Apple’s UK iCloud case explained: what the £3 billion claim means for iPhone users

Which?’s £3 billion UK iCloud case against Apple has cleared a procedural hurdle. Here is what the allegations, class rules, deadlines and possible compensation really mean.

Which?’s UK collective case against Apple over iCloud has cleared a major procedural hurdle, but Apple has not been found liable and no compensation has been awarded. On June 17, 2026, the Competition Appeal Tribunal allowed the claim to proceed. Which? alleges that Apple used control of iOS to favour iCloud over rival cloud-storage services. The case is pending, with trial currently listed for October 2028.

The original 2024 headline described the claim as worth about $3.8 billion. That was an exchange-rate conversion of an approximately £3 billion claim—not a US-dollar lawsuit, judgment or guaranteed payout.

What is the Apple iCloud case?

The formal case is Consumers’ Association (“Which?”) v Apple Inc., Apple Distribution International Limited, Apple Europe Limited and Apple Retail UK Limited. It is being heard in the UK Competition Appeal Tribunal under case number 1689/7/7/24 as collective proceedings under the Competition Act 1998.

Which? seeks compensation for alleged consumer loss and behavioural or injunctive remedies intended to prevent the alleged conduct continuing. The pleaded legal bases are an alleged breach of Chapter II, section 18 of the Competition Act 1998 from October 1, 2015, and an alleged breach of Article 102 of the Treaty on the Functioning of the European Union for the period from October 1, 2015 to December 31, 2020. The Tribunal has not yet decided whether Apple broke competition law.

Case identity, legal basis and timetable are set out by the Competition Appeal Tribunal.

What does “iCloud monopoly” mean?

“Monopoly” is shorthand for Which?’s allegation, not a judicial finding. The claim argues that Apple is dominant in the iOS ecosystem and leveraged that position in the related cloud-storage market.

The alleged technical restrictions

According to the Tribunal’s summary of the claim, Apple allegedly gives iCloud preferential technical treatment and prevents or limits rival providers from storing or backing up significant categories of iPhone and iPad data. Which? says this can make a comprehensive device backup effectively dependent on iCloud.

The alleged choice architecture

Which? also challenges Apple’s interface and setup choices. Its case is that defaults, prompts and product design steer users towards iCloud instead of allowing rivals to compete on equal terms. The allegations, including the technical and design theories, are described in the Tribunal’s collective-proceedings judgment.

This is not a claim that Google Drive, OneDrive or Dropbox cannot store files or photos on an iPhone. The legal question is whether those services can offer a complete or functionally equivalent backup for the data categories iCloud handles, and whether Apple’s restrictions or defaults prevent that competition.

Why consumers use iCloud

Apple includes a free 5GB iCloud allowance with an Apple account. Photos, messages, device backups and app data can consume that space, leading some users to buy additional iCloud+ capacity. iCloud is integrated with Apple account settings, device backup and restoration, Photos and other system features.

Rival services can handle many files and photos, but a third-party storage subscription is not automatically a replacement for Apple’s native iPhone or iPad backup workflow. Which?’s claim concerns that difference, rather than simply the existence of competing storage apps.

How much money is involved?

Dividing £3 billion by 39.7 million would not establish an equal payment for everyone. Damages could depend on the relevant period, the service obtained, the class definition and the Tribunal’s eventual methodology. Which? previously referred to an average of about £70 in 2024, so estimates have changed.

Who may be included?

The described class covers consumers who obtained iCloud services on an iPhone, iPad, iPod touch or another Apple mobile device using iOS between November 8, 2018 and June 8, 2026. It includes people who used the free 5GB allowance and those who paid for additional storage, including iCloud+ obtained through Apple One.

The Tribunal’s formal orders control eligibility. Use the official CloudClaim eligibility guidance and claim documents rather than assuming that any Apple storage use guarantees inclusion.

What UK consumers need to do

If you lived in the UK on June 8, 2026

If you satisfy the class definition, you are generally included on an opt-out basis. You do not need to submit an individual claim form simply to remain in the case. You can opt out if you do not want to participate.

If you lived in the UK during the period but moved away

You may need to opt in rather than being included automatically. Which? gives October 8, 2026 as the deadline for opting in or opting out. Forms and the eligibility tool are available at the official claim website.

What registration does—and does not—do

Signing up for updates is not the same as filing an individual damages claim, and it does not guarantee money. Which? says compensation depends on the case being won or settled. Do not pay an unofficial claims company merely to check eligibility.

What the Tribunal has decided so far

Collective Proceedings Order

The Tribunal’s April 2, 2026 judgment described the alleged technical restrictions and choice architecture. On June 17, 2026, the Tribunal made a Collective Proceedings Order (CPO), allowing Which? to bring the case on behalf of the proposed class. A CPO is a procedural gateway: it does not decide that Apple abused a dominant position or that consumers are owed damages.

Non-Purchasing Customers issue

On May 6, 2026, a Tribunal majority rejected Apple’s attempt to strike out part of the claim involving “Non-Purchasing Customers”—people who did not pay for iCloud during the relevant period but may have valued access to a cheaper competing service. The majority considered that issue suitable for trial. Tribunal chair Waksman J dissented and said it should have been struck out. The split shows that this part of the case remains legally contested, not resolved in Which?’s favour.

Apple’s position

Which? reported that Apple rejected the suggestion that its iCloud practices are anti-competitive and would vigorously defend any legal claim. That is Apple’s stated position as reported by Which?, not a finding by the Tribunal. No newer direct Apple statement is established here.

What happens next?

  • November 27, 2026: case-management conference.
  • October 2028: trial listed for the first available date, with an estimated duration of nine weeks.

As of August 18, 2026, the case remains pending. There is no final liability decision, confirmed settlement or payment timetable.

Why the case matters beyond iCloud

The dispute tests how competition law treats a platform that controls an operating system and also sells a related service. It raises questions about self-preferencing, interoperability and defaults: can a platform restrict what rivals can technically do, or design setup flows that make its own service the practical choice, while still claiming that alternatives exist?

It also tests how consumer harm should be measured where some people used free storage, some paid for iCloud+, some received iCloud+ through Apple One and some may have wanted a rival service without ever buying Apple storage. The Tribunal’s eventual findings—not the headline claim value—will determine whether any compensation is payable and how it is calculated.

Considering alternative cloud storage?

Changing storage providers does not preserve, reduce or otherwise alter legal rights in this case. A product should be judged on the data it actually supports, not described as a complete iCloud replacement without qualification.

Current prices, storage allowances and promotions should be checked on each provider’s official page on the date you buy. Which?’s reported 2024 allegation that UK iCloud prices rose by 20% to 29% across tiers in 2023 is historical and is not a current price comparison.

Do free 5GB iCloud users count?

Which?’s described class includes users of the free allowance, but inclusion does not guarantee that a person will receive damages if the case succeeds.

Is this a settlement?

No. The Tribunal has allowed collective proceedings to continue; it has not approved a settlement or found Apple liable.
