Which states have legal online casinos?
State lists differ because they describe different dates and do not classify Maine and West Virginia the same way. The American Gaming Association’s State of the States 2025 describes the market at the close of 2024. It identifies seven states with full online casino games and Nevada for online poker only. A July 30, 2026 Wyoming Legislative Service Office comparison memo lists eight states where it says iGaming is legal; it identifies Nevada as poker-only and Maine as tribal-only. The memo does not include West Virginia.
These snapshots are useful for orientation, not a substitute for checking current law and regulator listings. The 2026 memo does not resolve the discrepancy with the older AGA report, and Maine’s authorization is distinct from an operational launch.

What counts as a state-authorized online casino?
A state-authorized platform is an operator and service permitted under the applicable state’s online-gaming law and regulator’s licensing rules. A familiar national brand name, a casino’s physical presence in your state, or a sports-betting license is not by itself evidence that its real-money casino games are legal there. Online poker may also be regulated separately from other casino games.
- Find the official gaming regulator for the state where you are physically located.
- Use that regulator’s current licensee or approved-platform directory to check the exact operator and, where listed, the platform or app. Do not rely only on a brand’s advertising or a search result.
- Confirm that the directory covers the kind of play you want—such as casino games rather than sports betting or poker—and that the platform is currently available in your state.
- Before funding an account, review its identity checks, account terms, withdrawal rules, and responsible-gaming controls.
The source snapshots do not provide a current brand-by-brand operator roster. Maine’s enacted framework specifically contemplates physical-location, identity, and age verification; requirements and checks elsewhere depend on the state. A website that accepts a payment or loads games is not proof that it is licensed where you are.

Why Maine’s authorization is not the same as a platform launch
Maine’s LD 1164, enacted as Public Law Chapter 538 on January 11, 2026, authorizes covered Internet gaming subject to state licensing and rules. Eligible operators are limited to federally recognized Indian nations, tribes, or bands in Maine, and the framework gives the Wabanaki tribes an exclusive role. The statute covers approved online games of chance, requires a license for covered activity, and bars wagers from people under 21.
The law directs rules to address patron protections and responsible-gaming information, age and identity checks, physical-location verification, self-restriction, internal controls, house rules, and advertising. The Gambling Control Unit’s rulemaking page showed a third publication dated September 30, 2026, with comments due October 30, 2026. Those were proposed rules at that time. The available status information establishes authorization and rulemaking, not that a licensed consumer platform had launched.

When Governor Janet T. Mills announced the law on January 8, 2026, she said: “I considered this bill carefully, and while I have concerns about the impacts of gambling on public health, I believe that this new form of gambling should be regulated, and I am confident that Maine’s Gambling Control Unit will develop responsible rules and standards to hold providers of this new form of gambling accountable while ensuring that Maine’s tribes benefit from its operations.”

- Self-exclusion: Check whether the state offers a regulator-run program, whether it covers online play, and how to enroll. Participation and scope vary by jurisdiction.
- Spending and time controls: Look for deposit, loss, wager, or session-time limits, along with cooling-off options. The available controls differ by state and operator.
- Account and withdrawal terms: Read the rules for identity verification, withdrawals, account closure, and any restrictions that could affect access to funds.
- Age and location checks: Expect checks where required. Never try to bypass a platform’s location or identity controls.
- Personal boundaries: Decide in advance how much time and money you can afford to spend, and stop when you reach either limit.
The AGA’s Responsible Gaming Regulations and Statutes Guide, published July 8, 2025, reports coverage as of January 31, 2025, across 38 covered commercial-gaming jurisdictions and the District of Columbia. In that defined group, 38 of 38 required self-exclusion programs, 28 of 38 required responsible-gaming plans, 29 jurisdictions with account-based online gaming, sports betting, or casino digital wallets required some patron-limit mechanism, and 17 restricted some financial instruments. These figures are not a current 2026 count of all states, and the guide excludes rules for sovereign tribal gaming lands where tribal regulators have authority.

What does not prove online casino play is legal?
- Sports betting is available: A state may permit online sports wagering without authorizing online casino games.
- There is a casino nearby: A land-based casino license does not automatically cover internet play.
- Poker is available: Nevada illustrates that online poker can be authorized without a full online casino menu.
- A site calls itself a casino: Branding, a nationwide reputation, or a successful deposit does not establish state authorization.
- A sweepstakes game is accessible: Sweepstakes products are a different category from state-licensed real-money online casino gaming; their availability does not establish that licensed casino play is legal in your state.
