California Attorney General Rob Bonta sent xAI a cease-and-desist letter on January 16, 2026, demanding that it stop the creation and distribution of nonconsensual sexual images generated or enabled by Grok, including images depicting or appearing to depict minors in sexual situations. The letter followed a state investigation announced two days earlier. It was an enforcement demand—not a court order or a final ruling that xAI had violated the law.
What California demanded
The letter demanded that xAI immediately stop conduct involving nonconsensual intimate imagery and sexual images of minors. It covered activity through Grok’s website and app, as well as Grok’s integration with X. The state also asked xAI to confirm within five days what remedial steps it had taken. The letter and the attorney general’s announcement describe demands to stop:
- Creating, disclosing, or publicizing sexually explicit material portraying an identifiable person who did not consent to its creation or disclosure.
- Facilitating or helping others create, disclose, or publish that material.
- Creating or helping create, distribute, or publish images depicting or appearing to depict anyone under 18 engaging in or simulating sexual conduct.
The five-day request was for confirmation of steps taken; it was not itself a court-imposed deadline backed by an injunction.
Why Grok came under scrutiny
On January 14, the California Department of Justice announced an investigation into reports that people were using Grok to alter ordinary photographs of women and children into suggestive or explicit images without their consent. The department pointed to Grok’s image-generation and editing features, including a mode it called “spicy mode,” and said reports included sexualized images of children or apparent children. These are allegations cited by the attorney general, not findings that xAI employees personally created every image or that every image in circulation came from Grok. Grok is an AI model developed by xAI and available through its website and app, as well as through X. The letter was addressed to Elon Musk as xAI’s CEO and sought action across those access points. That product relationship does not make users, xAI, and X interchangeable actors: the legal questions can differ depending on who generated, facilitated, posted, or distributed particular material.
Which laws did the attorney general cite?
California’s announcement cited laws addressing several different kinds of conduct. The citations set out the state’s potential legal theories; they do not establish that a court found xAI liable under any of them.

The analysis can turn on details such as whether a real, identifiable person is depicted, whether the subject is an adult or a minor, whether an image was kept private or shared, and whether a company generated it, enabled its creation, or distributed it. The state’s announcement lists the cited provisions; California’s statutory text is available through the California Legislative Information website.
A letter is not a court ruling
A cease-and-desist letter communicates an enforcement demand from the attorney general’s office. It is not a judicial injunction, and sending it does not by itself prove a violation, impose a penalty, or shut down a service. California said the alleged conduct appeared to implicate state law; xAI’s ultimate legal responsibility would require a separate resolution, such as an accepted compliance outcome, settlement, or court decision.

A California Senate committee analysis published in June 2026 said the official action it reviewed had not gone beyond the cease-and-desist letter. That statement is limited to the analysis and its date; it does not establish the status of the matter after June. Read the committee analysis.
What is known about xAI’s response?
The Associated Press reported that Grok and X would restrict image editing of real people in revealing clothing where the conduct was illegal, and that image-editing limits were introduced on X. Those reported product restrictions are distinct from the attorney general’s broader demands. What could happen next?
Depending on what the state and company do, possible paths include voluntary changes, further investigative steps, civil enforcement, litigation, or referrals for appropriate criminal review. These are possible routes, not announced outcomes. A product restriction alone would not show that California accepted the company’s response; a formal closure notice, settlement, court filing, or later enforcement announcement would be needed to establish a different legal status.
California’s action also followed a broader state effort to address nonconsensual AI-generated sexual imagery. In August 2025, Bonta joined other attorneys general in asking technology, search, and payment companies to curb the creation and spread of nonconsensual deepfake pornography, and separately warned AI companies about child safety. If an intimate image affects you
California’s January 14 announcement directs people who believe they were affected by xAI-related conduct to submit a complaint to the attorney general. Filing a complaint does not guarantee an investigation, removal, compensation, or prosecution. Consider these practical steps:
- Keep URLs, account names, dates, screenshots, and platform notices that document the post or report. Store evidence securely.
- Report the content through the platform’s current channels for abuse and nonconsensual intimate imagery. Avoid sharing or reposting exploitative material; never redistribute images involving apparent minors.
- Consider contacting local law enforcement if the situation involves threats, extortion, stalking, or images involving minors.
- For advice about possible civil remedies, consult a qualified attorney familiar with California privacy, harassment, and intimate-image law.
- Avoid contacting an alleged perpetrator directly if doing so could increase threats or harassment.
Status as of the sources cited here: The January 16, 2026 cease-and-desist letter is confirmed. A June 2026 Senate analysis said official action had not advanced beyond it; the sources cited here do not establish a later court judgment, penalty, settlement, or closure.
