Can the U.S. Government Sell Seized Bitcoin? Forfeiture, Auctions and the Strategic Bitcoin Reserve

The government has historically sold forfeited Bitcoin, but a 2025 executive order directs that qualifying BTC deposited in the Strategic Bitcoin Reserve not be sold, subject to specific exceptions.

Yes, the U.S. government has historically sold Bitcoin after forfeiture, but the rules changed in March 2025. Executive Order 14233 directs that qualifying Bitcoin finally forfeited and deposited in the Strategic Bitcoin Reserve not be sold, subject to stated legal exceptions. A seizure alone does not make Bitcoin government property: forfeiture and the asset’s eventual disposition are separate steps.

Seizure is not the same as forfeiture

When authorities seize or restrain Bitcoin, they secure it while legal proceedings determine the government’s rights. That custody does not by itself transfer final ownership to the government. DOJ policy treats seizure authority and later disposition as separate matters; the rules for a particular asset can depend on the proceedings and applicable law. That distinction matters for victims and owners. The March 2025 Reserve direction applies to qualifying Bitcoin that is finally forfeited and deposited in the Reserve; it does not turn every seized wallet into a reserve holding or remove the need for legal process.

What the March 2025 order says about Bitcoin

Executive Order 14233, signed March 6, 2025, directs the Treasury Department to establish custodial accounts collectively called the Strategic Bitcoin Reserve. The order says it is to be capitalized with Treasury-held Bitcoin finally forfeited through criminal or civil asset forfeiture, or received in satisfaction of a civil money penalty, subject to the order’s conditions and statutory needs.

Its operative direction is that “Government BTC deposited into the Strategic Bitcoin Reserve shall not be sold and shall be maintained as reserve assets of the United States utilized to meet governmental objectives in accordance with applicable law.” The restriction is specific: it concerns Bitcoin deposited into the Reserve, not every seized Bitcoin regardless of its legal status or custody. When can government-held Bitcoin still be sold or otherwise disposed of?

The order is not an unlimited permission to sell, nor an absolute ban covering every possible case. It says agencies shall not sell or otherwise dispose of Government Digital Assets except under the listed authorities and exceptions. Depending on the asset and circumstances, those include:

  • A court order or another legal requirement.
  • Returning assets to identifiable and verifiable crime victims.
  • Using assets or proceeds for law-enforcement operations.
  • Equitable sharing with state and local law-enforcement partners.
  • Releasing assets to satisfy requirements under the statutes named in the order: 31 U.S.C. 9705, 28 U.S.C. 524(c), 18 U.S.C. 981 and 21 U.S.C. 881.

The order also permits Treasury’s lawful stewardship of the separate U.S. Digital Asset Stockpile, which covers qualifying non-Bitcoin assets held by Treasury. The Reserve’s no-sale direction is for deposited Bitcoin; the Stockpile provisions should not be read as making all digital assets subject to the same treatment.

How the government handled forfeited Bitcoin before the order

Before the Reserve order, federal disposition policy generally called for prompt sale of forfeited property when it was not put to official use or transferred. The DOJ Office of Inspector General’s 2022 audit describes the U.S. Marshals Service’s historical use of Bitcoin auctions. The audit noted that approval, advertising to reach suitable buyers, and accumulating enough cryptocurrency to justify an auction could affect how long Bitcoin remained in USMS custody. It also described a planned contractor process intended to liquidate cryptocurrency within five business days after forfeiture; that was a plan reported in the audit, not a confirmed current service standard. The March 2025 executive order changed the direction for qualifying Bitcoin deposited in the Reserve. Historical auctions explain what happened under earlier practice; they do not establish that Reserve Bitcoin can now be sold outside the order’s exceptions.

What happens operationally when cryptocurrency is seized?

Secure custody and disposition depend partly on the type of cryptocurrency. The 2025 DOJ Asset Forfeiture Policy Manual tells prosecutors and agents to check with the U.S. Marshals Service about whether it or a contractor can store and liquidate the particular cryptocurrency. Before custody is transferred, the seizing agency must use a government-controlled self-custodial or cold-storage wallet. Prosecutors must consult the Money Laundering and Asset Recovery Section (MLARS) before seeking an interlocutory sale or pretrial conversion.

These procedures address custody and case management; they do not themselves decide whether an asset is forfeited or whether it qualifies for the Reserve. Those questions turn on the legal status of the asset and the applicable authority.

What is known about Reserve implementation?

The White House’s July 2025 digital-assets report said Treasury had delivered legal and investment considerations for establishing and managing the Reserve and the separate Stockpile, and that Treasury would continue coordinating on next steps. That report provides a dated status update; it does not establish that every agency transfer or custody step was complete. See the July 2025 report.

Accordingly, the order’s policy direction and the operational status of particular holdings are distinct questions. The available July 2025 update does not establish a later completion status.
