The $33.7 million figure in contemporaneous coverage was a reported dollar equivalent, not a fixed current conversion. The decision concerned Clearview’s service for law-enforcement and public defenders, not every use of facial-recognition technology.
What the Dutch regulator decided
The AP found that Clearview processed personal data of people in the Netherlands without a legal basis for its “Clearview for law-enforcement and public defenders” service. The European Data Protection Board’s summary of the decision says the AP imposed a €30.5 million fine and four orders backed by penalties for non-compliance, intended to end ongoing violations. The EDPB summary was published on 3 September 2024 and identifies the decision date as 16 May 2024.

The Associated Press used $33.7 million as the contemporaneous dollar equivalent in its 2024 report. The euro fine is the amount imposed by the AP; dollar values can change with exchange rates. The AP report republished by CityNews Halifax also described the agency as calling Clearview’s collection an “illegal database” of faces. That phrase is the regulator’s characterization as reported by AP.

The EDPB summary says the AP identified breaches involving GDPR Articles 5, 6, 9, 12, 14, 15 and 27. In practical terms, its findings covered several distinct duties:

- Biometric data: The AP found that Clearview processed biometric data contrary to GDPR Article 9, which governs special-category personal data.
- Transparency: The company did not adequately inform people whose data it processed.
- Access rights: The AP found failures to respond to two access requests and to facilitate people’s access rights.
- EU representation: Clearview had not appointed a required representative in the European Union.
These are findings by the Dutch authority about Clearview’s processing in the case before it. They should not be read as a blanket ruling that every facial-recognition system or use is unlawful.
How the fine differs from the compliance orders
The €30.5 million amount is the base fine. The four orders are separate remedies requiring Clearview to end continuing violations. The AP’s contemporaneous report said that non-compliance could lead to up to €5.1 million in additional penalties. That potential amount is not part of the base fine, and the EDPB summary does not state that the additional penalties were imposed or collected.

The AP also warned Dutch companies against using Clearview’s services, according to its contemporaneous reporting. That warning concerns companies in the Netherlands; it is not evidence of a restriction applying in every country.

At the time of its announcement, the AP said Clearview had not objected to the decision and therefore could not appeal the fine. This describes the regulator’s reported position at that time. The available official summary and contemporaneous report do not establish later court proceedings, whether the fine was collected, or whether the compliance orders or possible additional penalties were later enforced.

What the decision means for people and businesses
For individuals, the AP’s findings underscore that biometric information and access to personal data are subject to GDPR safeguards; people can make access requests to seek information about processing. For organizations, the decision is a warning to assess their own legal basis, transparency duties, handling of biometric data, and EU representation obligations rather than assuming a vendor’s service is compliant. The AP’s specific warning about Clearview was directed to Dutch companies.
