A narrow exception may apply when a law requires the employer to provide the meal or canteen service. Hiring an outside caterer does not, by itself, make the credit eligible: the employer must establish that the legal obligation applies and meet the usual conditions for claiming ITC.
Why GST credit on employee meals is generally blocked
Section 17(5)(b)(i) of the Central Goods and Services Tax Act, 2017 (CGST Act) lists food and beverages and outdoor catering among supplies for which input tax credit is generally unavailable. The starting point is therefore restriction, not credit. Read section 17(5) of the CGST Act.
The provision includes an exception where an employer is obliged under a law to provide the relevant goods or services to employees. CBIC Circular 172/04/2022-GST clarifies that this proviso applies to all of section 17(5)(b), including food and outdoor catering. The circular says: “Accordingly, it is clarified that the proviso after sub-clause (iii) of clause (b) of sub-section (5) of section 17 of the CGST Act is applicable to the whole of clause (b) of sub-section (5) of section 17 of the CGST Act.” Read Circular 172/04/2022-GST.
When the legal-obligation exception may apply
The key question is whether a law in force requires this employer to provide this meal or canteen service to these employees. A company’s decision to offer meals, a workplace policy, or a caterer’s invoice does not, on its own, establish that legal obligation. Check the legislation and rules applicable to the particular employer, establishment, workers and service.

Factory canteens: check state rules and establishment facts
Section 46(1) of the Factories Act, 1948 authorises State Governments to make rules requiring a canteen in specified factories where more than 250 workers are ordinarily employed. The central Act’s wording is enabling; it is not a universal, self-executing requirement for every factory above that threshold. Whether a particular employer must provide a canteen depends on applicable state rules, the establishment’s status and worker count, and any relevant exemption. Read section 46 of the Factories Act, 1948.
Outsourcing does not decide eligibility
A third-party caterer can supply a service used to meet an employer’s legal canteen obligation, but outsourcing alone neither creates nor proves eligibility for ITC. Establish the legal requirement first, then connect the particular catering service and invoice to the facility the employer is required to provide.

How to assess an outside-caterer invoice
- Identify the recipient and service. Check which entity is named on the invoice and what the caterer actually supplied: food, restaurant service, outdoor catering, or a bundled service. The vendor’s label alone does not determine the GST treatment.
- Check the premises and rate category. Establish whether the service is supplied at or away from “specified premises” under the applicable rate entry. Compare the invoice with the current notification and CBIC rate schedule; the categories are not interchangeable.
- Test the legal obligation. Determine whether a law applicable to this employer requires this meal or canteen service for these employees. For a factory, check the applicable state factory rules, worker-count records, establishment status and any exemption.
- Substantiate the credit position. If a legal mandate applies, retain the relevant statute or rule, establishment and worker-count records, canteen arrangement, caterer contract, tax invoice and evidence linking the billed service to the required facility. These records help substantiate the position; the cited sources do not prescribe this as a separate statutory checklist.
- Review employee payments separately. If employees pay for meals, receive a subsidy, or receive meals free, analyse the contracts and payment flows. The cited materials do not conclusively resolve every pattern of employee recovery or onward supply.
If you cannot establish an applicable legal obligation, use the section 17(5)(b)(i) restriction as the starting point and obtain qualified GST advice before claiming credit. Do not assume a company policy, employment contract, collective arrangement or general welfare practice necessarily amounts to an obligation “under any law.”
Supplier GST rate and employer ITC are separate questions
The caterer’s output tax rate does not decide whether the employer can claim ITC. CBIC’s rate schedule lists an outdoor-catering category at premises other than specified premises at 2.5% central tax plus 2.5% state tax (or the corresponding integrated-tax treatment), subject to the supplier not taking input tax credit on inputs used for that service. The schedule separately treats specified-premises cases. This is a rate entry, not a determination of the recipient employer’s credit eligibility; verify the current notification, service classification and premises facts against the invoice. Which canteen guidance should not be applied broadly
CBIC’s Sectoral FAQ includes a response stating that tax paid in respect of canteen service providers is unavailable as credit. Read that general response alongside the later Circular 172/04/2022-GST, which expressly confirms that the legal-obligation proviso applies throughout section 17(5)(b). Read the CBIC Sectoral FAQ.
