Did Ben Affleck and J.Lo’s Prenup Really Include a Sexual Stipulation?

The widely repeated claim that Ben Affleck and Jennifer Lopez’s prenup required sex four times a week is unverified. The private agreement has not been produced in the reporting reviewed here, and a 2022 account says Affleck denied that specific claim in a 2003 interview. A separate 2003 report described an alleged no-cheating clause; that is a different claim.

Was there really a four-times-a-week sex clause?

There is no verified contract text establishing that Affleck and Lopez agreed to a sexual-frequency requirement. The claim circulated widely in 2022, but both El Universo and EL PAÍS framed it as a report attributed to other media, not as a term they had verified by examining the agreement.

El Universo’s 2022 article says Affleck denied the four-times-weekly clause in a 2003 Vanity Fair interview. It quotes him as saying, “You can’t legislate behavior. You have to believe in the person and believe that you can meet the challenges that you face.” The same later account gives his continuation: “It would be nice if you could have ‘the rules,’ but you just can’t write it.” These quotations are attributed here through El Universo’s report, rather than to an independently reviewed copy of the original interview.

What did the 2003 report say instead?

A September 2003 Guardian report said Lopez had insisted on a “no-cheating” term in a prenup being discussed before the couple’s planned wedding. It was a contemporary news account, but it did not reproduce the agreement. An alleged fidelity provision and an alleged sex-frequency requirement are separate claims reported in different contexts; one does not verify the other.

What is actually known about the agreement?

The original private document is not available in the reporting cited here, so its wording, legal status, and terms cannot be confirmed. Later 2024 coverage was also qualified: one law-firm blog characterized the couple as not having a prenup, while another article said that claim came from a source and cautioned that silence in a divorce filing cannot establish whether a private premarital agreement existed. The record described in that coverage does not settle the question of existence or contents.

Would a sexual requirement be enforceable?

The legal discussion in the cited coverage concerns Spain, not California law or a ruling on the couple’s agreement. EL PAÍS quoted Spanish legal professionals who viewed a sexual-frequency requirement as potentially contrary to liberty, dignity, or personal intimacy, while also presenting a different view about agreements voluntarily assumed by the parties. El Confidencial likewise reported disagreement among Spanish family-law experts and described possible limits under Spanish law. Those opinions address a hypothetical in a particular jurisdiction; they do not determine the validity or content of any Affleck-Lopez agreement.

For context on Spanish marriage arrangements, EL PAÍS reported that Spain’s Consejo General del Notariado recorded 15,840 property-separation agreements among 90,670 marriages in 2020. That figure concerns property arrangements in Spain, not sexual clauses or the couple’s private contract.
