Africa does not have one data protection statute that automatically governs every country. The African Union’s Malabo Convention sets out a continental framework, but the national law, regulator and transfer rules that apply depend on the countries involved and the specific data processing. For personal-finance services such as banking, payment apps and remittances, check the relevant national rules rather than assuming the same protections or obligations apply across the continent.
Does Africa have one data protection law?
No single continent-wide statute is identified here as governing all African countries. The African Union Convention on Cyber Security and Personal Data Protection—commonly called the Malabo Convention—is a regional treaty framework. National laws and regulators remain central to determining what an organization must do and what recourse a person has.
The African Union records the convention’s adoption on 27 June 2014 and its entry into force on 11 May 2020. Those dates describe the treaty at the continental level; they do not establish that every country has joined it or implemented its provisions in domestic law. The convention’s stated purpose includes harmonizing approaches while balancing the use of information and communications technologies with privacy and individual rights.
What does the Malabo Convention cover?
The convention text addresses data protection principles and individual rights, national supervisory authorities, complaints, audits, sanctions and certain cross-border transfers. These are treaty provisions, not a complete guide to the rights or procedures available in any particular country. For a specific issue, consult the applicable national statute and the local regulator’s guidance.

Among the functions described for national authorities are receiving complaints, auditing processed data, advising organizations, imposing administrative or monetary sanctions, and authorizing certain transfers across borders. The relevant domestic law determines the authority’s actual powers and the process a person or organization must follow.
How do continental digital-trade rules fit in?
Continental digital-trade materials are relevant to data flows, but they should not be treated as interchangeable with a national privacy statute or as automatically applicable to every transaction.

- AU digital-trade guidelines: The African Union published its Guidelines for Integrating Data Provisions in Protocols on Digital Trade on 22 May 2025. The AU says they form part of the broader AfCFTA Digital Trade Protocol framework, were endorsed by the Executive Council in February 2024 and align with the AU Data Policy Framework endorsed in February 2022.
- AfCFTA Digital Trade Protocol text: The text addresses electronic cross-border data transfers and cooperation on personal data protection. Whether and how it applies to a particular transaction depends on its legal status and implementation in the jurisdictions concerned.
For a business moving customer or account data between countries, check both the domestic privacy laws and any relevant trade-instrument implementation. Do not assume a provision in a continental trade text replaces national requirements.
What does this mean for personal-finance data?
Information handled by a bank, lender, payment provider, remittance service or budgeting app may move across borders when it is stored, accessed or processed in another country. The continental framework makes clear that transfers can raise legal questions, but it does not establish one universal transfer permission or procedure for every African country.

If a continental treaty or trade instrument may apply, verify its status and local implementation as well.
How should you check the rules for a country?
Start with the official text of the country’s current data protection law, regulations and regulator guidance. A country-by-country list or count of laws and operational regulators is not established by the sources summarized here, so a broad inventory should not be treated as definitive without current official records.
When comparing countries for a financial service or data-sharing arrangement, use the same questions in each jurisdiction:
- What is the law’s scope and territorial reach?
- What are the definitions and lawful bases for processing?
- What rights do individuals have, and what response deadlines apply?
- What duties apply to controllers and processors, including any registration obligations?
- Are there special rules for sensitive data, children or automated decisions?
- What breach-notification duties apply?
- What conditions govern transfers to another country?
- Which regulator has authority, what powers does it have, and how can a complaint be made?
- What penalties are available, and what enforcement practice is documented?
Kenya: a dated example of treaty participation
Kenya’s Office of the Data Protection Commissioner (ODPC) reported on 8 September 2025 that the Cabinet had approved Kenya’s accession to the Malabo Convention and that stakeholder consultations had begun. The ODPC also described itself as the statutory body regulating personal-data processing and enforcing Kenya’s Data Protection Act, 2019. That announcement documents a step in an accession process; it does not establish that accession was completed. Check an authoritative, up-to-date treaty-status record before relying on Kenya’s participation.
A practical compliance checklist
If you operate a financial service, handle customer financial information, or are assessing a provider, map the processing before deciding which rules apply:

- List the countries involved. Include where the organization operates or targets people, where people are located, and where data is stored or accessed.
- Identify roles and purposes. Establish whether each organization acts as a controller or processor and why the data is being used.
- Classify the information and flows. Record the data categories, recipients, storage locations and any cross-border access or transfers.
- Check local requirements. Read the current national law, regulations and regulator guidance, including rules on registration, impact assessments, individual-rights requests and breach reporting.
- Verify transfer conditions. Determine whether the law requires a particular safeguard, adequacy finding, authorization or other mechanism for each destination.
- Confirm instrument status. Check whether a continental treaty or trade instrument is in force and implemented for the countries and activity involved.
- Use the national regulator as a starting point. Its official materials can direct you to local procedures and authoritative legal texts.
