Bombay High Court Pension Ruling: What Is Known About the Rule 49(2)(b) 50% Deduction Claim

The Bombay pension ruling described in the title remains unverified. Here is what Rule 49 generally says about short service and when Rule 38 may provide a limited exception.

The title describes a Bombay High Court order granting a retired Income Tax Commissioner full pension and retiral benefits despite less than 10 years of qualifying service, with a 50% deduction under Rule 49(2)(b) said not to apply to Petitioner W. The decision itself could not be identified, so its facts, reasoning and directions cannot be confirmed. The general rules do show why the retirement ground matters: short service ordinarily leads to service gratuity, while a limited exception applies to eligible invalid-pension cases under Rule 38.

What can be confirmed about the Bombay High Court claim?

The decision described in the title has not been identified in the available legal sources. Its case number, date, Petitioner W’s service history, the meaning of the stated “50% deduction,” the court’s reasoning and the operative relief therefore remain unverified. It would be unsafe to say that the High Court relied on Rule 38, or to treat the title’s account as the court’s confirmed holding.

That uncertainty matters because the ordinary short-service rule and the invalid-pension exception apply on different legal bases. The cited authorities explain those rules, but neither establishes what happened in Petitioner W’s case.

What does Rule 49 generally provide for less than 10 years of qualifying service?

The Supreme Court’s discussion in P. Bandopadhya v. Union of India describes the ordinary Rule 49 framework: ten years of qualifying service is required for pension, while service shorter than that attracts service gratuity under Rule 49(1). The case concerned government employees who opted for absorption into VSNL and were deemed retired from government service on absorption; its holding is specific to those circumstances and does not establish the basis of the unidentified Bombay ruling. For a claim involving less than 10 years’ service, the distinction between pension and gratuity is central. The relevant question is not simply how many years the employee served, but also the legal ground on which the employee retired and whether the service counted as qualifying service under the applicable rules.

When can the 10-year condition not apply?

A limited exception concerns eligible government servants who retire on invalid pension under Rule 38 because of bodily or mental infirmity. A Department of Pension and Pensioners’ Welfare office memorandum dated 12 February 2019, reproduced in a Delhi High Court judgment, states that “the condition of qualifying service of ten years for grant of pension under Rule 49(2) of the CCS (Pension) Rules, 1972 shall not be applicable in the case of a Government servant retiring on Invalid Pension on account of any bodily or mental infirmity, under Rule 38.” Read the Delhi High Court judgment discussing the clarification.

This exception is conditional and limited to qualifying Rule 38 cases. It does not mean that every employee with less than 10 years of qualifying service is entitled to pension. The 2019 clarification also describes invalid pension as 50% of emoluments or average emoluments, whichever is more beneficial, subject to a minimum of ₹9,000 and a maximum of ₹1,25,000 per month. Those figures belong to the clarification and are not established as amounts awarded to Petitioner W.

What would be needed to explain Petitioner W’s outcome?

The Bombay High Court judgment is necessary to establish why the title says the 50% deduction did not apply and what “full pension and retiral benefits” meant in the case. In particular, the decision would need to clarify:

  • how the court calculated Petitioner W’s qualifying service;
  • the retirement ground and whether Rule 38 medical and other eligibility conditions were relevant;
  • whether the claim concerned pension, service gratuity, or both; and
  • the actual relief ordered and how the asserted 50% deduction related to it.

Until that decision is available, the general rules can explain the legal distinction, but they cannot establish which point determined the Bombay case.
