Possibly—but the opening is not yet a guaranteed route to customers or a startup boom. A jury found for the states that took Live Nation and Ticketmaster to trial, while a separate, proposed federal judgment would require certain forms of third-party ticket marketplace access and change some exclusivity arrangements. Whether startups can turn those developments into business depends on the final rules, which venues and ticket inventory are covered, and how venues implement them.
Two legal tracks produced different outcomes
The U.S. Department of Justice and state attorneys general sued Live Nation Entertainment and its wholly owned subsidiary Ticketmaster in May 2024. DOJ alleged that the companies used their combined positions in concert promotion, venue relationships and ticketing to restrain competition. The complaint pointed to exclusive venue contracts, barriers to venues using multiple ticketing services and conduct DOJ said could impede rivals. Those were allegations in the complaint, not findings at the time the case was filed.
The federal and state cases later diverged. DOJ filed a notice of settlement in March 2026, while a coalition of states continued to trial. On April 15, 2026, the jury found for the litigating states. Oregon Attorney General Dan Rayfield’s office reported findings that Ticketmaster unlawfully maintained a monopoly in primary ticketing at major concert venues, Live Nation held a monopoly in large amphitheaters, and Live Nation unlawfully required artists using its amphitheaters to use its promotion services.
The verdict and the proposed federal settlement are separate developments. The proposed judgment filed in federal court on June 12, 2026, describes terms for resolving DOJ’s claims; it is not the jury’s verdict and should not be treated as a final, operative order.

How the proposed federal terms could open a route to inventory
As summarized in the Federal Register, the proposed federal judgment would require technology enabling certain major concert venues that use Ticketmaster backend software to distribute primary tickets through third-party marketplaces. It also proposes changes to some exclusivity arrangements, access for alternative sellers at Live Nation amphitheaters and other conduct restrictions. If approved and implemented, these provisions could make some inventory or venues more reachable by competing services.
That is a potential route to market, not a guarantee that any startup can list every Ticketmaster event. The terms described apply to certain venues and circumstances; the materials do not establish that every venue, event or ticket is covered, or that every seller would receive identical access. Final approval, implementation details and commercial terms matter.

Marketplace access is different from replacing a venue’s ticketing provider
A startup could seek to reach customers through third-party marketplace distribution, or it could compete to become a venue’s primary ticketing provider. Those are distinct opportunities: a marketplace may distribute eligible primary inventory while another company continues to provide the venue’s underlying ticketing system. The proposed provisions do not establish that a startup has won a venue contract or can replace Ticketmaster’s backend.

Access alone will not make a ticketing business viable
Even if new access becomes available, a startup would still need to persuade venues, sellers or customers to use its service. A workable entry strategy would need to account for:
- Coverage: which venues and inventory are actually eligible, and whether that coverage is large enough to attract buyers.
- Integration: the technical work needed to connect with ticketing systems and meet venue requirements.
- Contracts: whether exclusivity or other agreement terms limit a venue’s ability to add another provider or marketplace.
- Economics: fees and other commercial terms for access, alongside the cost of operating the service.
- Execution: dependable ticket delivery, customer support and fraud controls, as well as a way for buyers to discover events.
These questions help distinguish a legal opening from a sustainable business. The available materials do not provide a sourced forecast for startup revenue, market share or consumer savings, so the verdict cannot support a quantified prediction of those outcomes.

The verdict did not settle every remedy or damages question
A jury verdict does not by itself specify every remedy. In a July 30, 2026 SEC filing, Live Nation said the jury awarded damages measured on a per-ticket basis without calculating how many tickets the measure would cover. The filing described post-trial motions and a remedies phase as subsequent steps. That account is the company’s filing, not a court determination of the final damages total or remedy.
The distinction matters to startups because access rules, remedies and implementation are what could determine whether the legal outcome changes day-to-day market conditions. The records described here do not establish a final total damages award or the eventual scope and durability of the remedies.

What the case’s scale figures do—and do not—show
In its 2024 announcement of the complaint, DOJ said Live Nation owned or controlled more than 265 concert venues in North America, including more than 60 of the top 100 U.S. amphitheaters. DOJ also reported more than $22 billion in annual global revenue across Live Nation’s three business segments. These are figures from DOJ’s 2024 description, not a current independent count or current revenue figure. They indicate why venue access was central to the government’s case, but they do not measure how much business a startup could win.
