The key questions are which kind of plan is involved, whether its governing rules allow the investment, and whether fiduciaries can justify it under their duties to participants. For an individual saver, Bitcoin is not automatically available in a 401(k): the plan must offer an investment option that provides the exposure.
Can pension funds invest in Bitcoin?
There is no single rule for every pension fund. A U.S. private-sector 401(k) covered by ERISA, a state or local government pension system, and an individual participant in a workplace plan are different decision-makers under different frameworks. A fund’s ability to invest also does not mean that its fiduciaries should do so, or that the investment is available to every plan participant.
The available U.S. federal materials do not establish what share of pension assets is invested in Bitcoin, and they are not a current census of pension-fund holdings. It would be misleading to say that pension funds as a class are investing in it or that crypto is already a standard retirement allocation.
What changed for 401(k) plans?
On May 28, 2025, the U.S. Department of Labor (DOL) rescinded its 2022 compliance release cautioning 401(k) fiduciaries about cryptocurrency investments. DOL said the earlier release departed from its historically neutral, principles-based approach. Rescinding that caution did not approve Bitcoin, endorse a particular investment, or waive fiduciary obligations.

DOL’s Compliance Assistance Release No. 2025-01 emphasizes that ERISA fiduciaries must act prudently under the circumstances prevailing at the time. It says the principles apply to digital assets and derivatives, and explains: “The standard of "extreme care" is not found in the Employee Retirement Income Security Act of 1974 (ERISA) and differs from ordinary fiduciary principles thereunder.” The practical effect is not a blanket green light: fiduciaries still have to assess an investment in the context of the plan and its participants.
Why public pensions and private 401(k)s are not the same
ERISA’s Title I fiduciary framework applies to covered private employee benefit plans, including many 401(k) plans. Governmental plans are generally outside that framework and may instead be governed by state or local law and their own governing documents. A conclusion about the federal rules for private plans therefore should not be applied automatically to every public pension system.

The Government Accountability Office’s 2024 discussion of crypto options in 401(k) plans provides context for private plans; it is not a count of public pension allocations or a substitute for the law governing a particular state or local fund. A public fund’s investment authority and process depend on its own legal and governance framework.
How can a pension fund get Bitcoin exposure?
A fund could consider direct Bitcoin ownership or exposure through a Bitcoin exchange-traded product (ETP). The structures are different: direct ownership means the fund must arrange custody of Bitcoin itself, while an ETP gives investors shares in a vehicle that holds Bitcoin. SEC-filed fund disclosures describe a spot Bitcoin ETP’s objective as tracking Bitcoin’s price, less expenses and liabilities.

A spot Bitcoin ETP is a security, but it should not be casually described as a conventional registered mutual fund or ETF. The SEC notes that spot Bitcoin and Ether ETPs are not subject to some Investment Company Act requirements that apply to registered mutual funds and ETFs. Product structure matters, so decision-makers should review the specific vehicle’s filings rather than assume every product carries the same protections or obligations.
What risks should fiduciaries weigh?
Bitcoin exposure can involve high volatility. Depending on the product and route used, SEC materials also identify risks involving valuation, liquidity, technology, cybersecurity, legal and regulatory issues, and tax. A fiduciary’s review should consider how those risks affect the plan’s objectives and participants, not just whether Bitcoin’s price might rise.

- Portfolio fit: Assess the proposed exposure against the plan’s investment policy, diversification, liquidity needs and risk-adjusted objectives.
- Valuation and trading: Examine how the asset or product is valued, how it can be traded, and what liquidity constraints could matter when the fund needs to rebalance or meet obligations.
- Custody and operations: For direct holdings, evaluate private-key control, custody providers and operational safeguards. For an ETP, assess the vehicle’s custody, disclosures and service-provider arrangements.
- Costs and tracking: For an ETP, review expenses and the possibility that its return may differ from Bitcoin’s price. Direct holdings also entail custody and operational arrangements that must be evaluated.
- Legal and regulatory conditions: Consider the rules applicable to the fund and the product, including whether proposed changes have actually become final.
These are due-diligence questions, not evidence that one route is inherently safer or more suitable than the other. Suitability depends on the fund’s legal obligations, policy, circumstances and chosen structure.

On October 1, 2026, the SEC proposed amendments to custody rules for investment advisers and regulated funds. The proposal would permit certain crypto self-custody and custody through state trust companies, subject to conditions, and would update related recordkeeping and disclosure requirements. As of October 8, 2026, these were proposed amendments, not an effective final rule. A proposal should not be treated as settled law or as a determination that a particular pension fund can use a particular custodian.

What should a 401(k) saver do with this information?
For an employee, the first practical question is whether the plan offers an investment option that provides Bitcoin exposure. The DOL’s policy change did not add such an option to any particular plan. If one is available, review the plan’s description of the option, its structure, costs and risks, and consider how it fits with your overall retirement portfolio and ability to tolerate losses. The regulatory developments alone are not a personal recommendation to buy or avoid Bitcoin.
For a plan sponsor or pension fiduciary, the issue is a documented investment-policy and due-diligence decision: identify the governing legal framework, evaluate the specific exposure route and service providers, and determine whether the investment can be justified under the applicable fiduciary standard and the plan’s objectives.
