The five rights below group related provisions for practical use; they are not five isolated sections. RERA is Act 16 of 2016, enacted on 25 March 2016 and brought into force on 1 May 2016. Its purpose includes protecting consumers and providing a mechanism for dispute redressal.
RERA is implemented through state and union-territory authorities and rules. Check the regulator where your project is located, the project’s registration record and your agreement for sale before relying on any remedy.

1. What documents and project updates can I ask for?
Section 19 gives an allottee access to information needed to monitor the project and the promised home. This includes the sanctioned plans and specifications relevant to the allotment, the stage-wise schedule of completion, essential services and the promoter’s obligations for timely possession. Ministry of Housing and Urban Affairs FAQ material also describes project disclosures and updates made through the regulator’s website.

Save the allotment letter, agreement for sale, payment receipts, brochures, approved-plan references and dated emails or messages. If a promised date or specification changes, ask for the explanation in writing rather than relying on a phone call.

2. Can a builder take more than 10% before signing an agreement for sale?
Generally, no. Section 13 bars a promoter from accepting more than 10% of the cost of an apartment, plot or building as an advance or application fee unless a written agreement for sale has first been executed with the allottee. The Ministry’s 2025 FAQ states the same one-tenth threshold.
This is a statutory ceiling on pre-agreement collection, not a promise that every booking payment is refundable or that you can cancel without considering the contract. Check whether the amount is calculated against the stated apartment or plot cost, obtain a receipt for every payment and read the agreement’s payment schedule, cancellation and possession clauses. State rules and the project’s registered documents may add requirements.

3. What if I find construction defects after possession?
Section 14(3) covers structural defects and other specified defects in workmanship, quality or services that are reported to the promoter within five years from the date possession is handed over. The promoter must rectify a covered defect without further charge within 30 days. If the promoter fails to do so, the allottee may be entitled to compensation under the Act.

Describe the problem precisely, identify when it appeared and attach dated photographs, inspection reports or maintenance records. Send a written notice through a channel that shows delivery and keep the reply. A paid inspection can help document a suspected defect, but RERA does not make one a condition of the promoter’s duty.

4. What can I do if my builder delays possession?
Section 18 creates different statutory routes depending on whether you still want the property. The agreement, relevant dates, permitted exceptions and state rules affect the claim, so no result is automatic.

Before choosing, assemble the agreement, allotment letter, receipts, promised possession date, project updates and all delay notices. A buyer who stays in the project does not automatically lose all rights, but must continue to follow valid payment and possession obligations. Conversely, withdrawing is not an unconditional cancellation right; obtain advice on the contract and facts if the sums are substantial.

5. Where do I file a RERA complaint?
Start with the RERA authority for the state or union territory in which the project is situated. The Ministry’s implementation material provides links to territorial regulators, but portals, forms, fees, filing requirements and deadlines can change. Verify the current instructions on the relevant authority’s official website and use the project registration number when available.

Prepare a chronological file: agreement and allotment documents, payment proof, promised dates, project-disclosure screenshots, correspondence, notices and evidence of defects or delay. State the remedy you seek—such as information, rectification, possession-related relief, refund, interest or compensation—and attach the clause or statutory provision supporting it. If the authority issues an order, the Act provides an appeal route through the applicable appellate forum; check the current jurisdictional procedure and time limit before filing.

A practical checklist before you pay or complain
- Confirm the project’s registration and the responsible state or union-territory regulator.
- Read the agreement for sale alongside the registered project details; note the possession date, specifications, payment schedule and remedies.
- Keep every receipt and communication in a dated folder.
- Do not pay more than the statutory 10% pre-agreement threshold without checking the legal and contractual basis.
- For a defect, send a detailed written notice within five years of handover and preserve delivery proof.
- For delay, decide deliberately whether you seek exit or continued possession, then check section 18 and current local rules.
- Use the regulator’s current portal and instructions; consider a local property lawyer or consumer-rights adviser for a live dispute.
These protections work alongside, not instead of, the allottee’s duties to make payments and take possession in accordance with RERA and the agreement. Because implementation is territorial, confirm the rule, form and filing route that apply to your project before acting.
Frequently Asked Questions
Does RERA guarantee that a delayed project will pay me immediately?
No. Section 18 provides statutory claims, but the applicable dates, agreement terms, exceptions, state rules and the authority’s process determine how a claim is decided and enforced.
Is every crack or leak covered by the five-year defect protection?
No. Section 14(3) concerns structural defects and specified defects in workmanship, quality or services reported within five years of possession. Ordinary wear, purely cosmetic issues or later damage may fall outside it.
