Some compounding of semaglutide and tirzepatide may still be possible under narrow legal conditions, but that is not the same as FDA authorization for mass-marketed copies. Compounded drugs are not FDA-approved, and shortage-related enforcement discretion is not a blanket, continuing permission. The FDA’s April 2026 proposal to exclude three GLP-1 ingredients from a list used by certain outsourcing facilities was a proposal—not, by itself, a final decision. Separately, an appeals court upheld FDA’s tirzepatide shortage determination; it did not approve compounded drugs.
What “keep making” means in this dispute
“Off-brand weight-loss drugs” is an informal label for compounded drugs that may contain ingredients such as semaglutide or tirzepatide. Compounding involves combining, mixing, or altering ingredients to make a drug for a particular patient or situation. It is not the same as manufacturing an FDA-approved generic.
The distinction matters for both safety and cost decisions. FDA-approved drugs undergo agency review for safety, effectiveness, and quality before marketing. Compounded drugs do not undergo that same premarket review. Their legal availability depends on the applicable compounding conditions; it does not follow simply from a patient wanting a cheaper option or a company choosing to make a copy.

FDA’s shortage-related enforcement discretion was time-limited and applied to certain compounders after shortage determinations. Enforcement discretion describes FDA’s approach to enforcement during a specified period; it is not an FDA approval or a permanent exemption from compounding law.

What changed in FDA’s timeline
- October 2, 2024: FDA determined the tirzepatide injection shortage was resolved. After litigation and reevaluation, FDA issued a new resolution determination on December 19, 2024.
- February 21, 2025: FDA determined the semaglutide injection shortage was resolved. FDA said it had confirmed with the manufacturer that supply could meet present and projected national demand, while acknowledging that intermittent local supply-chain disruptions might occur.
- February 6, 2026: FDA said it intended to take steps to restrict active pharmaceutical ingredients intended for mass-marketed, non-FDA-approved compounded GLP-1 drugs. It warned companies not to describe compounded products as generic versions, the same as approved drugs, or clinically proven to produce results for patients.
- April 30, 2026: FDA proposed excluding semaglutide, tirzepatide, and liraglutide from the 503B bulks list. The agency said it had found no clinical need for outsourcing facilities to compound those drugs from bulk substances and invited comments through June 29, 2026, before making a final determination.
- August 27, 2026: The Fifth Circuit affirmed the district court judgment in Outsourcing Facilities v. FDA, a challenge concerning FDA’s tirzepatide shortage determination.
The April proposal and the August court ruling are different actions. The proposal described a possible future change to the 503B bulks list; the court considered whether FDA had adequately explained its tirzepatide shortage determination. Neither should be described as FDA approval of compounded GLP-1 drugs.
What the court ruling does—and does not—settle
The Fifth Circuit concluded that FDA had engaged in reasoned decision-making and reasonably explained its assessment of the evidence on tirzepatide supply and demand. That ruling upheld the judgment in the shortage litigation; it was not a finding that every patient can readily get an approved drug, nor a ruling that all compounding is prohibited.

National supply and an individual patient’s access are not identical. The opinion discussed barriers including price, insurance, pharmacy operations, and supply-chain dynamics. A shortage determination can therefore matter to the legal conditions for compounding without resolving whether a specific patient can afford or obtain an approved prescription.
What the FDA proposal means for 503B facilities
The 503B bulks list concerns whether outsourcing facilities may compound certain drugs from bulk drug substances under the relevant statutory framework. FDA’s April 30 action proposed removing semaglutide, tirzepatide, and liraglutide from that list. The agency said, “When FDA-approved drugs are available, outsourcing facilities cannot lawfully compound using bulk drug substances unless there is a clear clinical need,” according to FDA Commissioner Marty Makary, M.D., M.P.H., in the announcement.

A proposal is not a final determination. FDA invited comments through June 29, 2026, and said it would consider them before deciding. The April announcement alone does not establish a final outcome. Nor does the proposed 503B action answer every question about 503A compounding, which operates under different conditions.
Safety and quality issues patients should understand
FDA has described risks associated with unapproved compounded GLP-1 products, including dosing mistakes when measuring or calculating doses, use beyond labeled doses or titration schedules, improper refrigeration during shipping, and risks from using multidose sterile vials more than 28 days after first use. The agency has also warned about semaglutide salt forms and fraudulent products. These are reasons to discuss a specific product and prescription with a licensed clinician and pharmacist rather than assume a compounded product is interchangeable with an approved one.

FDA reported 990 adverse-event reports associated with compounded semaglutide and more than 730 associated with compounded tirzepatide as of May 31, 2026. Those are reports, not confirmed counts of reactions caused by the drugs: FDA says reports do not always establish causation. The agency also says reports are likely undercounted because certain state-licensed pharmacies are not required to submit them.
Refrigeration and delivery
FDA says injectable GLP-1 drugs require refrigeration as directed in their product package inserts. It advises patients not to use an injectable GLP-1 drug that arrives warm or without sufficient refrigeration because product quality may be affected. A home refrigerator thermometer can show the refrigerator’s temperature; it cannot verify a shipment’s temperature history or make a product safe if its storage conditions are uncertain.

Practical questions to ask before choosing a compounded product
- What exactly is being prescribed? Confirm the active ingredient, formulation, dose, and whether the product is FDA-approved or compounded.
- Why is compounding being used in this case? Ask the prescriber to explain the patient-specific reason and which compounding pathway applies.
- How should it be stored and measured? Get the product-specific refrigeration instructions and clear directions for measuring each dose; do not transfer dosing instructions from a different pen, vial, or formulation.
- What happens if supply or affordability is the obstacle? Ask the clinician and pharmacist about approved-product availability, insurance coverage, and other appropriate treatment options. The court’s recognition of access barriers does not establish that a compounded product is equivalent or suitable for an individual patient.
