Are Prediction Markets Legal Where You Live? How to Check Your State’s Rules

The CFTC says federally regulated prediction markets can operate nationwide, while states challenge federal authority over some event contracts. Here’s how to check the rules for your location, platform, and contract.

There is no settled, reliable yes-or-no answer for every U.S. location, platform, and prediction-market contract. The Commodity Futures Trading Commission (CFTC) says federally regulated prediction markets can operate in all 50 states, but states dispute federal authority over some products—especially sports-related contracts—and litigation is ongoing. Check the law and official notices for your location, the operator’s regulatory status, and the specific contract before relying on a broad claim.

Why the answer depends on where you are and what you trade

Prediction markets offer event contracts whose value or payout depends on an event’s outcome. The legal question is not simply whether “prediction markets” are legal. It can turn on your jurisdiction, the platform and exchange offering the contract, and the contract’s subject—such as sports, elections, or another event.

In the United States, the central dispute is about the boundary between federal commodities regulation and state authority over gambling and consumer protection. The CFTC says federal law gives it exclusive authority over event contracts offered by its registrants. State officials argue that at least some products, particularly sports-related contracts, fall within state authority. Those are competing legal positions; they do not amount to a settled nationwide rule for every product and state.

What the federal framework does—and does not—settle

The CFTC’s position

The CFTC explains that prediction markets trade event contracts and says federally regulated markets can operate in all 50 states. That is the agency’s stated position, not a final resolution of every state-law challenge. A platform’s claim that it is federally regulated should therefore be checked against official CFTC information, and should not be treated as conclusive proof that every contract is lawful in every state.

On March 12, 2026, CFTC staff issued an advisory reminding designated contract markets of obligations under the Commodity Exchange Act and Commission regulations. The advisory is a reminder of regulatory duties, not a state-by-state legality ruling.

Contract listing and public-interest review

Federal rules provide routes for a designated contract market to list derivatives, including self-certification or voluntary prior approval. They also impose monitoring and anti-manipulation obligations. Under section 5c(c)(5)(C) of the Commodity Exchange Act, the CFTC can prohibit specified event contracts if it determines that they are contrary to the public interest. Federal oversight therefore does not mean that every possible event contract is automatically permitted.

A 2026 Federal Register notice recounts that the CFTC withdrew its 2024 proposed event-contract rules in February 2026 and sought information about significant issues and possible future agency action. Proposed interpretations or future action should not be mistaken for a final rule currently resolving the state-federal dispute.

What the litigation means

On April 9, 2026, the CFTC announced that it had filed complaints against Arizona, Connecticut, and Illinois. It sought declarations that federal law gives it exclusive authority and injunctions against state enforcement. The announcement describes the CFTC’s claims and requested relief; a complaint is not a court judgment that state law is preempted.

The state-side position is also active. The Maryland Attorney General’s office reported that a coalition of 41 attorneys general urged the CFTC to recognize state authority over sports-related event contracts. That count describes the coalition’s advocacy position, not a judicial ruling.

State activity is changing, and a bill is not the same as a ban

A June 23, 2026 Pew Research Center snapshot reported that at least 16 states had attempted to regulate prediction markets during 2026. It described at least 12 states with related bills pending and at least four where such bills had failed, as of that reporting snapshot. “Attempted to regulate” does not mean that 16 states enacted bans.

Pew also summarized legislation in Kentucky and Tennessee and reported executive orders in Maryland and New York addressing state employees’ use of prediction markets. Its snapshot covers legislative activity through June 2026 and says its map does not account for executive actions; it also notes that states may have additional pending or failed bills. Use it as a dated overview, not as a current legal directory or a substitute for the enacted text and any later action.

How to check the rules for your location

  1. Pin down your jurisdiction. Identify your country, state or equivalent, and locality. Do not infer your rule from a neighboring state. The U.S. developments summarized here do not establish the law for U.S. territories, tribal jurisdictions, or any country outside the United States.
  2. Identify the exact platform and exchange. Read the platform’s disclosures to determine which entity offers the relevant market and whether it says the exchange is a CFTC-registered designated contract market. Then verify that claim through official CFTC materials. Registration is relevant, but it does not by itself settle a contested state-law question.
  3. Read the exact contract. Check whether it concerns sports, elections, or another event, and review its rules, settlement criteria, and any location restrictions. Different contract categories may raise different legal issues.
  4. Check state primary sources. Search the state gaming regulator and attorney general for current notices, enforcement actions, or guidance. For legislation, look for the enacted statute and its effective date in official state sources; a proposal, failed bill, or news headline is not the same as current law.
  5. Check court status, not just lawsuit announcements. Look for official court opinions and orders in the relevant case. Distinguish a pending complaint from a temporary order, an injunction, and a final judgment; each has a different legal effect.
  6. Recheck before opening an account or trading. Court orders, agency positions, state laws, and platform access policies can change. Confirm the status again close to the time you plan to act.

How to interpret what you find

  • “The CFTC says it is available nationwide” reports the agency’s position about federally regulated markets; it is not a guarantee that every state accepts that view for every contract.
  • “A state filed suit or issued a notice” shows state action or a state position, not necessarily a final ruling on the merits.
  • “A platform is CFTC-registered” is a regulatory-status claim worth verifying, but it does not answer every question about a particular contract or a state’s enforcement position.
  • “A bill would ban or regulate it” is not enough to establish the current rule. Check whether it passed, was signed, took effect, or was later blocked or changed.
  • “A court has acted” still requires attention to the order’s scope, parties, and duration. A limited or temporary order should not be generalized to every operator, contract, or state.

What a general guide cannot establish

The available national picture does not resolve the law in a particular reader’s location, provide a complete current directory of all 50 states, or determine the status of a specific platform or contract. It also does not establish rules for territories, tribal jurisdictions, or other countries. If those details matter to a decision, consult current official sources for the relevant jurisdiction or a qualified lawyer.
