of Justice.

What were TerraUSD and LUNA, and why did they crash?

TerraUSD, or UST, was marketed as a stablecoin intended to hold a value of one U.S. dollar through an algorithmic protocol. LUNA was its sister cryptocurrency. In May 2022, UST lost its peg and both tokens collapsed. The DOJ alleges that Kwon misrepresented how effectively the system could maintain UST’s dollar value.

The DOJ’s figures describe two different things. Its 2024 extradition announcement said the alleged fraud and crash erased more than $40 billion in investor assets; that is an agency-reported loss figure, not a final government-calculated restitution total. In a 2025 sentencing announcement, the DOJ said UST and LUNA together had a peak market value exceeding $50 billion in spring 2022. Peak market value and reported investor losses are not interchangeable measures.

How is the SEC case different from the criminal case?

The criminal prosecution and the Securities and Exchange Commission’s civil enforcement case are separate proceedings. In the civil case, a jury found Terraform Labs and Kwon liable for securities fraud on April 5, 2024, according to the SEC. The SEC subsequently announced an agreement under which the defendants would pay more than $4.5 billion. That civil-case finding and payment agreement are not Kwon’s criminal sentence; the sentence followed his later guilty plea in federal court.

What do the dollar figures mean?

  • More than $40 billion: the DOJ’s 2024 description of investor assets erased by the alleged fraud and May 2022 crash.
  • More than $50 billion: the DOJ’s 2025 statement about the combined peak market value of UST and LUNA in spring 2022.
  • More than $4.5 billion: the payment agreement announced by the SEC in the separate civil case.

Then-U.S. Attorney Damian Williams described the loss figure in the extradition announcement as an allegation: “As we allege, this fraud and the crash of Terraform’s cryptocurrencies in May 2022 erased over $40 billion in investor assets, causing devastating losses to countless investors in the United States and around the world.”
