Re:

Card Surcharges vs. Cash Discounts: What Consumers Should Know

A surcharge adds to the price for credit-card payment; a cash discount reduces the regular price for a qualifying payment method. Posted prices, advance disclosure, location-specific law, and card-network rules all matter.

A credit-card surcharge adds an amount when you choose to pay by credit card; a cash discount lowers the regular price when you use cash or another qualifying payment method. The label a business uses is not decisive: the posted or regular price, how and when any fee is disclosed, the law where you pay, and applicable card-network rules all matter.

When comparing payment options, start with the price the seller treats as regular, then check what you would actually pay with each method. A discount and a surcharge can look similar at checkout, but they are not interchangeable descriptions—and a clearly disclosed charge is not automatically permitted.

How a surcharge differs from a cash discount

The practical difference is the price the business treats as its regular price. A surcharge is an added charge for paying by credit card. A cash discount is a reduction from the regular price for paying with cash or another qualifying method. Two signs can display different numbers while describing the same transaction differently, so focus on the regular or posted price—not just the words “fee,” “discount,” or “cash price.”

What to check Credit-card surcharge Cash discount
Price mechanics An amount is added when you choose a credit card. The regular price is reduced when you use cash or another qualifying method.
Reference price The regular or posted price is the baseline; the card price is higher. The regular or posted price is the baseline; the qualifying payment price is lower.
What the label tells you Not enough by itself to establish how the price is treated or whether the charge is allowed. Not enough by itself to establish how the price is treated or whether the reduction is allowed.

Regulation Z’s official interpretation describes the regular price as the tagged or posted price when a single price is displayed. It also addresses cases in which no price is tagged or two prices are tagged, identifying the credit-card price as the regular price in specified circumstances. At a fuel pump, for example, the displayed pump price is treated as the posted price in the interpretation. The details matter when deciding whether a payment option is presented as a discount or an added fee. See the CFPB’s Regulation Z § 1026.4 and official interpretation.

The CFPB interpretation permits cash discounts and gives examples of distinctions among cash, check, and card payments. It says the merchant must make the discount available to prospective buyers, while allowing certain distinctions among payment methods. That does not mean every arrangement called a discount is automatically lawful under every state or local rule.

In practical terms, ask what price is being used as the starting point. If the business shows one price and adds a card fee when you reach checkout, that is the kind of price change consumers commonly mean by a surcharge. If the business advertises a regular price and offers a lower price for cash, that is commonly described as a cash discount. These descriptions help explain the mechanics; they do not decide legal status on their own.

Likewise, a menu or sign that displays more than one price does not answer every question. Find out which amount applies to which payment method, whether any conditions apply, and whether the seller treats one amount as the posted or regular price. The CFPB interpretation’s treatment of single-price, untagged, and dual-price situations is why the baseline price matters. Consumers should not infer the legal classification solely from a sign’s wording.

What to check before you pay

  1. Identify the regular or posted price. Look at the displayed price, including the shelf tag, menu, posted service price, or pump price. If the business shows more than one price, ask which one is its regular price and what conditions apply to each.
  2. Find out whether the fee is avoidable. Ask whether a viable payment method at that same location or on that same platform avoids the fee. The FTC’s rule treats an avoidable payment-processing fee differently from a mandatory fee when calculating the total price a business must disclose.
  3. Check the disclosure before you agree to pay. For an avoidable fee, the FTC says the business must disclose it before you consent to pay and state its nature, purpose, and amount. Review the displayed total before authorizing the transaction; a fee first revealed after you have agreed to pay raises a different disclosure concern from a fee clearly presented in advance.
  4. Separate disclosure from legality. A clearly displayed fee is not necessarily permitted. The FTC says payment-processing fees may be charged or passed through only if otherwise permitted by law, and Visa’s rules and applicable state and local requirements may also apply.
  5. Check the jurisdiction for the transaction. The relevant rules depend on where the transaction takes place. If you are deciding whether to dispute a charge, identify the state and locality involved and consult current rules for that jurisdiction rather than relying on a general statement about U.S. law.

These checks answer different questions, so do them separately. The posted-price question is about whether the transaction is framed as an added fee or a reduced price. Avoidability and disclosure concern what the seller must communicate about a fee under the FTC rule. State, local, and network requirements concern whether the practice is permitted. Passing one check does not automatically answer the others.

Compare the amount you will actually pay

Before choosing a payment method, compare the amount shown for each option, including any fee that applies to your choice. If the seller advertises a cash price and a different card price, ask which is the regular price and how the prices map to payment methods. If the seller starts with one posted amount and adds a charge for card use, check the fee’s amount and purpose before consenting to pay. The point is not to assume that one arrangement is lawful and the other is not, but to understand the price mechanics and then check the applicable rules.

Avoid assuming that “cash discount” means cash is the only qualifying method. The CFPB interpretation gives examples involving cash, checks, and cards and allows certain distinctions among those methods. Ask which payment methods qualify at that business. The phrase “another qualifying payment method” depends on the seller’s stated terms and applicable rules; it should not be read as a promise that every non-card method receives the same price.

Questions worth asking at the counter or online

  • “Which price is the regular or posted price?”
  • “Does this fee apply to every payment method, or can I avoid it with another viable method here?”
  • “What is the fee’s amount and purpose, and where was it disclosed before checkout?”
  • “Which payment methods qualify for the lower price?”
  • “Does the displayed total include every required fee before I authorize payment?”

For an online transaction, the same consumer questions apply to the platform where you are purchasing: determine whether the fee can be avoided through a viable method offered on that platform and inspect the price information before agreeing to pay. The FTC describes avoidability by reference to another viable method at the same location or platform. A payment option that is not actually offered for that transaction is not a useful comparison.

What the FTC fee rule requires—and what it does not

The FTC’s Rule on Unfair or Deceptive Fees took effect on May 12, 2025. The FTC says that when a payment-processing fee is avoidable, a business must disclose it and include it in the final amount before asking for payment. The business may not misrepresent the fee’s purpose or amount. The FTC announced the effective date on May 12, 2025; its FAQ explains the rule’s requirements.

If a business requires payment by credit card, the FTC says it must include the mandatory fee in the total price. If another viable payment method at that location or platform avoids the fee, the business may exclude it from the total price, but it must disclose the fee and state its nature, purpose, and amount before the consumer agrees to pay. The rule addresses price disclosure; it does not make every surcharge lawful or displace other applicable restrictions.

This distinction is important at checkout. A required fee is part of the price a consumer must pay, so it belongs in the total price. An avoidable fee may be left out of that total under the FTC’s described treatment, but the consumer must still be told about it—including what it is for and how much it is—before agreeing to pay. Being told only after payment, or seeing an unexplained amount without its nature and purpose, is not the same as receiving the advance disclosure described by the FTC.

The rule also does not turn a disclosure into permission. A seller could provide information about a fee and still face a separate question about whether that fee is permitted by law. Conversely, a consumer who sees a price difference should first clarify the mechanics rather than conclude from the label alone that a violation has occurred.

As the FTC puts it: “Businesses may charge or pass through credit card or other payment processing fees if otherwise permitted by law.” That qualification is important: compliance with a disclosure rule does not by itself settle whether state law, local law, or card-network rules allow a particular charge.

Why there is no single nationwide answer on legality

Whether a particular surcharge or discount is allowed can depend on the transaction’s location and the payment method. State and local requirements can differ, and card-network rules impose separate requirements on participating merchants. A business cannot establish that a fee is lawful merely by disclosing it, and a network’s general policy does not override stricter applicable law.

Visa says U.S. surcharging is permitted in most states, subject to applicable laws and its merchant requirements. It also says merchants generally may not add amounts over the advertised or normal price unless the law expressly permits a surcharge. Visa’s rules and policies describe its requirements; they are not a complete guide to every state or local rule.

Florida illustrates why a broad answer can mislead. Florida’s 2025 statute, § 501.0117, prohibits a seller or lessor from imposing a surcharge for choosing a credit card, subject to the statutory text and exceptions. That statement is limited to Florida and the 2025 statutory text; it is not a state-by-state survey or a determination of how a particular transaction should be resolved. Read Florida’s 2025 statute § 501.0117.

For a specific disputed fee, check the current law and regulator for the place where the transaction occurred, along with the relevant network rules. A general claim that all U.S. surcharges are either legal or illegal goes beyond what these sources establish.

Do not treat “permitted in most states” as a determination about your own purchase. It does not identify the current rule for every state, locality, transaction, or exception. Florida’s statutory example makes clear that at least one jurisdictional rule can differ from a broad description of general network policy. For a current answer, narrow the question to where the transaction occurred and check the law and regulator there.

If a fee appears unexpectedly

  • Keep the receipt and, if available, a photo or copy of the price display and checkout screen. Note the business location, transaction date, amount, payment method, and when the fee first appeared.
  • Ask the business to identify the fee, explain whether it is mandatory or avoidable, and show where its amount and purpose were disclosed before you agreed to pay.
  • If the fee was not disclosed as required, or you believe it is barred where the transaction took place, raise the issue with the business and check the relevant state or local regulator’s current consumer guidance.
  • If you contact your card issuer about a transaction, describe what happened accurately and provide the documentation. The issuer can explain its dispute process; an unexpected fee is not automatically proof that a charge qualifies for reversal.

It can help to keep the facts distinct when making an inquiry: the price posted before you selected a payment method; the amount ultimately charged; the payment choice you made; whether another viable method was offered; what the seller disclosed and when; and the transaction’s location and date. Those details help a business, regulator, or card issuer understand what happened without assuming in advance that the charge was either allowed or prohibited.

If the displayed price and final total differ, first ask the business to explain the difference and point to the advance disclosure. If the answer does not resolve the concern, the FTC guidance and the state or local regulator for the transaction’s location are more relevant than a general social-media claim about surcharge legality. For a card transaction, your issuer can explain its own dispute process, but it is not a substitute for determining the applicable law.

This is general consumer information, not a legal determination. The legality of a particular charge depends on the facts and the rules that apply to that transaction.

Frequently Asked Questions

What is the difference between a credit-card surcharge and a cash discount?

A surcharge adds an amount when you choose to pay by credit card. A cash discount reduces the regular price for paying with cash or another qualifying method. The posted or regular price is the key reference point; the seller’s label alone does not settle the classification or legality.

Are credit-card surcharges legal everywhere in the United States?

There is no single answer that applies everywhere. Visa says surcharging is permitted in most states subject to applicable law and its merchant requirements, while state and local rules can differ. Florida’s 2025 statute, for example, prohibits a surcharge for choosing a credit card subject to the statutory text and exceptions. Check current rules for the transaction’s location.

Does the FTC fee rule make every credit-card surcharge legal?

No. The FTC says processing fees may be charged or passed through only if otherwise permitted by law. Its fee rule addresses disclosure and total-price presentation; state or local law and card-network requirements can impose separate restrictions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When must a business disclose a payment-processing fee?

Under the FTC’s FAQ, if a viable payment method at the same location or platform avoids the fee, the business must disclose the fee’s nature, purpose, and amount before you agree to pay. If the business requires the fee, it must include it in the total price.

What should I do if a card fee was not shown until checkout?

Keep the receipt and any available copy or photo of the posted price and checkout screen. Note the location, date, amount, payment method, and when the fee appeared. Ask the business to explain the fee and its advance disclosure, then check current guidance from the regulator for that location if the issue remains. Your card issuer can explain its dispute process, but an unexpected fee is not automatically eligible for reversal.

The Bottom Line

A surcharge adds to the price for choosing a credit card; a cash discount lowers the regular price for a qualifying payment method. Check the posted price, whether the fee can be avoided, and whether its nature, purpose, and amount were disclosed before you agreed to pay. Then check the rules for the transaction’s location: disclosure alone does not establish that a fee is permitted.
