In 2016, Anna Wurtzburger sued KFC, seeking $20 million over an $20 eight-piece meal whose bucket she said looked less full than KFC’s advertisements. She did not claim she received fewer than eight pieces. The federal court dismissed her complaint in 2017; she did not win $20 million.
What the lawsuit was about
Wurtzburger’s complaint concerned purchases at a KFC in Hopewell Junction, New York, between June and August 2016. In the court’s account, she bought a $20 Fill-Up meal advertised as an eight-piece bucket. She argued that KFC’s advertisements showed a bucket overflowing with chicken and that the bucket she received was not full. She said the bucket should have been smaller or filled to the rim. The court’s 2017 opinion describes the dispute.
Crucially, the court said she did not allege that KFC gave her fewer than the eight pieces she had purchased. The dispute was about how full the container appeared, not a claim that the meal was short by pieces.
What happened in court
On December 13, 2017, Judge Nelson S. Román of the U.S. District Court for the Southern District of New York dismissed the complaint in its entirety. The opinion reasoned that using a larger-than-necessary bucket was not materially deceptive to a reasonable consumer when the customer ordered, paid for, and received the requested number of pieces. It also found her assertion that the phrase “whole family” was misleading to be conclusory and found the injury she pleaded insufficient for the New York consumer-protection claims cited. The court’s order directed the clerk to terminate the case.

That ruling was a dismissal, not an award to Wurtzburger. The $20 million was the amount she sought, not money the court ordered KFC to pay.
What the $70 coupon offer means
CBS New York reported in October 2016 that KFC had offered Wurtzburger $70 in free-chicken coupons, which she refused. The report quoted her saying, “It’s the principle of the matter.” That was a contemporaneous news account of the offer, not a court-ordered settlement or a finding in the final ruling. Did KFC say a “family bucket” meant a chicken family?
That line is not supported by the court opinion. A 2025 Factcheck Lab review traced the story to the real lawsuit but found the “chicken family” comeback unsupported. The court record does not report KFC making that response. The Factcheck Lab review also addresses other viral versions.
Did she win after DNA testing the chicken?
No. The DNA-testing victory story is also unsupported by the reviewed case record. The court’s actual disposition was dismissal of the complaint on December 13, 2017, not a plaintiff victory. The court’s order records the outcome.

What this case does—and does not—establish
The decision turned on the allegations in this particular complaint: the meal was sold as eight pieces, and Wurtzburger did not allege receiving fewer than eight. It should not be read as a universal ruling that advertising or package-size disputes can never support a consumer claim. The court addressed the facts and claims before it.
