Yes, you can use AI as a limited drafting and organization aid—but treat everything it produces as an unverified draft, not as authority on your claim. Check every factual detail against your original records, follow the official instructions for your program and jurisdiction, and avoid entering unnecessary sensitive information into a consumer AI service.
What AI can—and cannot—do for a claim
A generative AI tool may help you turn your own notes into a clearer chronology, make a checklist from official instructions, summarize a document for your own review, or draft questions for a claims office or representative. These are practical uses, not uses evaluated or endorsed for claimants by the U.S. Department of Labor (DOL).
DOL’s 2025 AI strategy describes agency uses such as document analysis and summarization, extracting information from complex forms, and redacting personally identifiable information. Those government use cases do not establish that a public chatbot is accurate or appropriate for your personal claim.
Do not ask AI to fill gaps in your account, embellish symptoms, convert uncertainty into certainty, or decide whether you qualify for benefits. It can help present information you provide; it cannot replace the official form, claim process, or a qualified person’s advice about a disputed case.

How to use AI without losing control of the facts
- Start with the right official instructions. Identify the agency and workers’ compensation program responsible for your claim before asking AI to help. Forms and filing routes differ by program and jurisdiction.
- Provide only information needed for the task. For example, you can ask for a chronology template or a checklist without uploading an entire medical or claim file.
- Keep your source records. Compare any generated summary or draft against the original documents. Verify names, dates, work events, symptoms, treatment, wages, and the benefit you are requesting.
- Preserve uncertainty accurately. If a date or detail is unclear, mark it for checking rather than allowing AI to guess or state it as fact.
- Submit through the designated channel. Use the required official forms and filing process; do not treat a chatbot’s explanation as a substitute for them.
Which forms and filing route apply?
Workers’ compensation is not one nationwide filing system. The federal examples below apply to particular DOL programs; they do not set the forms or deadlines for every state claim.
Federal employees covered by FECA
DOL directs federal employees filing under the Federal Employees’ Compensation Act (FECA) to register for ECOMP and file the appropriate form. A CA-1 is for a qualifying traumatic injury tied to a specific work event or series during a single day or shift. A CA-2 is for an occupational disease produced by continued or repeated exposure over longer than one workday or shift. DOL describes ECOMP as a free web application. DOL also states on that page: “You do not need approval from your supervisor or anyone else at your agency to initiate your FECA workers’ compensation claim.” That statement is about starting a FECA claim; it should not be assumed to describe state or other workers’ compensation systems.
Longshore and Harbor Workers’ Compensation claims
DOL’s Longshore claimant page lists program-specific forms, filing deadlines, and instructions. Claimants can submit case documents electronically through SEAPortal. FECA forms are not a universal substitute for Longshore forms, or for state forms.

State claims
For a state claim, use the responsible state agency’s instructions and the forms and deadlines that apply there. The federal FECA and Longshore examples do not establish state requirements. Texas, for example, has its own rules for access to workers’ compensation claim-file information, described by the Texas Department of Insurance, Division of Workers’ Compensation.
Protect medical, wage, and identifying information
Claim-preparation materials may contain medical details, wages, dates of birth, employer information, and claim identifiers. DOL says FECA claim cases are protected under the Privacy Act and explains routine access to claim information in its Rights of the Injured Employee information. DOL’s Longshore document-submission FAQ discusses access to claim files and release-of-information rules. Texas also says information in or derived from a workers’ compensation claim file is confidential except as provided by state law.

These protections concern agency claim files. They do not establish how a separate consumer AI service stores or uses what you type into it. Before using a service, check its current terms for retention, model training, deletion, and account controls. Avoid unnecessary identifiers and consider using a blank template or asking the agency or a qualified representative what information is needed. Provider practices differ; no particular AI product’s privacy terms are established here.

DOL’s Longshore FAQ recognizes attorneys and authorized representatives among those who may access claim files for claim administration. That does not make representation mandatory or establish that any particular lawyer is right for your case.
