Did Caroline Ellison, Gary Wang and Nishad Singh Get Prison Time?

A former SDNY prosecutor predicted cooperating FTX defendants would probably avoid prison. The eventual outcomes differed: Ellison received 24 months, while Wang and Singh received time served.

Yes—Caroline Ellison received a two-year prison sentence. Nishad Singh and Gary Wang were sentenced to time served, with supervised release. Those outcomes differed from a prediction made in October 2023 by former federal prosecutor Josh Naftalis, who said cooperating first-time white-collar defendants typically avoid additional prison time.

What the prosecutor predicted in 2023

TechCrunch published Naftalis’s assessment on October 24, 2023, after interviewing him about the FTX defendants. He was describing a pattern from his experience, not announcing a legal rule or predicting a guaranteed outcome. He said that for a first-time offender who cooperates in a white-collar case, it is “pretty typical” not to serve actual jail time. He also cautioned that he had worked on cases where cooperating witnesses did receive prison time, though he considered that the exception.

That qualification matters: cooperation can help a defendant at sentencing, but it does not determine the sentence by itself. The forecast was also made before the three FTX executives were sentenced.

How the three FTX executives were sentenced

“Time served” means no additional prison term was imposed at sentencing. It does not mean the person was never detained, or that the criminal case and its consequences ended with the sentencing hearing.

Why Ellison’s result differed

Ellison’s sentence shows why Naftalis’s forecast should not be read as a promise. The Guardian reported that the judge recognized her cooperation but found that the seriousness of her conduct warranted incarceration. Cooperation was part of the sentencing picture, not an automatic exemption from prison.

The available reports establish the different outcomes, but they do not support reducing the judges’ decisions to a single formula or claiming that the three defendants’ roles and circumstances were identical.

Criminal sentences are separate from civil regulatory orders

The SEC reported final consent judgments involving the three former executives. The CFTC later reported supplemental consent orders involving Ellison and Wang, including trading and registration bans. These are civil regulatory measures, not additional criminal prison sentences. A prison sentence, supervised release, and a civil trading or registration restriction are distinct legal consequences.

How the forecast looks in hindsight

Naftalis’s prediction was directionally right for Singh and Wang if “avoid jail time” means receiving no further prison term at sentencing. It was wrong for Ellison, who was sentenced to 24 months in prison. The three outcomes confirm the qualification in his original comment: cooperation may matter, but it does not ensure that a defendant will avoid incarceration.
