No. Texas did not adopt H.J.R. 175 as a constitutional amendment, and the proposal would not have made digital currency legal tender. It proposed protecting the use of mutually agreed exchange media in private trades and contracts—but it never appeared on the state’s November 4, 2025 constitutional-amendment ballot.
What did Texas H.J.R. 175 propose?
H.J.R. 175 was a joint resolution proposing to add Section 37 to Article I of the Texas Constitution. Its proposed language said: “The right of the people to own, hold, and use a mutually agreed upon medium of exchange, including cash, coin, bullion, digital currency, or privately issued scrip, when trading and contracting for goods and services shall not be infringed.” The resolution’s text also said government could not prohibit or encumber ownership or holding of money or other currency, while preserving Texas’s authority to choose what it accepts for payments made to the state.
The Senate Research Center described the resolution’s purpose as reaffirming a right to use a mutually agreed medium of exchange in trading and contracting. That was proposed constitutional language, not a constitutional right already in force. The Senate Research Center analysis, dated May 13, 2025, characterized H.J.R. 175 as a proposal and listed November 4, 2025, as its proposed election date.
Did H.J.R. 175 reach the 2025 ballot?
No. The Texas Secretary of State’s June 25, 2025 announcement listed 17 proposed amendments for the November 4 election, and H.J.R. 175 was not among them. The Legislative Reference Library’s record of measures adopted at that election likewise does not list it. The Secretary of State explains that a proposed amendment must be approved by at least two-thirds of both the Texas House and Senate to be placed on the ballot.

The available official election records therefore do not support describing H.J.R. 175 as a passed amendment. They establish that it was not on the 2025 ballot; they do not establish why it did not reach the ballot.
Would the proposal have made cryptocurrency legal tender?
No. The resolution named digital currency as one example of a mutually agreed medium of exchange for trading and contracting. It did not declare digital currency legal tender, and it did not require a business or individual to accept it. Its wording concerned the right to use an agreed-upon medium between parties.

Texas law separately defines “virtual currency” for purposes of Business and Commerce Code Chapter 12 as a digital representation of value used as a medium of exchange, unit of account, or store of value that is not legal tender, subject to exclusions. That chapter also leaves the determination of rights in virtual currency to other law. This statutory definition is separate from H.J.R. 175 and does not describe the proposal’s legal effect. H.B. 1056 is a separate enacted law concerning certain gold and silver specie, not digital currency. The distinction matters because its legal-tender language and payment-system provisions should not be attributed to H.J.R. 175.

H.B. 1056’s enrolled text says qualifying gold and silver specie is legal tender in Texas to the extent authorized by Section 10, Article I of the U.S. Constitution, while preserving the use of Federal Reserve notes. It sets September 1, 2026, for the specie provision and May 1, 2027, for the act’s other provisions. Those dates are the act’s stated effective dates; implementation status may change over time.
