There is no settled nationwide yes-or-no answer. As of October 9, 2026, sports event contracts offered on CFTC-registered markets sit at the intersection of federal commodities regulation and state gambling laws. The federal regulator claims authority over qualifying contracts on those markets, while some states argue that the contracts are unlawful sports betting. Litigation over those competing positions remains active, and the law may depend on the contract, platform, state, and current court orders.
Why the answer depends on more than the words “prediction market”
A platform’s label does not determine whether a sports contract is lawful. The relevant questions include what the contract legally is, whether its venue is registered with the Commodity Futures Trading Commission (CFTC), and how the state where a customer is located treats the activity. A contract offered as a financial product can still face a state challenge that it amounts to sports betting; the federal and state positions have not been reconciled nationwide.

The CFTC describes event contracts as derivative contracts, typically with a binary payoff, based on the outcome of an event. Its March 2026 notice says such contracts may qualify as swaps or futures under the Commodity Exchange Act (CEA). That classification is a starting point for the federal framework, not a blanket ruling that every sports contract is lawful. CFTC advance notice, March 16, 2026.

What federal regulation establishes—and what it does not
Registration and CFTC oversight
Under the CFTC’s March 2026 explanation, a prediction market offering swaps or futures to the general public must register as a designated contract market (DCM), which is subject to CFTC oversight under the CEA. The notice also says that some event contracts may fall under Securities and Exchange Commission jurisdiction depending on their legal classification. A platform’s registration therefore matters, but registration alone does not establish that every listed contract has been finally approved or is immune from other legal challenges. Authority to prohibit certain event contracts
The CFTC says CEA section 5c(c)(5)(C) gives it authority to prohibit particular event contracts if it determines they are contrary to the public interest. That authority is not a finding that all sports contracts are prohibited—or that all have been approved. The Commission’s March 2026 notice sought public comment on how existing law and regulatory principles apply to prediction markets, including sporting events; it was an advance notice, not a final rule. CFTC advance notice.
The proposed event-contract rule was withdrawn
The CFTC withdrew its 2024 event-contract rule proposal effective February 4, 2026, and said it did not intend to issue final rules from that proposal. The agency cited litigation and unresolved questions involving CFTC authority, state-law preemption, the CEA’s definitions, and how “gaming” applies to sports-related contracts. The withdrawn proposal is not a final rule and cannot be treated as a definitive nationwide resolution. CFTC withdrawal notice, February 6, 2026.

Staff guidance is not a court ruling
On March 12, 2026, the CFTC’s Division of Market Oversight issued a staff advisory reminding DCMs of their obligations under the CEA and CFTC regulations, including DCM Core Principle 3 and product-submission requirements. The agency announcement says the advisory also addressed considerations specific to sports-related event contracts. It is staff guidance about compliance, not a final adjudication of whether a particular contract is lawful in every state. CFTC staff advisory announcement.
The CFTC’s March notice reported that approximately 1,600 event contracts were certified for listing in 2025. That figure covers event contracts across multiple subjects, not sports contracts alone, and does not measure their legality or state-by-state availability. CFTC advance notice.

Why states and the CFTC disagree
Some states have treated sports event contracts as betting subject to state gaming laws. The CFTC, in turn, argues that federal law gives it exclusive authority over qualifying contracts on CFTC-registered markets and has challenged state enforcement efforts. Those are competing legal positions; neither a regulator’s argument nor a lawsuit filing is itself a final ruling on the merits.
In a June 12, 2026 release, the CFTC said New Mexico had sued Kalshi in state court, alleging unlawful online sports betting, and that the CFTC had then sued New Mexico seeking declaratory and injunctive relief. The release documents the parties’ filings and the CFTC’s position; it does not establish the final outcome of the cases or settle the issue for the country. CFTC release on New Mexico.

A California Nations Indian Gaming Association filing with the CFTC argued that sports event contracts are prohibited gaming and cited court decisions in support. That is an advocacy submission, not a CFTC determination or a nationwide court disposition. California Nations Indian Gaming Association comment, April 27, 2026.

Calling an offering a “contract” does not settle its legal status. The distinction readers should examine is the legal and regulatory framework actually applied to the product and venue, not simply the label used in an app.

| Question | Sports event contract on a prediction market | Conventional sportsbook wager |
|---|---|---|
| Regulatory framework | May fall under the CEA if it is a swap or future offered through a CFTC-registered DCM; classification and state challenges matter. | Typically considered under the applicable state’s sports-betting and licensing framework. |
| Who asserts authority? | The CFTC claims authority over qualifying contracts on registered markets; some states assert their gambling laws apply. | State regulators oversee sportsbooks under the applicable state framework. |
| What can change the answer? | Contract terms, venue registration, customer location, and operative court orders or rulings. | State law, the operator’s state authorization, and any applicable court orders. |
This is a framework comparison, not a state-by-state determination. The CFTC’s own account of the withdrawn proposal confirms that preemption and the meaning of “gaming” for sports-related contracts remain contested issues. CFTC withdrawal notice.
Quick Recap
How to check the status where you live
- Identify the exact contract and platform. Check the product’s terms and the platform’s regulatory disclosures. Do not assume that two products described as sports prediction markets have the same legal classification.
- Verify the venue’s regulatory status. For a product said to be a swap or future offered to the public, check whether the venue is a CFTC-registered DCM and review the product’s applicable disclosures. Registration does not by itself answer every state-law question.
- Check your state’s current position. Consult the state gaming regulator’s notices, enforcement actions, and official guidance. A general statement about federal oversight does not tell you whether your state has taken action or whether a court order affects access there.
- Check current court orders and appeals. Look for operative orders in the relevant state and federal cases, not just complaints or press releases. Filings describe what parties are asking courts to decide; they do not prove that a court granted the requested relief.
- Recheck before relying on an older answer. Litigation and agency actions can change the practical status. The sources available through October 9, 2026 do not establish every state’s position, every operative injunction, or the disposition of every appeal.
What can be said with confidence as of October 9, 2026
- “Prediction market” is not a legal conclusion; contract classification and venue status matter.
- The CFTC says certain public event-contract markets fall within the CEA framework and require DCM registration, while asserting authority over qualifying contracts.
- The federal regulatory details remain in motion: the CFTC withdrew its 2024 proposal and issued a 2026 advance notice and staff advisory, neither of which resolves the state-federal dispute nationwide.
- States have challenged at least some sports event contracts as unlawful betting, and the CFTC has disputed state enforcement on federal-authority grounds.
- The available official sources do not support saying that sports prediction contracts are legal in all 50 states, illegal nationwide, or settled by the courts.
