Not automatically. In a reported August 2026 decision, the GST Appellate Tribunal (GSTAT), Thiruvananthapuram Bench, set aside a demand after finding that the department had not followed the procedure for a discontinued business under Section 93(1)(b) of the CGST Act: it had not notified the legal heir or examined whether the deceased’s estate could meet the liability. The reports also say the tribunal allowed a FY 2017–18 input tax credit (ITC) claim under retrospective Section 16(5). The case does not establish that every GST liability ends at death: the result depends on whether the business continued, the estate and the applicable procedure.
What happened in the GSTAT case
In Vijayan Sahadevan (Deceased) v. The Commissioner of Kerala State GST, Thiruvananthapuram, identified in reports as Appeal No. APL/19/TVP/2026 and Final Order No. 03/TVP/KERALA/2026, the bench reportedly decided the appeal on August 21, 2026. TaxGuru’s October 10, 2026 account and a TaxCorp summary published the same day describe the ruling. The case-specific official order was not retrieved, so the outcome and procedural findings here are attributed to those secondary reports rather than presented as verified quotations from the tribunal.

How Section 93 treats a proprietor’s GST liability after death
Section 93(1) distinguishes between a business that continues after the taxable person’s death and one that is discontinued. The reported ruling treated the business as discontinued. In that situation, Section 93(1)(b) limits a legal representative’s liability to payment from the deceased’s estate, and only to the extent that the estate can meet the charge. That is not the same as saying the heir personally owes the full amount from their own assets.

When the business continues
Under Section 93(1)(a), the provision addresses a different situation: a legal representative or another person continues the business after the proprietor’s death. The estate-based limitation described for a discontinued business should not be assumed to govern a continuing business.
What the tribunal reportedly found in this case
According to TaxGuru’s account, the department neither notified the legal heir under the applicable Section 93 procedure nor examined the deceased’s estate. The bench reportedly set aside the impugned order and proceedings on that basis. The ruling, as reported, turns on the facts and process in this case; it is not a blanket cancellation of tax debts whenever a proprietor dies.

Why the FY 2017–18 ITC claim was reportedly allowed
The reports describe a separate basis for allowing the disputed ITC. Section 16(5), inserted with retrospective effect from July 1, 2017, addresses specified invoices or debit notes for FY 2017–18 through FY 2020–21 where the relevant return was filed by November 30, 2021. The tribunal reportedly applied that provision to the FY 2017–18 claim.
In this case, returns for July 2017 through February 2018 were reportedly filed on July 31, 2018, and the March 2018 return was filed on June 16, 2019. Both dates fall before the November 30, 2021 deadline described in the reports. The date test alone does not establish ITC eligibility: the statutory conditions and the actual invoice, debit-note, return and credit records still matter.

What the ruling did not resolve about interest
The department reportedly argued that Section 16(5) did not affect the separate ₹1,87,350 demand for Section 50(1) interest on delayed discharge of admitted cash tax. TaxGuru’s detailed account says the tribunal did not decide that argument separately after setting aside the proceedings under Section 93. The reported ITC relief should therefore not be read as a ruling that Section 16(5) cancels every interest demand.
