AI vs. a Workers’ Compensation Attorney: Which Tasks Can Each Handle?

AI can organize notes and draft questions, but a workers’ compensation attorney can apply state law, advise you, and advocate in a dispute. Learn what each can—and cannot—do.

AI can help organize information and prepare drafts; a workers’ compensation attorney can apply state law to your facts, advise you, and represent you in a dispute. Treat AI output as unverified assistance, not legal advice. If your claim is denied, benefits are disputed, or a hearing or appeal deadline is approaching, contact a qualified attorney in your state or the appropriate state agency promptly.

How AI and an attorney differ

The practical distinction is between working with information and taking responsibility for legal judgment and advocacy. A general-purpose AI tool may help you arrange information you provide. It cannot take responsibility for advising you about your rights, choosing a legal strategy, or representing you in a contested proceeding.

Organizing a claim Turning your notes into a dated chronology or grouping questions by topic. Identifying which facts and records matter under the law in your state.
Working with documents Summarizing documents you are authorized to share or drafting a neutral first version of a letter. Assessing evidence, obtaining and organizing relevant records, and checking that a filing or communication supports your position.
Understanding options Preparing questions to ask a lawyer or agency. Applying current state law to your circumstances and advising you about choices, procedure, and possible consequences.
Handling a dispute Helping you organize questions or materials for a conversation with counsel. Preparing you and witnesses, analyzing the other side’s evidence, presenting arguments, examining witnesses, and handling settlement discussions or review and appeal.

These are possible support tasks, not guarantees of AI accuracy. Do not rely on an AI tool to decide whether an injury is legally covered, calculate what you are owed, assess anyone’s credibility, choose a strategy, negotiate a settlement, or meet a filing deadline without competent human supervision.

What AI can help you prepare

Used cautiously, an AI tool can help make your own information easier to review. For example, you might ask it to:

  • Turn your notes into a timeline with dates, appointments, communications, and events.
  • Group questions for a lawyer or agency by subject, such as medical treatment, wages, notices, or next steps.
  • Summarize documents you are permitted to share, then compare the summary with the original before relying on it.
  • Draft a neutral letter for a lawyer to review before you send it.

Keep original records and check every name, date, amount, and quotation in any AI-generated summary or draft. A summary can leave out context or misstate a document; a polished answer is not proof that it is correct. The American Bar Association has described uses of generative AI in legal work such as research, document review, due diligence, and drafting, but those uses do not transfer responsibility away from the lawyer (ABA, “Practical Uses of ChatGPT in Your Legal Practice”).

What an attorney contributes when a claim is disputed

A workers’ compensation attorney can assess your situation under the law and procedure of the relevant state, help identify what evidence is needed, and advise you about the choices available at your stage of the claim. In a contested matter, that work can extend to organizing medical and wage records, preparing you and witnesses to testify, analyzing the opposing evidence, presenting testimony and legal arguments, examining witnesses, and handling settlement discussions or an appeal.

State agency materials illustrate these roles but do not define every lawyer’s engagement nationwide. California’s injured-worker guide describes an applicant attorney’s role as gathering information to support a claim (California Division of Workers’ Compensation guidebook). Arizona’s Industrial Commission says a lawyer can advise on applicable law and procedure, evidence and witnesses, and whether settlement is in the worker’s interest (Industrial Commission of Arizona, ALJ Frequently Asked Questions).

A contested case may involve formal evidence and testimony, not just a form or letter. In Virginia, the Workers’ Compensation Commission describes hearings in which parties may present sworn testimony and evidence and cross-examine witnesses (Virginia Workers’ Compensation Commission, Hearings). Whether your case needs that kind of advocacy depends on its facts, stage, and state rules.

Why state law and the stage of your claim matter

Workers’ compensation is administered under state-specific laws and procedures. Deadlines, forums, representation rules, fees, and available assistance can differ, so do not apply a process described for one state to a claim in another. Read the notice you received and check the official workers’ compensation agency for your state.

For example, Virginia says an injured worker is not required to have an attorney but may choose representation; its guidance also says the employer or carrier must be represented at a claim hearing. The Commission does not provide the worker with legal representation or legal guidance (Virginia Workers’ Compensation Commission, Before the Hearing; Virginia Workers’ Compensation Commission, Injured Workers). These are Virginia-specific statements, not a nationwide rule.

Texas describes a different dispute path: a benefit review conference may be followed by a contested case hearing if the dispute is not resolved, then an appeal. Texas also identifies ombudsman assistance for some unrepresented injured employees (Texas Department of Insurance, Dispute resolution for injured employees; Texas Department of Insurance, About the appeal process). That sequence and Texas appeal rules should not be assumed to apply elsewhere.

Protect sensitive claim and medical information

Medical records, claim forms, employer details, and settlement communications can contain sensitive information. Before entering them into an AI service, review how that tool handles information and consider whether you can get the organizational help you need without including identifying or confidential details. Do not assume that a general-purpose tool provides the protections or confidentiality arrangements appropriate for your situation.

Lawyers also have professional obligations when they use generative AI. The ABA’s Formal Opinion 512, issued July 29, 2024, addresses competence, client information, communication, supervision, candor, meritorious claims, and reasonable fees. The ABA summarizes its core message this way: “To ensure clients are protected, lawyers using generative artificial intelligence tools must fully consider their applicable ethical obligations.” (ABA, “ABA issues first ethics guidance on a lawyer’s use of AI tools”; see also the ABA’s discussion of maintaining confidentiality when lawyers use generative AI.) Whether a particular tool is appropriate depends on its terms, configuration, jurisdiction, client circumstances, and applicable rules.

When to contact a lawyer or state agency

AI may help you prepare for a conversation, but it cannot make that conversation a substitute for legal advice when a consequential decision is at stake. Contact a locally qualified workers’ compensation attorney or the appropriate state agency promptly if you have received a denial, disagree about medical or wage benefits, have a hearing notice, are considering a settlement, or face a possible appeal deadline. The right next step and how urgently you need it depend on your state and case stage.

When speaking with an attorney, ask whether they are licensed in your state, what workers’ compensation matters they handle, what the fee arrangement is and whether any approval is required, what work the representation covers, and what deadlines are coming up. Do not assume an attorney is mandatory for every claim; check the rules and available assistance in your jurisdiction.
