Audi and Volkswagen owners may qualify for limited relief under the approved Kimball v. Volkswagen Group of America settlement, but it is specifically a turbocharger and wastegate settlement—not a payout for every EA888 engine problem. Eligibility depends on the vehicle’s VIN, generation, repair history and, for past repairs, a claim filed by November 29, 2025. The settlement administrator reports that claim determination notices were mailed June 11, 2026; contact the administrator to check an individual claim.
What the Audi-VW EA888 settlement covers
The case, Kimball v. Volkswagen Group of America, Inc., Civil Action No. 2:22-cv-04163-MAH, concerned allegations that certain Volkswagen and Audi turbochargers could fail prematurely. Volkswagen Group of America denied that the turbochargers were defective or that it violated warranties or laws. The settlement resolves the claims without a finding on their merits and without an admission of liability. It does not create a general remedy for every EA888 engine issue. The official settlement site describes the case and benefits; the final order and judgment supplies the court’s approval status.
The court granted final approval after a fairness hearing on December 4, 2025. The settlement website also contains older boilerplate saying approval is pending, which conflicts with the filed final order. The order—not that stale text—confirms that the settlement was finally approved.
How to check whether your vehicle is included
The class is limited to people or entities who purchased or leased qualifying vehicles distributed by Volkswagen Group of America in the United States or Puerto Rico. The model-year examples below are only a starting point: the settlement identifies eligible vehicles by VIN, and not every vehicle with a listed badge and year qualifies. Use the official VIN lookup or contact the settlement administrator for an eligibility determination. The settlement agreement and official FAQ provide the class terms and claim details.

What benefits the settlement provides
Generation 3 warranty extension
For a VIN-confirmed qualifying Generation 3 vehicle, the settlement provides coverage for 50% of the cost of repair or replacement, including parts and labor, at an authorized Volkswagen or Audi dealer when turbocharger failure is caused by corrosion of the wastegate fork-head and/or link pin. Coverage ends at 8.5 years or 85,000 miles from the vehicle’s in-service date, whichever comes first. A special timing provision applies to vehicles already older than 8.5 years as of September 15, 2025. Original warranty terms and exclusions apply; excluded causes include abuse, misuse, modification, inadequate maintenance, collision, vandalism, impact and other outside damage. Consult the settlement agreement for the precise terms.
Reimbursement for one qualifying past repair
The agreement allows reimbursement for one qualifying repair paid for before September 15, 2025, and performed within 8.5 years or 85,000 miles of the vehicle’s in-service date. The eligible failure cause depends on generation: Generation 1 and 2 repairs must relate to wear at the wastegate link plate and pin; Generation 3 repairs must relate to fork-head and/or link-pin corrosion.

- If the repair paperwork identifies the qualifying cause, the reimbursement rate is 50% of the eligible expense.
- If the paperwork does not identify the cause, a 40% rate may be available with the required oil-maintenance records.
- For a non-dealer repair, the percentage applies to no more than $3,850 of invoice expense.
- Claimants must provide an invoice and proof of payment. Depending on the circumstances, a declaration or evidence that an authorized dealer declined or could not perform the repair under warranty may also be required.
These are partial reimbursement terms, not a promise to repay the full repair bill. See the official FAQ for documentation requirements.
Are claims still open, and how can I check a decision?
No. The deadline to submit a reimbursement claim was November 29, 2025. The settlement website reports that determination notices were mailed to all claimants on June 11, 2026, but that mailing date does not establish the outcome of any particular claim. What approval does—and does not—mean
Final approval makes the settlement terms binding as provided in the order; it does not establish that the alleged defect existed or that Volkswagen or Audi admitted fault. The court’s final-approval materials describe approximately 3,900,000 settlement class members, 16 purported objections and approximately 265 timely, valid requests for exclusion. Those figures describe the settlement process, not the number of defective vehicles, failures or successful claims.
