Delhi HC Warns Patanjali of Possible Costs in Dabur Ad Appeal

The September 2025 warning concerned Patanjali’s appeal of an interim order requiring edits to specific ads. It was not a fine, and a separate November “dhoka” ad ruling came in another suit.

The Delhi High Court’s September 19, 2025 warning to Patanjali Ayurved was conditional: withdraw its appeal of an interim order over advertisements about Dabur Chyawanprash or risk costs. The available reporting does not show that the court imposed a fine or costs. The appeal concerned edits to specific “ordinary” chyawanprash advertising—not a later, separate “dhoka” advertisement case.

What the September warning was about

Dabur challenged Patanjali advertisements for Patanjali Special Chyawanprash. Dabur alleged that references to “ordinary” chyawanprash made with 40 herbs pointed to Dabur Chyawanprash and disparaged it.

On July 3, 2025, Justice Mini Pushkarna issued an interim order requiring changes to specified advertising material. The order did not require the advertisements to be taken down altogether: they could continue subject to those edits. Patanjali challenged that order in appeal, case FAO(OS)(COMM) 140/2025.

At a September 19 hearing, a Delhi High Court division bench of Justices C. Hari Shankar and Om Prakash Shukla reportedly questioned whether the single judge’s discretionary interim order warranted appellate interference. Scroll reported that the bench told Patanjali to withdraw the challenge or face costs. Those were reported oral remarks; the available account does not establish a written order imposing costs or a fine. Scroll’s report on the September hearing.

What the court said about the separate “dhoka” ad

The November 6, 2025 ruling concerned another Dabur suit and a different advertisement. Justice Tejas Karia held at the interim stage that describing competing chyawanprash products as “dhoka” amounted to disparagement. The court restrained dissemination and directed that the advertisement be taken down or disabled within 72 hours. The suit was listed for February 26, 2026. This was not the appeal from the July order.

In explaining its reasoning, the court said comparative advertising is permissible, but an advertiser should not promote its product by alleging defects, shortcomings or deficiencies in competitors’ products. It said the assessment should consider the advertisement’s intent, manner, storyline and message, including the overall impression on consumers. The order put the distinction this way: “The fine distinction between asserting that one’s own product is better than another’s, and alleging that the other’s product is worse than one’s own, must always be carefully maintained.” It also said: “Disparagement of a rival or competitor’s product is wholly impermissible.” These statements are part of the court’s reasoning in this interim order, not a complete account of Indian advertising law. What is known about the case’s later status

A January 27, 2026 order in the July-order suit records that pleadings were complete and lists the matter for hearing on March 3, 2026. That procedural listing does not establish what happened at the hearing, or whether the appeal or underlying litigation has since been resolved. Delhi High Court order of January 27, 2026.
