The City of South Perth planned to auction two properties—3 Lyall Street in South Perth and 92 Ryrie Avenue in Como—if their outstanding rates and service charges were not paid within three months. PerthNow reported the proposed action on 6 July 2024; the available sources do not establish whether either property was later auctioned or sold.
What the City planned to do
PerthNow reported on 6 July 2024 that the City had taken possession of both properties and that their owners had three months to pay before the properties could be sold by public auction. The auction was a conditional next step, not a report of a completed sale. The City’s public notice dated 11 June 2024 confirms its possession action for 92 Ryrie Avenue: “In accordance with the Local Government Act 1995, the City is taking possession of 92 Ryrie Avenue, Como.” PerthNow’s report and the City’s public notices are the sources for those reported steps.

The figures below were attributed to the City by PerthNow in July 2024. They are historical reported amounts, not verified current balances or property valuations.

The “amount sought” should not be read as the amount originally unpaid: PerthNow reported it separately from the three-year arrears and stated that costs would be additional. Neither figure should be treated as a current debt total.

How a rates-related sale can happen in Western Australia
Under the Western Australian Government’s guidance on sale of land for unpaid rates, the framework is Part 6, Division 6, sections 6.63–6.75 and Schedules 6.2–6.3 of the Local Government Act 1995, together with regulations 72–78 of the Local Government (Financial Management) Regulations 1996. The process is not an immediate sale triggered by one missed payment:
- The land must be rateable, and rates or service charges must have remained unpaid for at least three years.
- The local government must take possession and give the notices required by law.
- A sale notice states the amount owing and says the land may be offered at public auction if the amount remains unpaid after three months. The appointed auction time must be between three and twelve months after service of that notice.
- Generally, the local government must have made at least one court recovery attempt within the preceding three years, although the guidance identifies exceptions.
Landgate’s guidance on transfers for unpaid rates explains that the debt is a charge against the land and that the law can allow a sale to a third party or a transfer to the local government or State. It describes title memorial and T5 transfer procedures, including electronic lodgement for eligible transfers from May 2025. Those general procedures do not establish what happened to either property named in the 2024 report.

What is—and is not—known about the outcome
The contemporaneous report and City notice establish a proposed rates-recovery process and, for 92 Ryrie Avenue, the City’s stated possession action. They do not establish that either property was later auctioned, sold, or had its debt paid. The reported amounts also do not establish current arrears, ownership, or property values. A later outcome should not be inferred from the notice of a possible auction.
