El acuerdo no fue un veredicto judicial que declarara culpable a Apple. En mayo de 2026, el DOJ informó que había procesado la distribución del fondo compensatorio completo de 18,25 millones de dólares.
Qué alegó el Departamento de Justicia
La investigación del DOJ, iniciada en febrero de 2019, concluyó —según la agencia— que Apple incurrió en un patrón o práctica de discriminación por estatus de ciudadanía al reclutar para puestos que cubría mediante PERM. El acuerdo escrito sitúa el periodo investigado desde, como mínimo, el 1 de enero de 2018 hasta al menos el 31 de diciembre de 2019. El DOJ sostuvo que las prácticas disuadieron de postularse a trabajadores estadounidenses y a ciertos no ciudadanos protegidos, mientras Apple prefería cubrir esos puestos con beneficiarios de PERM.
PERM es un proceso de certificación laboral que permite a empleadores patrocinar a trabajadores para obtener la residencia permanente después de cumplir requisitos de reclutamiento y otros requisitos del programa. El Departamento de Trabajo y el Departamento de Seguridad Nacional administran el proceso. El asunto se refería a cómo se reclutaba para puestos asociados a PERM, no a una prohibición general de contratar a personas por su ciudadanía.
Las prácticas de reclutamiento cuestionadas
El DOJ dijo que Apple no publicaba los puestos PERM en su sitio externo de empleo, aunque normalmente anunciaba allí otras vacantes. Para esos puestos exigía solicitudes impresas enviadas por correo, mientras que para otras vacantes aceptaba solicitudes electrónicas. En algunos casos, según la agencia, tampoco consideró solicitudes electrónicas de empleados de Apple para puestos PERM.

El 21 de mayo de 2026, el DOJ informó que había procesado la distribución de la totalidad del fondo de 18,25 millones de dólares a trabajadores cualificados. La agencia dijo que evaluó individualmente a miles de posibles reclamantes. El DOJ señaló que Apple ya había aplicado algunas medidas después de que comenzara la investigación. ¿Todavía se puede reclamar parte del fondo?
El DOJ informó en mayo de 2026 que ya había procesado la distribución completa del fondo compensatorio. Eso no permite concluir por sí solo si existe algún trámite individual pendiente o qué opciones tendría una persona concreta. Qué significa el acuerdo —y qué no significa
El acuerdo resolvió las alegaciones del DOJ sin que las fuentes oficiales citadas describan un veredicto judicial que declarara culpable a Apple. Kristen Clarke, entonces Assistant Attorney General de la Civil Rights Division del DOJ, afirmó en noviembre de 2023: “Creating unlawful barriers that make it harder for someone to seek a job because of their citizenship status will not be tolerated.” La cita expresa la postura institucional de la agencia en ese momento.
