Are Forgiven Student Loans Taxable? Federal and State Rules Explained

Student-loan tax treatment depends on the forgiveness program, the relevant date, federal exceptions, and your state’s rules. Here’s how to check each.

Sometimes. For federal income tax, qualifying student-loan discharges tied to a repayment period ending from January 1, 2021, through December 31, 2025, generally qualify for a temporary exclusion. An eligible income-driven repayment discharge tied to a period ending on or after January 1, 2026, is generally taxable unless another exception applies. State tax treatment is separate and depends on the state and tax year.

Start with the discharge date, program, and type of tax

Forgiveness is not one tax category. To work out whether canceled student debt may be taxable, identify three things first: the legal basis or program for the discharge, the relevant date, and whether you mean federal or state income tax. Borrower-specific exclusions can also change the federal result.

For income-driven repayment (IDR), Federal Student Aid’s FAQ asks: “Will I be taxed if my student loans are discharged under an income-driven repayment (IDR) plan?” Its answer depends on when the repayment period ends. For this purpose, the agency’s table uses the date of the last payment in that period—not simply the date you received a notice, filed a return, or first learned that a balance would be forgiven.

Tax reporting may involve a different date question. IRS guidance says reportable canceled debt is reported for the year the cancellation occurred. Keep the program’s qualifying repayment-period date and the actual cancellation year distinct, and review your discharge records and any tax form to establish the facts for your case.

Federal treatment by discharge type and timing

Discharge basis or timing Federal income-tax treatment What to verify
Eligible IDR discharge tied to a repayment period ending January 1, 2021, through December 31, 2025 Covered by the temporary federal exclusion for the specified period. Confirm that the discharge qualifies and that the repayment period ended within these dates.
Eligible IDR discharge tied to a repayment period ending on or after January 1, 2026 Generally treated as cancellation-of-debt income, unless another exception or exclusion applies. Check the actual cancellation year, the program rules, and any borrower-specific exclusion.
Public Service Loan Forgiveness (PSLF) or Teacher Loan Forgiveness Federal examples of discharges that do not create federal tax liability when the applicable requirements are met. Confirm that the discharge is under the qualifying program and that its conditions were satisfied.
Death or total-and-permanent-disability discharge Recognized as an exception to the general cancellation-of-debt rule when the applicable requirements are met. Check the discharge basis and current IRS instructions.
Cancellation after qualifying work requirements or qualifying repayment assistance Some work-based cancellations and qualifying assistance can be tax-free under federal rules. Verify the specific program, employer or service requirements, and the type of assistance.
Bankruptcy or insolvency May allow a separate exclusion from gross income, subject to the relevant rules and limits. Determine whether the facts meet the applicable test and whether Form 982 is relevant.

The 2021–2025 rule is a time-limited federal provision, not a blanket promise that all student debt forgiven in those years is tax-free. IRS Topic 431 and the 2025 edition of IRS Publication 4681 describe the special rule and other exclusions. The Taxpayer Advocate Service’s March 23, 2026 guidance says IDR debt forgiven in 2026 or later is generally cancellation-of-debt income and may be reported on Form 1099-C.

Other federal exclusions can matter

The IRS identifies additional exceptions to the general rule that canceled debt can be income. They include certain cancellations after qualifying work requirements and discharges because of death or total and permanent disability. Publication 4681 also describes qualifying repayment assistance through the National Health Service Corps, certain state education-loan repayment programs, and certain state programs focused on health services in underserved areas or health-professional-shortage areas. These provisions depend on their own statutory and program conditions; a similar-sounding job, award, or discharge label is not enough by itself.

Bankruptcy and insolvency are separate potential exclusions. Insolvency generally concerns whether your liabilities exceeded the fair market value of your assets immediately before the debt was canceled; the amount that may be excluded depends on the applicable rules and your circumstances. The Taxpayer Advocate Service notes that Form 982 may be relevant when claiming an insolvency exclusion. Bankruptcy-related exclusions also have specific requirements. Use the current IRS instructions and records for the cancellation year rather than treating either label as an automatic exemption.

Why a federal exclusion does not settle state tax

States do not necessarily follow the federal result. Some conform to federal rules, while others apply their own exclusions, additions, or definitions; state rules can also change. Federal Student Aid advises borrowers to check the relevant state’s current guidance. The following official examples illustrate different approaches, but they are not a complete state-by-state guide.

State example What the cited state source says How to use the information
Indiana The Indiana Department of Revenue says a statutory add-back remained in place for some federal student-loan discharges during 2021–2025, despite the federal exclusion. Check Indiana’s instructions for the specific filing year and discharge type; do not assume the federal exclusion carries over.
California A Legislative Analyst’s Office report dated October 1, 2026, discusses temporary state exclusions and forgiveness types within its scope, including PSLF, long-term repayment, and death or disability discharges. The report is California-specific and limited to the matters it discusses. Confirm current law and filing guidance for the year at issue.
Pennsylvania The Department of Revenue says student-loan payments or cancellation generally are not subject to Pennsylvania personal income tax unless the student provides services directly to the payor or lender in exchange. Apply the state’s stated service-related qualification to the actual arrangement and confirm the current guidance.

As of Federal Student Aid’s August 2026 guidance, nine states have no individual state income tax: Alaska, Florida, Nevada, New Hampshire, South Dakota, Tennessee, Texas, Washington, and Wyoming. That fact concerns state income tax only; it does not change whether a discharge is taxable on a federal return. It also does not resolve other state or local tax obligations.

For a borrower-specific state answer, establish where you were resident and filing for the discharge year, then look up the rules from that state’s revenue department. If you moved during the year, had more than one filing state, or received a large discharge, the relevant state rules may require more careful review than a single-state summary can provide.

What to do when forgiveness occurs

  1. Identify the program and legal basis. Save the servicer or agency’s discharge notice and determine whether the debt was canceled through IDR, PSLF, Teacher Loan Forgiveness, death or disability, qualifying service, repayment assistance, bankruptcy, or another route. Do not rely only on a shorthand description such as “student loan forgiveness.”
  2. Establish the dates. For IDR, find the last-payment date that marks the end of the repayment period and compare it with the January 1, 2021–December 31, 2025 window. Separately establish the year the debt was actually canceled for tax reporting. Keep supporting notices and account records.
  3. Check federal exceptions before treating the amount as taxable. Consult IRS Topic 431, the applicable edition of Publication 4681, and current IRS instructions for any program-specific rule, bankruptcy exclusion, or insolvency exclusion that may fit your facts. Form 982 may be relevant to an insolvency claim or other applicable tax-attribute rules.
  4. Review any Form 1099-C. The Taxpayer Advocate Service says borrowers with IDR debt forgiven in 2026 or later may receive Form 1099-C in January or February following a cancellation. Compare the form with your discharge documents and applicable rules. The form is information about canceled debt, not by itself a ruling that the full amount is taxable.
  5. Check state treatment independently. Use the revenue agency’s instructions for the state and tax year that apply to you. Verify whether that state follows the relevant federal provision, has an add-back, or provides its own exclusion.
  6. File the correct year and amount. IRS Topic 431 says taxpayers remain responsible for reporting the correct taxable amount for the year cancellation occurred, even if Form 1099-C is inaccurate. If the form appears wrong, keep records of the discrepancy and use the IRS’s current instructions for handling it; do not assume an incorrect form changes the underlying tax result.

Common mistakes that lead to the wrong answer

  • Using the announcement date instead of the relevant date. For the IDR distinction, Federal Student Aid keys its guidance to the end of the repayment period. For reporting, IRS guidance points to the year the cancellation occurred. These dates serve different purposes.
  • Assuming all 2021–2025 forgiveness is exempt. The temporary federal rule covers qualifying discharges, not every debt cancellation or every program. Confirm that the particular discharge falls within the rule.
  • Assuming all forgiveness after 2025 is taxable. Later IDR cancellation is generally cancellation-of-debt income, but separate statutory exceptions and borrower-specific exclusions may still apply.
  • Transferring the federal answer to a state return. State law can diverge, as the Indiana example demonstrates. Check the state’s rules for the actual year and program.
  • Equating a Form 1099-C with a final tax bill. The form should be reviewed, but applicable exclusions and the correct taxable amount still matter. Conversely, a missing or inaccurate form does not erase a taxpayer’s reporting responsibility.
  • Assuming a program name guarantees qualification. PSLF, Teacher Loan Forgiveness, service-based cancellation, and repayment assistance each have conditions. Confirm the actual legal basis of the discharge.

Official guidance to consult

For federal rules, use Federal Student Aid’s IDR forgiveness FAQ, IRS Topic 431, IRS Publication 4681 (2025), the current Form 982 instructions, and the Taxpayer Advocate Service’s March 23, 2026 guidance on cancellation-of-debt income. For state filing, consult the revenue department for the state and tax year that apply. Tax materials can change, so verify current instructions before filing.

No official source cited here establishes a current, complete 50-state matrix covering every student-loan program and discharge year, or a representative tax bill for borrowers. A discharge’s tax cost, if any, depends on the amount treated as taxable, the taxpayer’s circumstances, and the applicable federal and state rules.
