How Congress sought to block cancellation
Lawmakers used two distinct funding measures. Section 163 of the FY2026 National Defense Authorization Act (NDAA), Public Law 119-60, bars FY2026 funds from being used to terminate the E-7A rapid-prototype contract or to end, or prepare to end, operations at an E-7A production line. The provision restricts specified uses of money; it does not itself procure or field operational aircraft. Read Section 163 of Public Law 119-60.
The FY2026 Defense Appropriations bill text takes a broader approach: it restricts use of funds in the bill and prior appropriations to pause, cancel, or terminate the E-7 program, or prepare to do so. The House-passed text is available at H.R. 4016. The sources available for this article do not establish the bill’s ultimate enactment status as of October 8, 2026, so its restriction should be described as a provision in the bill text, not as a confirmed enacted law.

What the House text requires from the Air Force
A July 21, 2026 House Congressional Record provision calls for more than a funding restriction. It requires the Air Force Secretary to provide congressional defense committees with an E-7 procurement and fielding schedule, a schedule for achieving operational capability, and a funding profile across the Future Years Defense Program. It also requires certification that the plan preserves airborne early warning, battle management, and command-and-control capability, and that planned E-3 retirements do not create a gap in coverage, mission availability, or responsiveness. The same House text changes the stated E-3 minimum inventory restriction from 16 aircraft to 15 and extends its application through FY2027. These are provisions in the House text; they do not establish that E-7 aircraft have been delivered or that the required schedule guarantees a particular fielding date.
Why the Department of Defense wanted to cancel the program
At its FY2026 budget briefing, the Department of Defense said it was canceling the E-7 because of significant schedule delays, projected cost increases, and survivability concerns in a contested environment. The briefing gave projected per-aircraft costs rising from $588 million to $724 million and said the department would invest in alternatives, including space-based capabilities and additional E-2D aircraft. What is known about the proposed $900 million increase
The Senate Appropriations Committee reported that its FY2026 Defense Appropriations Act included an additional $900 million for the E-7 early-warning and battle-management mission aircraft. Its release said the bill passed the House 217–214 and the Senate 71–29 and was headed to the President. The $900 million is the committee’s reported increase, not a verified final enacted amount; the cited materials do not establish the bill’s ultimate status or final E-7 funding as of October 8, 2026. The enacted NDAA restriction and the appropriations bill text make cancellation harder to carry out using the funds they cover. The House requirements also seek a schedule, funding profile, and assurance that E-3 retirements will not leave a capability gap. None of these provisions, on its own, proves that the Air Force has fielded E-7 aircraft, establishes a delivery date, or resolves the department’s objections about cost, schedule, and survivability.
