Could Tesla Have Avoided the $242.5 Million Autopilot Verdict?

A filing reported by TechCrunch says plaintiffs offered to settle the Autopilot crash case for $60 million in May 2025. The later verdict totaled about $242.5 million, but the trial and appeal record add important context.

Possibly: a filing reported by TechCrunch says plaintiffs offered to settle the Benavides v. Tesla case for $60 million in May 2025, and Tesla did not accept within 30 days. A jury later awarded damages that put Tesla’s total exposure at approximately $242.5 million. That sequence shows a reported opportunity to settle for less than the eventual award; it does not prove that a settlement was certain to resolve every claim or reveal why Tesla did not accept.

What the $60 million settlement offer tells us

TechCrunch reported on August 25, 2025, that plaintiffs made the settlement proposal in May 2025 and disclosed it in a filing seeking payment of their legal fees. A representative for plaintiffs’ attorney told TechCrunch the offer was rejected by default after Tesla did not accept it within 30 days.

“Tesla did not accept Plaintiffs’ Proposals for Settlement within thirty (30) days of service. Therefore, Tesla rejected the Proposals for Settlement by operation of the rule and statute.”

The quotation is from the filing as reproduced by TechCrunch. The filing said the proposals were made under Florida Rule of Civil Procedure 1.442 and Florida Statute § 768.79. It establishes the reported offer and non-acceptance within the stated period; it is not a judicial finding that the proposed settlement would necessarily have ended all claims.

The available reporting does not establish Tesla’s internal reasoning for not accepting. Tesla later said it planned to appeal, citing “substantial errors of law and irregularities at trial,” as reported by TechCrunch. That is Tesla’s characterization, not a court finding.

How the crash and lawsuit reached trial

The crash happened in Key Largo, Florida, on April 25, 2019. George McGee was driving a 2019 Tesla Model S equipped with Autopilot when it struck a parked Chevrolet Tahoe. The Tahoe then struck Naibel Benavides Leon, who died, and Dillon Angulo, who was injured. Benavides Leon’s estate filed suit in 2021; Tesla removed the case to federal court, and Angulo later brought a related action that was consolidated with it.

The verdict did not decide every claim originally pleaded. On June 25, 2025, the court granted Tesla summary judgment on claims of defective manufacture and negligent misrepresentation. What the jury awarded—and what Tesla’s share means

The jury returned its verdict on August 1, 2025. Tesla’s Form 10-Q for the quarter ended June 30, 2026, reports $129 million in total compensatory damages, assigns 33% of fault to Tesla and 67% to McGee, and lists $200 million in punitive damages. The distinction matters: the compensatory verdict was allocated between Tesla and the driver, while the punitive award was a separate component.

What happened after the verdict

Tesla asked the trial court for judgment as a matter of law, a new trial, or an amendment to the judgment. On February 19, 2026, U.S. District Judge Beth Bloom denied the motion. The order said the arguments largely repeated points the court had already considered and rejected, and that admitted evidence supported the verdict. Judge Bloom wrote: “Furthermore, Tesla does not present additional arguments or controlling law that persuades this Court to alter its earlier decisions or the jury verdict.”

Tesla’s 2026 second-quarter Form 10-Q says it filed its opening brief in the U.S. Court of Appeals for the Eleventh Circuit on July 2, 2026. That is the latest appeal milestone established by the cited filing; it does not say the appeal has been decided. Tesla states in the filing that it believes the facts and law do not justify the damages and reports an immaterial accrual. Those are the company’s positions, not conclusions reached by the trial judge.
