George R. R. Martin is suing OpenAI as one of several authors in an Authors Guild-led copyright class action—not in a separate case about one fan-fiction prompt. The complaint alleges that ChatGPT produced summaries and detailed outlines based on Martin’s books, including a prequel and an alternate sequel using existing characters. Those are allegations, not findings that OpenAI infringed copyright.
Who is Martin suing?
Martin is a named plaintiff in a broader class action brought by authors and led by the Authors Guild. The complaint names OpenAI entities as defendants; the Guild’s September 2026 update describes the consolidated litigation as involving OpenAI and Microsoft. The case is not a lawsuit against ChatGPT as a standalone defendant. The Guild’s original announcement explains the filing and quotes OpenAI’s position at that time: that it respects authors’ rights and believes authors should benefit from AI technology. What does the complaint say ChatGPT wrote?
The consolidated complaint says Martin owns or beneficially owns registered copyrights in 15 works. It alleges that OpenAI copied books without permission to train large language models and that prompts produced outputs based on Martin’s writing. The examples include summaries of A Game of Thrones, A Clash of Kings and A Storm of Swords, as well as two outlines that use existing series characters:
- “A Dance With Shadows”, described as an alternate sequel outline.
- “A Dawn of Direwolves”, described as a prequel outline.
The complaint characterizes one result this way: “When prompted, ChatGPT generated an infringing, unauthorized, and detailed outline for a prequel book to A Game of Thrones.” “Infringing” is the plaintiffs’ characterization, not a court’s conclusion. Calling the examples “fanfic” is shorthand for the alleged outlines using the series’ characters; the complaint does not establish that Martin filed a separate suit over a single fan-fiction prompt. Does the Berkeley study prove ChatGPT memorized the novel?
No. The complaint cites a 2023 study by University of California, Berkeley researchers Kent K. Chang and co-authors, Speak, Memory: An Archaeology of Books Known to ChatGPT/GPT-4. It reports that A Game of Thrones ranked 12th on the study’s reported memorization measure. That is a figure attributed to the complaint’s description of the study—not a judicial finding, and not by itself proof that the model reproduced protected text or infringed copyright. Has a judge ruled that OpenAI infringed copyright?
No final merits ruling is established by the available case updates. On October 27, 2025, the Southern District of New York denied OpenAI’s motion to dismiss the consolidated complaint’s output-based infringement claim, concluding that the complaint adequately stated a prima facie claim. That ruling allowed the claim to continue; it did not decide that copying, training, or any particular output infringed copyright. Southern District of New York, Document 716, October 27, 2025

What happens next in the case?
According to the Authors Guild’s September 2026 update, class plaintiffs filed for summary judgment on September 4, 2026, and defendants filed their own summary-judgment motions. The Guild said fact and expert discovery had been completed that summer. A summary-judgment motion asks a court to resolve issues as a matter of law; disputed material facts can mean a case proceeds to trial.
