No final U.S. ruling in the records cited here says Tesla has lost the “Cybercab” trademark. The USPTO issued nonfinal refusals on two Tesla applications in October 2025, and Tesla later opposed an earlier-filed application by Unibev. The Trademark Trial and Appeal Board docket checked for this article lists that opposition as pending.
What the records say about Tesla’s Cybercab trademark
There are three separate application files at issue, and they are at different procedural stages. The USPTO’s October 2025 actions concern Tesla applications 99185836 and 99211146. Unibev filed application 79412082 before those actions; Tesla’s opposition to Unibev’s application is a separate contested proceeding.

Why the USPTO objected to Tesla’s applications
Tesla application 99185836
In its October 6, 2025 nonfinal action, the examining attorney cited Section 2(d), the likelihood-of-confusion provision, based on existing U.S. Registration No. 5963829. The action states: “Registration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S. Registration No. 5963829.” It also identified Unibev’s earlier-filed application 79412082 as a potential bar if that application registered, and raised issues involving the identification of services and multiple classes. Tesla application 99211146
The October 22, 2025 nonfinal action on Tesla application 99211146 cited registrations 5963829 and 7854028 under Section 2(d), and separately identified Unibev’s earlier-filed application as a potential conflict. A nonfinal office action is an examination-stage notice, not a Board decision that Tesla has lost the name. The cited Section 2(d) analysis concerns whether the particular marks and goods or services can be registered without a likelihood of confusion. It does not, by itself, decide every question about Tesla’s ability to use the name.
What Tesla and Unibev claim in the opposition
Tesla’s notice of opposition alleges that Unibev pursued trademark filings in bad faith. The notice uses the heading “APPLICANT’S HISTORY OF BAD FAITH TRADEMARK SQUATTING”; that is Tesla’s characterization of its case, not a finding by the Board. Tesla’s notice of opposition

Unibev denied Tesla’s bad-faith allegations in its answer. The answer also admits specified facts, including that Unibev filed a French CYBERCAB application on April 29, 2024. An allegation, a denial, and an admission in a party’s pleading are not a decision resolving the dispute. Unibev’s answer
What “loses the trademark” would mean here
The phrase blurs distinct legal and procedural questions. Tesla has applications subject to nonfinal examination actions; Unibev has an earlier-filed U.S. application; and Tesla has challenged that application in an opposition proceeding. The records cited here establish neither a final decision awarding the U.S. registration to Unibev nor a final decision rejecting Tesla’s position in the opposition.

Trademark registration is also not identical to the practical ability to use a name. These filings address registration of specific marks for identified goods or services. They do not establish a blanket prohibition on using “Cybercab” in every context.

TTABVUE lists opposition 91305433 as pending and records Unibev’s answer dated April 23, 2026. That is the latest procedural status stated in the records cited here; the docket can change as the case proceeds. A later Board order or updated USPTO record could alter the status, so the docket should be checked for a current disposition before relying on this account.
